Bridges Of Law, Ideology, And Commitment, Steven L. Winter Walter S. Gibbs Distinguished Professor Of Constitutional Law May 2022

Bridges Of Law, Ideology, And Commitment, Steven L. Winter Walter S. Gibbs Distinguished Professor Of Constitutional Law

Law Faculty Research Publications

Law has a distinctive temporal structure—an ontology—that defines it as a social institution. Law knits together past, present, purpose, and projected future into a demand for action. Robert Cover captures this dynamic in his metaphor of law as a bridge to an imagined future. Law’s orientation to the future necessarily poses the question of commitment or complicity. For law can shape the future only when people act to make it real. Cover’s bridge metaphor provides a lens through which to explore the complexities of law’s ontology and the pathologies that arise from its neglect or misuse. A bridge carries us …

Draft Federal Legislation: Agricultural Economic Empowerment Zones, Samuel C. Kessler

Commonwealth Policy Papers

This draft federal legislation was modified from initial failed attempts to pass Qualified Opportunity Zones, and focused on most bipartisan parts of those attempts to then create a targeted policy of agricultural economic empowerment zones to incentivize sustainability, renewable energy, and upcycling value from biomass to improve local economic interdependence.

Members of the United States Congress and other national governments may make use of this bill draft freely.

Draft State Legislation: Agricultural Energy Net Metering & Power Purchasing, Samuel C. Kessler, Austin Gabhart

This draft legislation was first authored by Commonwealth Policy Coalition Associates Samuel Kessler and Austin Gabhart in 2018, and is now published in 2022 to provide a method of creating improved Agricultural Net Metering and Power Purchase Agreements for agriculture-based energy developments. Shortly after this time, the Commonwealth of Virginia passed similar legislation directly dealing with renewable Net Metering and eventually Power Purchase Agreements in an agricultural context. Those especially in states which do not have Renewable Energy Portfolios which may or may not entail concerns with those portfolios and stakeholders in the nonrenewable industry are urged to consider implementation …

The Role Of Non-Governmental Organizations (Ngos) In Improving Human Rights In Iraq, Naser A. Yahya

Department of Political Science: Dissertations, Theses, and Student Research

Iraq has had a long history of human rights violations since its inception as a modern state in 1921. This is true especially under the personalistic dictatorship of Saddam Hussein. Under his regime, the Iraqi people suffered a consistent pattern of gross violations of internationally recognized human rights, including political imprisonment, torture, and summary and arbitrary executions. This regime used a variety of mechanisms to squelch political dissent, including house-to-house searches; arbitrary arrests, often in large numbers; surveillance; harassment and questioning of family members; detention of targeted individuals, such as those returning to Iraq pursuant to amnesties, at unknown locations; …

Improving Care And Licensing Standards And Oversight In America's Zoos, Hannah Willis May 2022

Improving Care And Licensing Standards And Oversight In America's Zoos, Hannah Willis

Honors Theses

Since 1966, the Animal Welfare Act has been the official federal legislation passed to provide care standards and regulations for publicly exhibited animals, specifically exotic animals within zoos; however, in an age of major advocacy for improved animal welfare standards for all animals, the AWA has remained fairly stagnant in its guidelines for animal exhibitors. Through numerous articles, documentaries, and TV shows, specific zoos and animal exhibitors have shown many Americans that there seems to be little to no governmental oversight over zoos that have engaged in poor animal care or those engaging in often dangerous and cruel animal contact …

A Cleave Within The Piney Woods: Nacogdoches, Stephen F. Austin State University And How Racial Integration Divided The Town And Gown, Caitlin Hornback

Electronic Theses and Dissertations

Stephen F. Austin State University was once the pride and joy of the city of Nacogdoches, Texas. When the Texas State Legislature began to look for a location for their new state normal school, the people of the East Texas town fought to have it built there and the Stephen F. Austin Teacher’s College opened its doors in September 1923 to a proud community. Through the trials and tribulations of early twentieth century events, the school managed to stay afloat and grow in numbers. Dr. Ralph W. Steen became the president of the college in 1958 and he oversaw a …

