The Compatibility Of The Substance Over Form Doctrine With Tax And Investment Treaties: A Case Study Of Lone Star V The Republic Of Korea, Blazej Kuzniacki
The Compatibility Of The Substance Over Form Doctrine With Tax And Investment Treaties: A Case Study Of Lone Star V The Republic Of Korea, Blazej Kuzniacki
Research Collection School Of Accountancy
In late August 2022, the Lone Star tribunal concluded one of the latest awards in tax-related investment treaty disputes (the tax-related claims account for almost USD 1.5 billion of the total of almost USD 4.7 billion claimed in compensation). It also is the first award in which the tribunal dealt with the application of the substance over form doctrine (SOFD) by tax authorities and courts of the host state to prevent the abuse of a double tax treaty (DTT), and the impact of the refusal to accord the claimants the benefits under the DTT via a domestic (Korean) SOFD on …

This op-ed encourages all to reflect on their year and examine whether they have lived meaningfully according to their yardstick of meaning, the legacy they want to leave behind, and whether their talents and credentials are empowering and enabling, rather than restricting them. It is written as part of a research project examining success and flourishing in Singapore.

The Relationship Between Police Stress And Officer Misconduct, Leobardo Lopez-Cristobal
The Relationship Between Police Stress And Officer Misconduct, Leobardo Lopez-Cristobal
UNLV Theses, Dissertations, Professional Papers, and Capstones
Recent high-profile and controversial police-related incidents have sparked an intensified public discourse on police misconduct. This has resulted in increasing calls for greater accountability and transparency within U.S. police agencies. Much of the existing research on police misconduct centers around two competing explanations: the "bad apples" perspective, which attributes misconduct to individual officers, and the "bad barrels" perspective, which points to systemic or organizational factors (Rojek, Decker, & Wagner, 2015). However, one factor that has been underexplored in the literature is the role of police stress in influencing deviant police behavior. Previous studies suggest a potential link between police-related stress …

How White Supremacy Travels Through Time: Anti-Literacy Laws, Dei Bans, And The Issue Of Black Self-Determination In Public Health., Nicole V. Ford
Electronic Theses and Dissertations
This dissertation used a qualitative policy content analysis (PCA) of historical anti-literacy laws and modern DEI bans to answer two research questions: What is the connection between anti-literacy laws and DEI bans? How do anti-literacy laws and DEI bans create an environment that maintains white supremacy? A PCA exercise informed the analysis of historical anti-literacy laws in South Carolina (1834), Georgia (1829), North Carolina (1830), Louisiana (1830), Virginia (1831), and Alabama (1833) and modern DEI bans in Texas (2023), Alabama (2024), and Florida (2023) to find the connection between the laws. Findings from this dissertation illustrate how white supremacy operates …
Disputing Personal Data In The Eu-China Comprehensive Agreement On Investment, Mark Mclaughlin
Disputing Personal Data In The Eu-China Comprehensive Agreement On Investment, Mark Mclaughlin
Research Collection Yong Pung How School Of Law
This chapter analyses the emerging data realms in China and the European Union against the backdrop of the Comprehensive Agreement on Investment (CAI). It examines the link between data protection and investment flows and undertakes a comparative analysis of the PIPL and GDPR. Moreover, this chapter will also analyse the Digital Silk Road in promoting China’s model of data sovereignty. While early trade and investment agreements did not consider data relevant for the regulation of cross-border commerce, modern treaties are increasingly cognisant of rules for data protection. As such, the data-related provisions of the CAI will be placed in the …

