Reflections And Perspectives On Reentry And Collateral Consequences, Michael Pinard
Michael Pinard
This essay addresses the continued and dramatic increase in the numbers of individuals released from correctional institutions and returning to communities across the United States. It provides a brief history of the collateral consequences of criminal convictions, and the ways in which these consequences impede productive reentry. It then highlights national and state efforts to address to persistent reentry obstacles and to better understand the range and scope of collateral consequences. It concludes by offering suggestions for reform.

This symposium issue of the Drexel Law Review marks the anticipated launch of a proposed new section on Law and South Asian Studies of the Association of American Law Schools, including several contributions that were initially presented during a session of the proposed section at AALS Annual Meeting for 2010. The proposed AALS section comes at a moment of heightened interest in the region among lawyers, policymakers, and the public at large in the United States, and is part of a rapidly growing constellation of scholarly initiatives on law in South Asia that have emerged internationally in recent years. The main question which motivates the inquiry undertaken in this book is: what should public prosecutors do when victims withdraw support for domestic violence prosecutions? The answer defended herein can be summarized as follows: within the realm of justified (permissible) action, prosecutors should respond effectively; which is to say that, ceteris paribus, domestic-violence prosecutors should respond as feminists. This claim is intended as a provocative formulation of the proposition that domestic violence prosecutors should act for reasons generated by the value of reconstituting their states (and communities) as less patriarchal. This article surveys President Obama's policy agenda-setting for the first six months of his term. I consider whether the conditions ripe for an ambitious policy agenda and summarize the logic of Presidential agenda-setting. I use this framework to explain the Democrats' agenda for 2009, summarize their progress thus far, and discuss the implications for the Democratic Party in 2010 and after. Although the Democrats have made significant progress on their policy goals, they have not reaped the full political rewards from this success. This article explores the meaning of the Supreme Court's Michigan decisions and their implications for higher education in the judicial, political, and social–cultural context. It concludes that the complex and dynamic interplay of judicial policymaking, politics and public opinion, and demographic changes could have important consequences, including unanticipated ones, in the years ahead.

The Status Of The Uniform Guidelines On Employee Selection Procedures: Legal Developments And Future Prospects, Andrew Ewoh, James Guseh

This article examines the legal status of the Uniform Guidelines on Employee Selection Procedures from the perspectives of judicial opinions and race-norming provisions of the Civil Rights Act of 1991. Specifically, the analysis provides a discussion of important U.S. Supreme Court’s decisions with special emphasis on their relevance for disparate impact theory. Because the 1991 Civil Rights Act has altered the selection procedures somewhat, the article offers implications of these changes for personnel managers or specialists and recommends modification of the Uniform Guidelines.
