In The Halls Of Ivy: Legal Robots, Lester Brickman
In The Halls Of Ivy: Legal Robots, Lester Brickman
Articles
The article argues that law schools must move beyond traditional theoretical education to incorporate clinical training, emphasizing the development of practical skills like client counseling and emotional competence. It highlights the gap between intellectual learning and real-world client interactions, advocating for a more holistic approach to legal education.
Mobilizing Private Law, Richard O. Lempert
Mobilizing Private Law, Richard O. Lempert
Book Chapters
The mobilization of law may be thought of as the process by which legal norms are invoked to regulate behavior. In the area of private law, mobilization has two distinct aspects. The first is the process by which existing disputes become engaged in the legal system. In theory this means that disputes are transferred from an arena where their resolution and the enforcement of resolutions depends on the relative power of the parties as enhanced or constrained by non-governmental normative systems to an arena where disputes are resolved by reference to governmental (legal) norms and resolutions enforced by the power …

The Unpopularity Of Lawyers In America, Jon R. Waltz
The Unpopularity Of Lawyers In America, Jon R. Waltz
Cleveland State Law Review
What's wrong with us lawyers? Mainly, it is that the worst among us pose for our portrait, so that we are viewed as avaricious and egomaniacal, all flair and no substance, seeking and wielding power without having the strength of character to wield it well. Lost to the public is the portrait of most lawyers, the sorts of lawyers that I hope this University produces. They are quiet people who come to the law, and stay with it, because they know that the law's power lets them help people make the best of a trying world.

Third-Year Practice Rules In Virginia: Notes For The Practitioner, George K. Walker
University of Richmond Law Review
It is pleasing to know that all courts sitting in Virginia have provided for student participation in the processing of cases. Within the boundaries of the Commonwealth, there is a uniform recognition of the need and appropriateness of judicial cooperation in the process of educating young men and women in the law.

A Better Prepared Bar – The Wrong Approach, Michael I. Sovern
A Better Prepared Bar – The Wrong Approach, Michael I. Sovern
Faculty Scholarship
It is a pleasure for me to add my voice to this Symposium in pursuit of our shared goal of a better prepared bar. My Brother Clare and his estimable colleagues have labored most conscientiously to produce a proposal that they believe will bring us significantly closer to that goal. I respectfully disagree.
My disagreement does not, however, imply endorsement of all of the criticisms attracted by the report of the Advisory Committee on Qualifications to Practice Before the United States Courts in the Second Circuit (Clare Committee or Committee). To begin with, I do not at all quarrel with …
