Barcoding Bodies: Rfid Technology And The Perils Of E-Carceration, Jackson Samples
Duke Law & Technology Review
Electronic surveillance now plays a central role in the criminal legal system. Every year, hundreds of thousands of people are tracked by ankle monitors and smartphone technology. And frighteningly, commentators and policymakers have now proposed implanting radio frequency identification (“RFID”) chips into people’s bodies for surveillance purposes. This Note examines the unique risks of these proposals—particularly with respect to people on probation and parole—and argues that RFID implants would constitute a systematic violation of individual privacy and bodily integrity. As a result, they would also violate the Fourth Amendment.
Immigration, Moral Panics, And Punishment: The Impact Of Media Coverage And Public Interest On Jail Incarceration, Faraneh Shamserad
Immigration, Moral Panics, And Punishment: The Impact Of Media Coverage And Public Interest On Jail Incarceration, Faraneh Shamserad
Dissertations
Despite extensive empirical evidence showing that immigration does not lead to increases in crime, the purported immigration and crime link has been used to buttress increasingly punitive immigration policies over the past few decades. While previous studies have explored the role of enforcement practices for punishment, this dissertation delves into the mechanisms through which immigrants are transformed into “criminal subjects” and the consequences for punishment at the local level. By integrating moral panic theory with research on immigration, crime, and punishment, I propose that the inflammatory language surrounding immigration in media and public discourse has punitive consequences for immigrants. Moreover, …

Legislating Morality In The Gilded Age And Progressive Era: Moral Panic And The “White Slave” Case That Changed America, Nancy C. Unger
History
This article is based on the presidential address presented to the Society for Historians of the Gilded Age and Progressive Era at the meeting of the Organization of American Historians in Los Angeles in 2023. Its focus is Maury Diggs and Drew Caminetti, two white men from Sacramento, California, charged with violating the Mann Act (known as the White Slave Trafficking Act) in 1913. The Gilded Age and Progressive Era obsession with white slavery, a phenomenon that has particular resonance in today’s climate, reveals the power of moral panics. Examining the steps, and missteps, that various legal, social, and political …
The Antidote Of Free Speech: Censorship During The Pandemic, Christopher Keleher
The Antidote Of Free Speech: Censorship During The Pandemic, Christopher Keleher
Catholic University Law Review
Free speech in America stands at a precipice. The nation must decide if the First Amendment protects controversial, unconventional, and unpopular speech, or only that which is mainstream, fashionable, and government-approved. This debate is one of many legal battles brought to the fore during Covid-19. But the fallout of the free speech question will transcend Covid-19.
During the pandemic, the federal government took unprecedented steps to pressure private entities to push messages it approved and squelch those it did not. The Supreme Court will soon grapple with the issue of censorship during the pandemic. This article examines this litigation, along …
The Myth Of Children’S Online Privacy Protection, Stacey Steinberg
The Myth Of Children’S Online Privacy Protection, Stacey Steinberg
UF Law Faculty Publications
Digital technology has changed the landscape young people face as they come of age. It has changed how children interact with their parents, schools, community organizations, and the state. Despite many benefits, digital technologies that employ data collection, algorithms, and artificial intelligence pose significant risks for the next generation. Private businesses can collect, use, and sell a child’s data in ways never imagined by their families. Information collected by third parties with good intentions can be stolen through data breaches. Through faulty algorithms, websites can make inaccurate assumptions about young people’s interests, teachers can make inaccurate assumptions about a student’s …
Taxing The Metaverse, Young Ran (Christine) Kim
Taxing The Metaverse, Young Ran (Christine) Kim
Articles
The buzz surrounding the Metaverse has been growing steadily for the past couple of years, but the tax implications of this novel ecosystem remain fuzzy to most tax scholars. Such uncertainty is concerning, given the potential and momentum of this emerging technology. Although the Metaverse evolved from online video games focused only on user consumption, it now allows users to produce income and accumulate wealth entirely within the Metaverse. Current law seems to defer taxation of such until a realization or cash-out event. This Article challenges this approach and offers novel arguments justifying Metaverse taxation. Because economic activity within the …
Access To Justice And The Legal Profession: Three Questions, Trevor C. W. Farrow
Access To Justice And The Legal Profession: Three Questions, Trevor C. W. Farrow
Articles & Book Chapters
There is an increasing recognition – from all sectors of the legal system, including the former Chief Justice of Canada – that justice is in crisis. Even though we have some of the best judges, lawyers, and law schools in the world, delays in the civil, criminal, and family justice systems are massive and increasing. Costs of legal help are going up. An increasing number of people are trying to represent themselves. Legal aid is available only for the least well-off and only for a limited range of services. Many communities feel alienated and do not see themselves represented by …
The Abolition Of Woman, Lynne Marie Kohm
The Abolition Of Woman, Lynne Marie Kohm
Cardozo Journal of Equal Rights & Social Justice
The article argues that modern feminist jurisprudence, while initially aimed at advancing women's rights, has deviated from its original goals and now contributes to the erosion of the unique identity and value of women. This shift is evident in areas such as reproduction, gender fluidity, and motherhood, where legal and academic discourse increasingly deconstructs the concept of womanhood, leading to its potential abolition.
A Performative Model For Conducting Critical Race Analysis: Josephine Baker, Modern Dance, And Utilizing Narrative To Transform Legal Doctrine, Patrick C. Brayer
A Performative Model For Conducting Critical Race Analysis: Josephine Baker, Modern Dance, And Utilizing Narrative To Transform Legal Doctrine, Patrick C. Brayer
Faculty Works
This article proposes a performative model for analyzing the relationship between race and law by integrating narrative, modern dance, and performance as interpretive tools. Focusing on Josephine Baker’s activism and her 1952 return to St. Louis, the paper demonstrates how storytelling and artistic expression can expand legal scholarship and transform understandings of racial injustice. By bridging legal studies with performance, African American history, and cultural analysis, the work illustrates how embodied expression provides new pathways for confronting structural racism, transgenerational trauma, and the pursuit of social justice.

