The deluge of scientific research data has excited the general public, as well as the scientific community, with the possibilities for better understanding of scientific problems, from climate to culture. For data to be available, researchers must be willing and able to share them. The policies of governments, funding agencies, journals, and university tenure and promotion committees also influence how, when, and whether research data are shared. Data are complex objects. Individual employer-employee relations are regulated by a regime called 'employment law'. Despite the inadequate semantic clarity in our legal system regarding the usage of the words 'employment law' and 'labour law', the latter is 'understood as the regime that governs workers' efforts to advance their own shared interests through self-organisation and collective protest, pressure, negotiation and agreement with employers. Το κείμενο αυτό είναι μέρος μιας ευρύτερης προβληματικής η οποία θεωρεί ότι η συνολική Κυπριακή πολιτειακή εμπειρία αποτελείται από ένα σύστημα πολλαπλών, αντιφατικών και αλληλο-τεμνόμενων καθεστώτων εξαίρεσης, το οποίο βιώνει μια βαθειά ή καλύτερα οργανική κρίση. Από την μια μεριά τείνει να διαιωνίζει τους όρους ύπαρξης του μέσα από την σταδιακή κανονικοποίηση του, και από την άλλη μεριά όμως το ίδιο το σύστημα παρουσιάζει τέτοιες βαθύτατες δυσλειτουργίες που υπονομεύουν την ίδια ύπαρξη του. In response to over-exploitation and ecosystem degradation, United States federal fisheries policy is shifting from species-based to ecosystem-based management. In addition, the reauthorized Magnuson-Stevens Fisheries Conservation and Management Reauthorization Act of 2006 identifies the following goals to be achieved by 2011: end over-fishing, create market-based incentives, strengthen enforcement mechanisms, and improve cooperative conservation efforts. We refer to these goals (including the “status quo”) as front-ended policy objectives. Left unresolved are what we term back-ended policy and legal issues, specifically including issues involving the legal limitations that inhibit full consideration of ecosystem-based management principles through the adopting of scientific information. The advance of technology profoundly impacts how people interact with culture as the proliferation of digital networks transforms the effects of copyright in modern societies. This paper argues that the oligopolistic conditions of content markets and the legal discourse of intellectual property law have historically enabled copyright holders to promote a limited conception of art and obscure the complexities of copyright theory. While conceptual ambiguity is inevitable in the construction of aesthetic legal categories, current practices impose too many restrictions. Juvenile Diversion: Results Of A Three Year Experimental Study, Steven Patrick, Robert Marsh

In a three year longitudinal study of first time juvenile status offenders assigned at random to three treatment groups and a control group, no significant differences were found in recidivism rates among the groups. A total of 398 juveniles in this study were cited for offenses of tobacco or alcohol in a medium-sized metropolitan northwest city. The offenders were assigned at random to four groups: a traditional magistrate court, a traditional Youth Court diversion program, a new non-judicial diversion program and a control group. None of the groups including the control group showed a significant difference in recidivism rates. It …

The author criticizes the power of the Chilean Constitutional Court to exercise compulsory ex-ante control of statutes, established in article 93, number 1, of the Chilean Constitution. After clarifying its special juridical nature, he analyzes the advantages and disadvantages of this system of control, using national and foreign bibliography. The existence of a constitutional seal aggravates the disadvantages. Then, he dedicates a section to study the motivation of the judgments generated in this type of control, questioning its value.