Introduction To Intellectual Property, Innovation And Economic Inequality, Daniel Benoliel, Peter K. Yu
Faculty Scholarship
This chapter provides an introduction to Intellectual Property, Innovation and Economic Inequality. It begins by discussing the problem of economic inequality, including the scale of that problem, types of economic inequality, and extant research on such inequality. The chapter then outlines the structure of this volume, which is divided into three parts: (1) theoretical, empirical, and policy issues; (2) intellectual property and national inequality; and (3) intellectual property and global inequality.
Ai: A New Lone-Wolf Terrorism In The Digital Era (Preliminary Analysis), Marthsian Yeksi Anakotta Mya
Ai: A New Lone-Wolf Terrorism In The Digital Era (Preliminary Analysis), Marthsian Yeksi Anakotta Mya
Journal of Terrorism Studies
This article addresses two fundamental inquiries: can AI engage in acts of terrorism? If so, how might such a phenomenon occur? My hypothesis posits that AI is capable of independently committing acts of terrorism, a classification derived from the study of terrorism known as lone-wolf terrorism. To address these dual issues, this article adopts a criminological approach, which is further elaborated through an examination of lone-wolf terrorism and the advancement of artificial intelligence. As is widely recognized, contemporary terrorist organizations have harnessed technological advancements in the realm of information and communication to perpetrate acts of terrorism within the digital sphere. …
Repurposed Energy, Alexandra B. Klass, Hannah Wiseman
Repurposed Energy, Alexandra B. Klass, Hannah Wiseman
Articles
Wildfires, weather extremes, and other conditions induced partially by climate change add urgency to the project of accelerating the clean energy transition from fossil fuels to zero-carbon energy infrastructure. Yet the hurdles to accomplishing such a massive industrial-scale transition are daunting. Indeed, large renewable energy generation projects regularly face denials or project-killing delays across the United States. This Article proposes a national policy to channel the bulk of new clean energy projects to targeted categories of both rural lands and urban, post-industrial lands that we define collectively as “repurposed energy” sites. Such lands will consist of marginal farmland, abandoned coal …

(Un)Worlding With Karipuna’S Shadowy Alliances: The Mirangã And The Isolados, Hanmin Kin
Tipití: Journal of the Society for the Anthropology of Lowland South America
This ethnographically inspired article investigates the ways in which the Karipuna Indigenous people in Rondônia defend their land in the Western Brazilian Amazon against forces of deforestation and dispossession. I focus on the Karipuna’s plurivalent and collective forest spirits called the mirangã, through life experience accounts of two survivors from the “pre-contact” era who embody the Karipuna-mirangã connection. Through an analysis of the onto-epistemological entanglements in which the mirangã and my interlocutors are situated, I articulate another front of the Karipuna’s multi-faceted resistance: the struggle of worlding vis-à-vis the non-indigenous world. This process also reveals the association (from …

Placing The Four Rounds Of Israeli-Palestinian Negotiations In The Twenty-First Century In A Historical And Philosophical Context, Michael J. Reimer Dr
Department of Political Science and Law Faculty Scholarship and Creative Works
This paper will take a three-pronged approach to the analysis of prior treaty negotiations and their comparison to the Israeli Palestinian conflict. The first prong, which will be addressed in the next section, will be a historical analysis of other treaty negotiations which resulted in end of conflict treaties. These examinations will include The Congress of Vienna, 1814-1815; the Portsmouth Treaty, 1905 which involved a Treaty between a European and a non-European state2 negotiated by the President of the United States and American Diplomats; the Paris Peace Conferences of 19193 ; and Multiparty Mediation in Cyprus, 1963-1965. In each of …

Consent: From Generation To Co-Production, Artchil Bellosillo Fernandez
Social Sciences and Development Review
The concept of consent and its origin is a topic of intense debate within academia. This paper contributes to the discussion by examining two main perspectives on consent. One viewpoint argues that consent is manufactured or produced, particularly by the ruling class, known as the Marxist perspective on consent. This perspective is supported by the ideas of three influential Marxist thinkers – Antonio Gramsci, Michael Burawoy, and Louis Althusser. The other perspective on consent comes from relational sociology, which suggests that consent is a collaborative effort between the parties involved. This paper delves into the works of three sociologists – …

Immigration judges (IJs), housed within the Executive Office for Immigration Review within the Department of Justice (DOJ), make decisions in asylum and withholding claims, which are life or death matters. And although their title is “judge,” IJs are DOJ attorneys who lack independence and are par- ticularly susceptible to political pressures. Federal court judges and scholars alike have criticized the quality and fairness of IJ decision-making, and many studies have been carried out to better understand the factors that impact it. The prior studies have relied principally on quantitative data because IJ decisions are not publicly available or searchable in …

