The Faculty Of Law, University Of British Columbia 1981-90, Joost Blom May 1991

The Faculty Of Law, University Of British Columbia 1981-90, Joost Blom

Dalhousie Law Journal

It may be uninspiring to begin a sketch of the UBC Law Faculty since 1981 by talking about money, but the Faculty's financial circumstances during this period are the key to much of what follows. For about five years from 1982, the provincial government's fiscal watchword was "restraint", which so far as the universities were concerned meant, in the early years, actually cutting operating grants and, later on, keeping a fairly tight lid on them. UBC's budget fell in absolute terms for three successive years, and continued to slip in real terms for another year or two. The Law Faculty …

Legal Rhetoric Under Stress: The Example Of Vichy, Richard H. Weisberg Apr 1991

Legal Rhetoric Under Stress: The Example Of Vichy, Richard H. Weisberg

Cardozo Law Review

The article examines the complicity of the Vichy legal system in the persecution of Jews during World War II, arguing that French lawyers and judges actively contributed to Nazi objectives through legalistic rhetoric and formalism. By focusing on individual cases and interpretive debates, the legal profession avoided addressing the moral and ethical implications of their actions, enabling the enforcement of oppressive policies. The analysis critiques the failure of legal professionalism and the dangers of prioritizing formalism over human rights.

Review Essay: Sunstein, Statutes, And The Common Law--Reconciling Markets, The Communal Impulse, And The Mammoth State, Peter L. Strauss

Michigan Law Review

The following pages principally address Professor Sunstein's basic argument for building on, rather than defending against, legislative judgments, and so virtually ignore the details of his proposals for statutory interpretation. Part I outlines Sunstein's case for some regulation - the necessary failures of market ordering and the consequent need for a mixed economy in which government regulation intervenes in important ways. Part II addresses Sunstein's decision to tie his analysis to the public law innovations of the New Deal, and suggests ways in which the analysis might be strengthened by attention to earlier struggles and changes - changes in common …

Eras Of The First Amendment, David S. Yassky Jan 1991

Eras Of The First Amendment, David S. Yassky

Elisabeth Haub School of Law Faculty Publications

Part I will begin the story with the Founders' understanding of the structural role of the First Amendment. In this understanding, the First Amendment served as a bulwark of state independence. Along with the rest of the Bill of Rights, the First Amendment had as its primary purpose maintenance of the federal system--or, more precisely, protection of the states against federal government overreaching. The Founders' plan left the individual states entirely free to regulate speech, while strictly prohibiting the federal government from displacing the states' various speech regimes.

When the Civil War dramatically reshaped the federal-state relationship, the structural purpose …