No Child Left Online: Influencer “Sharenting” As A Breach Of Fiduciary Duty, Caroline Harrod
Cardozo Law Review
A controversy erupted on the video-sharing app TikTok in the summer of 2022, with audiences accusing a parenting influencer of exploiting her toddler daughter by posting compromising videos of her on the platform. The child’s mother, Jacquelyn, who runs the account @wren.eleanor, frequently shared videos of then-two-year-old Wren engaged in everyday activities such as riding a bicycle, going to the park, and eating snacks with the duo’s 17.1 million followers. Jacquelyn also regularly posted paid partnerships with brands such as SHEIN and Kohl’s, and, in lieu of working a regular job, provided for Wren through earnings from online content creation. …

Searching For Justice: Incorporating Critical Legal Research Into Clinic Seminar, Priya Baskaran
Scholarly Articles in Law Reviews & Journals
This Article provides educators with a roadmap for incorporating Critical Legal Research into Clinical Pedagogy. Critical Legal Research is a social justice-oriented critical intervention that provides a theoretical framework and practical application. Critical Legal Research provides lawyers with tools to deconstruct but also reconstruct legal research and analysis modes to engender more just, client-focused outcomes that fall outside dominant legal narratives. The problematic advent of ChatGPT and the broader incorporation of Artificial Intelligence (AI) within the legal research regime has made the Critical Legal Research project more urgent than ever. Ultimately, introducing Critical Legal Research in the clinic seminar is …
Open Source Perfume, Amanda Levendowski
Open Source Perfume, Amanda Levendowski
Georgetown Law Faculty Publications and Other Works
ABRIDGED ABSTRACT: Perfume is a powerful art and technology, but its secrets are closely held by a privileged few - by some counts, there are more astronauts than there are perfumers. As critics have noted increasingly since 2020, those select few perfumers often share similar backgrounds. As interviews with American, British, and French perfumemakers reveal, intellectual property (IP) also plays a gatekeeping role in perfumery. Drawing on work by perfumer and educator Saskia Wilson-Brown, this Article suggests that perfumery is overdue for a transformation. One is emerging: open source perfume. For those seeking ways to share scents and signal commitment …
Whom Do Prosecutors Protect?, Vida Johnson
Whom Do Prosecutors Protect?, Vida Johnson
Georgetown Law Faculty Publications and Other Works
Prosecutors regard themselves as public servants who fight crime and increase community safety on behalf of their constituents. But prosecutors do not only seek to protect those they are supposed to serve. Instead, prosecutors often trade community safety, privacy, and even the constitutional rights of the general public to enlarge police power. Prosecutors routinely advocate for weaker public rights, shield police from public accountability, and fail to prosecute police when they break the law.
This Article will show how prosecutors often protect police at the expense of the public. This Article suggests a novel theory of evaluating the conduct of …

The Last Colony Of The Mind: Narrative, Legal Advocacy, And The Decolonization Of Legal Knowledge, Ayodeji Kamau Perrin

Philippe Sands’ The Last Colony1 tells the story of how Chagos Islanders won the right to return to the lands of their birth through a 2019 Advisory Opinion of the International Court of Justice (ICJ).2 In 1965, while the United Kingdom stood in the midst of conceding to the independence claims of myriad anti-colonialists throughout its imperial holdings, it took the anachronistic step of creating a colony—the British Indian Ocean Territory (BIOT).3 In flagrant violation of UN Resolution 1514,4 the United Kingdom detached the Chagos Archipelago from the colony of Mauritius. And between 1967 and 1973, …

Do court victories result in social change? Can victories in court result in losses outside of court? If victories in court are no guarantee of victory outside of court, how much worse are court defeats? This Article explores these questions in part through analyzing Ogoni litigation against Royal Dutch/Shell. In 2002, Esther Kiobel and several co-plaintiffs tried to hold Royal Dutch/Shell accountable for its role in the death of Kiobel’s husband and for wider corporate abuses and related state human rights violations in Ogoniland. But in 2013, a unanimous United States Supreme Court held that the Alien Tort Statute (ATS) …

U'Wa Indigenous People Vs. Columbia: Potential Applications Of The Escazu Agreement, Ariana Lippi
Sustainable Development Law & Policy
Though the case is ongoing, and results are still to be seen, it in many ways sets a precedent for indigenous communities in Latin America seeking redress for environmental and cultural injustices. With Colombia’s recent ratification of The Escazú Regional Agreement (the Agreement herein) in 2022, this case presents a unique opportunity for implementation of the Agreement and greater accountability within existing domestic legislation.

Incentivizing Sustainability In American Enterprise: Lessons From Finnish Model, Vasa T. Dunham
Sustainable Development Law & Policy
The disparate climate performances of Finland and the United States, two of the wealthiest countries in the world, bring to light the question of how corporate responsibility has been inspired in each jurisdiction. Having established the urgency of the climate crisis and the importance of corporate behavior in optimizing a given country’s approach to protection of the global environment, an examination of each nation’s legal frameworks may shed light on features of the corporate regime that are effective in advancing sustainability goals and those that are not.22 Part I of this paper establishes a comparative framework by providing background on …