Strangers To The Algorithm: The Effects Of Algorithmic Decision-Making In Removal Proceedings On Due Process Rights, Otoniel Ramos
Strangers To The Algorithm: The Effects Of Algorithmic Decision-Making In Removal Proceedings On Due Process Rights, Otoniel Ramos
Undergraduate Research Symposium Podium Presentations
This paper investigates the impact of algorithmic decision-making tools on due process rights, particularly within immigration removal proceedings. Deviating from prior studies, which primarily focused on various measures of fairness or the long-term racial stratification as a consequence of these tools, this research emphasizes the implications for due process—a fundamental legal principle enshrined in the U.S. Constitution. By examining ICE's use of these tools between July 2012 (when they were adopted) and October 2016, the study reveals the ways algorithmic input may inadvertently erode principles of procedural justice, especially adjudicatorial independence, in a setting where the rights of non-citizens are …

Immigration: Ancient Counterparts And Processes, Monica Souza Sue
Undergraduate Research Symposium Posters
This project sought to inspect parallels between modern and ancient societies, and the commonality of certain events and political markers. This project makes mentions of power dynamics, the position of immigrants as a source of labor, and their commodification as a force. Research used a 'compilation of materials' method. In which, is performed the examination and studying of different materials in relation to the question, compiling findings, and crafting commentary based on the discoveries of the medias. The experiences of immigrants in the United States are strongly comparable to the experiences of metic (immigrant) women in ancient Athens. A small …

Korea: The Enduring Policy Blindspot, Justin Malzac, Rene A. Mahomed
The US Army War College Quarterly: Parameters
The threat posed by the Democratic People’s Republic of Korea is a neglected and under prioritized problem across the US government, requiring a dramatic change of approach. Most proposals for Goldwater-Nichols reform focus on geography, either increasing or decreasing the number of geographic commands. Based on our personal experience as Joint military planners at strategic-level headquarters, we argue that the change needs to go further, focusing on global national security problems instead of geography. This article’s analysis and conclusions will provoke conversation across the national security enterprise about how the United States competes with multiple global threats.
Ethical Considerations In Qualitative Research After Dobbs, Sabrina Singh
Ethical Considerations In Qualitative Research After Dobbs, Sabrina Singh
Pace Law Review
The verdict in the Dobbs case will undoubtedly have an impact on the United States research enterprise for years to come. Since the landmark decision was handed down by the high court, researchers have warned of the impacts that the decision will have on clinical research. However, there is less discussion about how qualitative researchers will be impacted by this decision. Oftentimes, qualitative researchers are asking their participants to be vulnerable and to let researchers be privy to intimate and/or confidential details about their lives. In exchange for such access, researchers need to ensure the protection of their participants and …
The American Way Of Studying War: What Is It Good For?, Michael P. Ferguson
The American Way Of Studying War: What Is It Good For?, Michael P. Ferguson
The US Army War College Quarterly: Parameters
Academic military historians, government institutions, and defense practitioners have unique purposes for advancing the study of war that influence the way they consume and produce history. Although there is substantial scholarship covering how the discipline of military history has changed since the late nineteenth century, the literature surrounding why it changes and how it is used is less plentiful. Using primary and secondary sources to contextualize debates between historians, this study traces major developments in military historiography, considers the US Army’s relationship with its history, and explores potential connections between a history’s purpose and its use for military professionals.
We Have Lost Our Minds, Teneille Ruth Brown
We Have Lost Our Minds, Teneille Ruth Brown
Pace Law Review
This Article examines the paradoxical treatment of autonomy in American healthcare law. While autonomy has become the dominant principle in medical ethics and neoliberal market philosophies, pregnant people have been systematically denied this same autonomy through increasingly restrictive abortion statutes. Using the rhetoric of “informed consent,” abortion-restrictive statutes ironically pervert the animating principles behind the doctrine—rendering it almost meaning- less. I argue that this contradiction stems from the dehumanization of pregnant people who seek abortions, particularly through the denial of their capacity to have individual, complex mental states and feelings. Drawing on moral psychology, the Article demonstrates how pregnant people …
