Clinical Education At The Crossroads: The Need For Direction, David R. Barnhizer
Law Faculty Articles and Essays
This Commentary rests on five premises. The first is that it is both possible and necessary to understand clinical legal education as a general instructional method. The second is that all legal educators must be more willing to reexamine and clarify the purposes of legal education and to engage in discussion about the primary educational goals to be served. The third premise is that different educational methods possess distinct capabilities for the attainment of specific educational goals and that certain applications of the clinical method are manifestly superior vehicles to facilitate learning in the area of "professional responsibility." For many of you, law school will be a full-time occupation for three school years; for others, a second job squeezed in at night over four or five years. Whatever your route to a degree, whatever sort of law school you attend, the beginnings of law school are likely to be much the same. You will face initially a set of required courses that will probably bear the same titles as the titles of our next six chapters: Civil Procedure, Contracts, Criminal Law, Property, Torts and Constitutional Law. Studies Of Legal Education: A Review Of Recent Reports, Thomas L. Shaffer, Robert S. Redmount

Early in 1972, the Carnegie Commission on Higher Education published its report on legal education. It is the most prominent study of legal education in the last decade, and typical of discourse in and about law schools—urbane, speculative, unempirical, conceptual, rarely student-centered. The authors of the Carnegie report were articulate law teachers. They wrote with their feet up and their pipes lit, without attention to facts which did not come from their considerable experience. The value of such reports is the thoughtfulness of the people who write them, and their predictive accuracy is due to the fact that people who …
