Using Management Techniques To Solve Environmental Problems, Patrick D. Kelly

Arguing that little effective progress is being made in solving problems of varying urgency, this paper suggests a leadership role for science and engineering societies. It proposes that such societies attempt to prioritize problems and attempt to focus public awareness (and calls to action) in a more systematic way.

The final paper from the symposium on public participation in Risk management discusses existing procedures for ensuring the integrity of advisory committee recommendations. It concludes that they are inadequate and argues that accountability would be better served if nonexperts were included. It also suggests that, in any event, measures need to be taken to indicate, e.g., the bases for committee conclusions.

Recent law and economics scholarship has produced much theoretical and empirical work on how and why legal disputes are settled and litigated. One of the most significant developments in this literature, attributable to the work of William Baxter and the combined efforts of George Priest and Benjamin Klein, has been the formation of a theory about both the selection of disputes for trial and the rates of success that plaintiffs enjoy for those cases that are resolved at trial. Most revolutions are noisy, tumultuous affairs. This is as true of significant shifts in legal doctrine as it is of shifts of political power through force of arms. The pro-plaintiff revolution in products liability in the early 1960s will forever be associated with heroic, martial images, epitomized in Prosser's description of the assault upon, and fall of, the fortressed citadel of privity. In contrast to these noisy, exuberant events, the revolution to which we refer has gone all but unnoticed. Industrial Waste: Saving The Worst For Last?, John C. Dernbach

This article explains why industrial waste that is not legally hazardous must be given greater attention and regulatory oversight. Industrial waste (including coal ash) may represent as much as 94 percent of municipal, hazardous, and industrial wastes combined. The article explores the existing federal framework for industrial waste and looks at innovative state approaches, particularly the approach taken in Pennsylvania. The article recommends four national goals for addressing industrial waste: energy and materials conservation, environmental protection at waste management facilities, prompt and significant results, and genuine state and federal partnerships. Dumping of wastes into the ocean has gone on for years especially in the New York Bight. The National Oceanic and Atmospheric Administration (NOAA) is mandated by Title II of the Ocean Dumping Act of 1972 to investigate the effects of ocean dumping on the marine environment. However, there is a perception within Congress, the public and other agencies that NOAA is not meeting it's responsibilities with regard to ocean dumping research. The effectiveness of NOAA's ocean dumping policies and programs and the difficulties in implementation experienced by the agency are evaluated by applying George Edwards' theory of policy implementation. …
