The Commerce Clause, Environmental Justice, And The Interstate Garbage Wars, Robert R.M. Verchick

This Article critically examines the Court's garbage cases in conjunction with traditional principles of Commerce Clause jurisprudence for the purpose of constructing a doctrine that is at once constitutionally and ecologically sound. The Article is divided into five parts. Part I briefly describes the current state of the garbage wars, both in terms of environmental effects and in terms of constitutional developments. Parts II and III critically examine the Court's garbage cases from the perspectives of two traditional justifications for the negative Commerce Clause: encouraging fair representation of residents across state lines and discouraging economic protectionism. Protecting And Promoting Wildlife And Habitat On State And Private Land In Washington's Arid Interior, Gregory A. Hicks

The object of this paper is to describe efforts now under way in the interior uplands of Washington State's Columbia Plain to restore and protect upland wildlife habitat and wildlife species in a busy and intensively used agricultural and range landscape. It is a landscape of greatly diminished ecological integrity, dominated by private land holdings, and where the remaining public lands are recovering from earlier periods of farming or grazing or still dedicated to productive use under lease or permit. Recent ecosystem assessments make clear that there are few areas of the Columbia Plain's original grass and shrub land which …

There are several places in the world where war could erupt over a dwindling supply of clean water from shared water resources. As one nation after another finds itself reaching its water resource limits, the potential for conflict among them intensifies. Add to already scarce reserves pollution of the water source, and the global picture appears more menacing. In fact, public health officials attribute al- most 80% of illnesses in developing countries to contaminated water;' the United Nations Children's Emergency Fund (UNICEF) reports that more than 35,000 children all over the world die every day from hunger or disease caused …
