On Choosing Clients And Careers: A Speculative Essay On The Problems Of Initial Choice, Joseph P. Tomain
On Choosing Clients And Careers: A Speculative Essay On The Problems Of Initial Choice, Joseph P. Tomain
Faculty Articles and Other Publications
This paper deals with the moral dimensions of initial choices of careers and clients. Although the foregoing tale is addressed to the initial choice of career, similar considerations enter into the initial choice of clients. The problems of initial career choice were highlighted because they are more immediate to law students.' In addition, one's choice of career may have a significant effect on future choices of clients.
In order for a lawyer to make an initial choice of either career or client, moral questions of the first rank must be answered. The purpose of this paper is to discuss these …

What Does Bakke Require Of Law Schools? The Salt Board Of Governors Statement, Howard Lesnick
Statements
In 1979, Professor Lesnick wrote a statement for the Board of Governors of the Society of American Law Teachers after the Supreme Court's decision in University of California v. Bakke, 438 U.S. 265 (1978). The question addressed in the statement is: What changes (if any) in minority-admissions programs are university law schools now obligated to make to comply with the Supreme Court's decision in Bakke?

University of Richmond Law Review
Mr. Smithers has been associated with the T. C. Williams School of Law for 50 years, both as a student and as a professor. Over the course of the half-century which has passed since he began his first year as a student in the old building on Lombardy Street, Mr. Smithers has served as example, mentor and friend to countless scores of students and attorneys both within and outside the state. He taught his last regular class at T. C. Williams last year, leaving behind a school saddened by his departure, yet richer for his service. The Editorial Board, therefore, …
Comment: The Texas Bar In The Nineteenth Century, Mary K. Bonsteel Tachau
Comment: The Texas Bar In The Nineteenth Century, Mary K. Bonsteel Tachau
Vanderbilt Law Review
Maxwell H. Bloomfield's Article, "The Texas Bar in the Nineteenth Century," presents an ingenious collage of information derived from more or less standard kinds of secondary works, interspersed with excerpts from the diary of a Texas lawyer and the brotherly correspondence of another, and highlighted with statistical data from the manuscript censuses of 1850, 1860, and 1900.Although the evidence centers on Galveston, the careers of William Pitt Ballinger and Alfred Howell, and the Texas Bar Association movement, Professor Bloomfield's skill in creating a series of vignettes leaves us with impressions of the entire bar for fifty years of what was …

The Texas Bar In The Nineteenth Century, Maxwell Bloomfield
The Texas Bar In The Nineteenth Century, Maxwell Bloomfield
Vanderbilt Law Review
As the twentieth century approached, bar leaders increasingly complained that the open bar, like the open range, had outlived its usefulness. In 1899 the Texas Bar Association began a vigorous lobbying effort for more restrictive regulation of attorneys. The state legislature responded four years later with a bill that required all future bar candidates to take a standardized written examination. The results of this new approach were immediate and gratifying to those who clamored for a more exclusive profession. While approximately four hundred candidates had applied for, and obtained, a license between August 1, 1896, and August 1, 1897, only ninety …

Multiple Representation And Conflicts Of Interest In Criminal Cases, Peter W. Tague
Multiple Representation And Conflicts Of Interest In Criminal Cases, Peter W. Tague
Georgetown Law Faculty Publications and Other Works
Conflicts of interest resulting from multiple representation in criminal cases impose heavy burdens on all the participants in the criminal justice system. Although the Supreme Court in Holloway v. Arkansas refused to hold that joint representation is unconstitutional per se, it recently approved Proposed Rule of Criminal Procedure 44(c), which would require trial courts to protect a defendant's right to counsel in this situation. After discussing the current approaches of the courts to the problems presented by joint representation, Professor Tague analyzes the proposed rule. He criticizes the proposed rule for its failure to define the role of the trial …
Federal Discovery: A Survey Of Local Rules And Practices In View Of Proposed Changes To The Federal Rules, Sherman L. Cohn
Federal Discovery: A Survey Of Local Rules And Practices In View Of Proposed Changes To The Federal Rules, Sherman L. Cohn
Georgetown Law Faculty Publications and Other Works
Traditionally, except for the limited role played by pleadings and bills of particulars, the attorney in a law court did not disclose evidentiary matters until trial. "A judicial proceeding was a battle of wits rather than a search for the truth,"' and thus, each side was protected to a large extent against disclosure of his case until counsel chose to disclose it at trial. This philosophy changed some forty years ago with the introduction of discovery in the Federal Rules of Civil Procedure. In the words of Mr. Justice Murphy, the discovery rules meant that "civil trials in the federal …
