The Professions And Noncommercial Purposes: Applicability Of Per Se Rules Under The Sherman Act, Jonathan Cobb Dickey
The Professions And Noncommercial Purposes: Applicability Of Per Se Rules Under The Sherman Act, Jonathan Cobb Dickey
University of Michigan Journal of Law Reform
This article will examine the doctrine of noncommercial purpose in the professional context and assess whether conduct undertaken by the professions conforms to the presumptions underlying the per se doctrine. It is the thesis of this article that the per se doctrine should not preclude inquiry into whether a valid noncommercial purpose justifies conduct undertaken in good faith by a profession to regulate its membership or to advance some other public interest. This article concludes that, with respect to professions, the goals of the Sherman Act are better served by inquiry into noncommercial purposes and application of the rule of …

Improving On The Contingent Fee, Kevin M. Clermont, John D. Currivan
Improving On The Contingent Fee, Kevin M. Clermont, John D. Currivan
Cornell Law Faculty Publications
Two basic fees--contingent and hourly--dominate the variety of fees that lawyers charge clients for pursuing damage claims. Each of these two types has its advantages; each is plagued with substantial disadvantages. This Article proposes a new type of fee, one that preserves the respective advantages of the two present fees while minimizing their distinct disadvantages.
In essence, the proposed fee calls for the payment, on a contingent basis, of an amount computed by adding one component tied to hours worked and another component linked to amount recovered. The preferability and feasibility of this proposed fee argue for the abolishment, or …

Jury Size And The Peremptory Challenge, Richard Lempert
Law Quadrangle (formerly Law Quad Notes)
The article was orginally submitted jointly with Dr. Jay Schulman as prepared testimony to the Senate Judiciary Subcommittee on Improvement of Judicial Machinery. The subcommittee was considering Senate Bill 2074, an omnibus bill which would have required all United States District Courts to switch from twelve to six member juries in civil cases and would have decreased the number of available peremptory challenges in civil cases from three to two. Upon completion of the hearings on this bill, these provisions were deleted from the version sent to the full Committee. It should be noted that most District Courts by local …

The Federal Rules Of Evidence And The Quality Of Practice In Federal Courts, Stephen A. Saltzburg
The Federal Rules Of Evidence And The Quality Of Practice In Federal Courts, Stephen A. Saltzburg
Cleveland State Law Review
One point that I shall endeavor to make today is that the Federal Rules of Evidence offer an opportunity for dramatic improvement in federal trial court practice. In the hands of the most experienced practitioner or the novice litigator just weaned from law school, the evidence rules offer a promise of even-handed justice that has heretofore been unavailable. Used properly, the Federal Rules of Evidence hold out a promise that trials might be less costly to litigants in terms of out-of-pocket expenditures, that the societal costs associated with erroneous decisions by trial judges might be reduced, and that federal litigants' …
The Immunity Of Public Defenders Under Section 1983, Ellen Keller
The Immunity Of Public Defenders Under Section 1983, Ellen Keller
Cleveland State Law Review
The Circuit Courts of Appeals that have considered the question of a public defender's liability issue have all held public defenders or court-appointed counsel immune from personal liability for actions taken in the course of representing their clients. This note will examine the ways in which the courts have disposed of these cases, discuss factors that have inclined federal courts to grant immunity to public defenders under section 1983, and weigh the advisability of personal liability for malpractice of those who defend indigent defendants in criminal trials.
