Discussion of the infamous "Christmas Controversy" – the legality of religious symbols in holiday displays on public land. This issue is examined both from the viewpoint of an attorney and a scholar of religion: From a legal point of view, the article examines the holdings of three major Supreme Court cases which have addressed this issue. From the viewpoint of religious scholarship, the article examined the relevant sociology of religion, which is also an important factor in accounting for why, in spite of settled precedents, this issue remains controversial.

A detailed reading of the Mormon plural marriage case of Holm v. Utah uncovers the significant role that visual indicators play in modern marriage law and generates a set of initial questions about the relationship between marriage practice and public performance. Traditional publicity requirements, such as endowment at the church door, wedding banns, and wedding announcements, all confirm the historical role and importance of publicity in marriage regulation and wedding ritual. Publicity requirements serve multiple purposes – evidentiary, status-granting, accountability enabling – and also highlight the importance of community, audience and locality to marriage status. Owner-Controlled Insurance Programs (OCIPs, also referred to “Wrap-Up” programs), are becoming a popular insurance program in the construction industry. Some states have placed statutory restrictions and/or prohibitions on OCIPs. However, there are only 10 states to date which have even enacted any statute concerning OCIPs.
In this article, I contend that the future availability of OCIPs in the insurance industry may largely be dictated on statutory grounds. It is a call for state legislatures to critically examine the policies and purposes of OCIPs and to enact legislation which provides guidance to the industry and courts. First, two cases, one from …

The situation of women in Israel is a complex one. While in many respects women enjoy advanced liberal citizenship rights, in other respects, especially in the domain of personal status law, they suffer from serious restrictions on their rights and from discrimination. I will argue that this discrimination is the result of Israel's commitment to maintaining its character as a Jewish state through a preservation of a Jewish majority in Israel. This commitment results in legal restrictions on the right to marry and on the right to have an abortion, both of which, as I will show, are strongly related …

A razão jurídica racionalista fez-se abstraccionismo e dogmatismo e tornou-se legalismo. O Direito ficou, em muitos casos, empedernido e injusto. Abrir o Direito aos sentidos e aos sentimentos, na senda, por exemplo, de um Luis Alberto Warat, sendo fascinante e iconoclasta, não é tarefa fácil, se for empresa prudente.