A Geographically Targeted Approach For A Preceptor Tax Incentive Using Primary Care Health Professional Shortage Areas (Hpsas), Julia Mattingly, Sarah Belcher, Samuel C. Kessler

Commonwealth Policy Papers

Years before the COVID-19 pandemic brought on a health care shortage in Kentucky, its rural areas were already struggling to obtain and attract primary care medical practitioners. Even though the number of medical school graduates in the U.S. has steadily increased throughout the years, there is a general disinterest in rural or small-town practice, and legislators throughout the country have pondered ways to address this issue plaguing communities. Versions of Preceptor Tax Incentive legislation in Kentucky have been proposed in the General Assembly to address care shortages in the state, however, all have been unsuccessful at truly targeting rural areas …

Congressional Rules Of Interpretation, Jarrod Shobe May 2022

Congressional Rules Of Interpretation, Jarrod Shobe

William & Mary Law Review

Many scholars argue that Congress should adopt federal rules of statutory interpretation to guide judicial interpretation. This Article uses a novel dataset to show that Congress has long used enacted rules of interpretation and has increasingly done so in recent decades. However, it has chosen to do so on a statute-by-statute basis in a way that has gone mostly unnoticed by scholars and judges. We developed a dataset by using computer code to search the U.S. Code dating back to 1946 for specific phrases indicating a rule of interpretation, then manually checked and classified each rule. These rules not only …

The Hard Work Is Worth It: Overcoming Unfavorable Determinants To Pass Pro-Immigrant Education Policy In A Conservative State Legislature, Megan Cardwell Godfrey May 2022

The Hard Work Is Worth It: Overcoming Unfavorable Determinants To Pass Pro-Immigrant Education Policy In A Conservative State Legislature, Megan Cardwell Godfrey

Graduate Theses and Dissertations

Immigrants, English learners (ELs), and culturally and linguistically diverse (CLD)students often lag behind their White, monolingual peers in academic achievement and English language proficiency. While there are policy solutions to improve academic and linguistic opportunities and outcomes for immigrant/EL/CLD students, such as implementing bilingual instructional models and increasing teacher diversity, these pro-immigrant policies can be hard to come by in some legislative contexts due to unfavorable economic, social, or political determinants. This qualitative case study analyzed the multifaceted political work that contributed to the passage of two pro-immigrant education policies in the Arkansas 93rd General Assembly: a bill for bilingual …

Gender Pay Disparity, The Covid-19 Pandemic, And The Need For Reform, Amy H. Soled Apr 2022

Gender Pay Disparity, The Covid-19 Pandemic, And The Need For Reform, Amy H. Soled

Brooklyn Law Review

The COVID-19 pandemic has exposed and deepened systemic inequities in the United States. One such inequity is gender discrimination in the labor market, evidenced by pay disparity—the difference between women’s and men’s wages. During the pandemic, women left the workforce at double the rate of men. This employment disruption will negatively affect women’s wages upon their return, as well as their lifetime earnings, further widening the pay gap. Pay disparity exploits more than half of the population, decreases gross national product, and stymies economic growth. This article addresses the reasons why existing legislation has failed to close the pay gap. …

Waging Peace: Female Legislators And A State’S Propensity For War, Caitlyn Shrewsbury Apr 2022

Waging Peace: Female Legislators And A State’S Propensity For War, Caitlyn Shrewsbury

Undergraduate Research Conference

Increasing conflict in the international system prompts policymakers and researchers alike to investigate unconventional methods of creating and maintaining peace. For decades, feminist theorists have argued that women exert a pacifying influence at all levels of society; by extension, their engagement in government would temper the aggressive tendencies of states. It stands to reason that the presence of female legislators in a state’s political system decreases its likelihood of conflict.

Policy Solutions To Maximize The Economic Potential Of The Casino Industry Clusters In Tunica County, Mississippi, John Furla

Honors Theses

Tunica County has come a long way over the past 30 years. Grounded in agglomeration theory, this research serves to confirm the quantitative data that claim that the casino clusters in Tunica County serve as the central driver of economic development for the area through the process of spillover. Through six qualitative interviews with officials from Tunica County government and economic development agencies, the collection of descriptive …
