and in title examination upon which the public records doctrine and the "new recording act"' have a bearing. Although most of these issues have existed as potential problems for many years, the extraordinary value of the Haynesville Shale play which has been taking place in Northwest Louisiana recently has caused these and other issues to be disputed more frequently, and at greater stakes. The Haynesville Shale play has given new meaning to the term "other valuable consideration," with consideration being paid to lessors and assignors/sublessors at rates not previously seen in this area of the country. Louisiana has a long and complex relationship with water, one that figures to get more interesting and complex in the years ahead. Culturally and economically, water has shaped Louisiana in powerful and obvious ways. Legally, the relationship has been more obscure, defined more by specific uses and periodic crises that command great attention, than by a systematic approach to management. Louisiana is hardly unique in this regard; indeed this has been the general approach that "wet" eastern and southern states have taken to water management and law. Current Issues In The Louisiana Severance Tax On Crude Oil And Condensate, Robert S. Angelico

This outline will discuss current issues in connection with the Louisiana severanc. tax on crude oil and condensate. First, the law governing this severance tax area will be presented together with the current regulations as promulgated by the Louisiana Department of Revenue. Second, background information will be provided concerning disputes that have arisen in this area going back to the mid-to-late 1990s. Third, the outline will present proposals put forth by the Louisiana Department of Revenue to amend both the statutes and the regulations concerning various issues involved in the severance tax, among them valuation, the transportation deduction, and payout …

When establishing joint ventures or operations for the exploration and/or production of oil and gas, parties typically enter into written agreements, known as joint operating agreements, designed to direct and manage the myriad of issues raised in these ventures. The joint operating agreement designates an operator, who is authorized to act on the behalf of the nonoperators, and specifies each working interest owner's rights and obligations in the joint operation. Issues addressed by the operating agreement include the potential for future acquisitions of mineral interests in the area and the ability to have some continued control over the parties involved …

As an attorney in charge of all legal matters related to minerals, lands, and the environment for the State, quite a few odd, interesting, and obscure issues come across my desk. This paper is intended to provide a brief review of several of the largely unknown, but fairly important, legal matters that are addressed by the State with respect to mineral matters and to provide guidance to practitioners that should assist in an understanding of these matters for future dealings with the State.

Today, the regulation of oil and gas exploration and production activities by substate governmental units has reemerged after a lengthy quiescent period. Oil and gas activities obviously take place where the oil and gas is located. Historically that has been in rural areas, although there are clear exceptions. Population growth and urban sprawl has brought the citizenry to where the oil and gas wells are. People who move to the country not only want urban amenities, they also want the "peace and quiet" that they believe exists in the idyllic rural surroundings.
