Government Information And The Rights Of Citizens, Michigan Law Review Jun 1975

Government Information And The Rights Of Citizens, Michigan Law Review

Michigan Law Review

This Project delineates the federal and state responses to these two fundamental societal concerns. The course of the discussion suggests the vitality of these concerns, and the flexibility and continuing development of the governmental responses. Clearly, the interests in maximizing disclosure of government-held information and minimizing the handling and dissemination of unnecessary or inaccurate personal information can conflict. The contours of this conflict, only intimated herein, will doubtless become more bold with the maturation of the opposing statutory schemes.

A Review: The Interaction Of Law And Religion, Frona Powell

IUSTITIA

In 1971 at Boston University, Harold J. Berman, Story Professor of Law at Harvard Law School, delivered four lectures in the series of Lowell Lectures on Theology. This book is comprised of those lectures with an introduction, postscript, and annotations. One would hope that Berman's analysis of the interaction of law and religion would provide insight into an area which is often neglected by modern jurisprudents. Unfortunately, it does not.

Those who are members of the legal profession as well as those who are not, are aware of the fact that the legal system does not always function properly. In …

The Creative Role Of Law, I. F. G. Baxter Feb 1975

The Creative Role Of Law, I. F. G. Baxter

Dalhousie Law Journal

A few years ago, the writer was asked by a professional association (concerned with pharmacy) to organize the legal side of a research project. The project was to examine the state of the profession and to produce a new design for the future. The suggestion was made that the legal part of the report should be done first so that the other reporters could know what they could or could not suggest in making their proposals. It was replied (by the legal researchers) that law too is a planning variable, and that law's true role is not to confine desirable …

Report On Antitrust Implications Of Joint Industry Activities Under Price Controls, William W. Sadd, William E. Huth, John C. Cortesio, Howard Hunter

Research Collection Yong Pung How School Of Law

Pursuant to the authority of the Economic Stabilization Act of 1970, the nation has recently experienced "Phase IV" of a program of price controls. This statutory authority expired on April 30, 1974, except as to certain petroleum products. Phase IV, to a greater extent than the preceding three phases of controls, gave rise to a need and an opportunity for joint industry efforts to influence and guide governmental authorities in shaping pricing policies in the economy. This report, therefore, examines the legal basis for such joint industry activities within the purview of Section 1 of the Sherman Act. If authority …

The Psychological Stress Evaluator: Yesterday's Dream - Tomorrow's Nightmare, Deborah Lewis Hiller

Cleveland State Law Review

This note will examine the manner in which the Psychological Stress Evaluator functions and explore the legal implications stemming from its use as a lie detector. More specifically, three issues which arise in connection with the use of the PSE will be discussed: first, the validity and reliability of the PSE; second, the admissibility of PSE test results in evidence; and third, the potential remedies for subjects of PSE tests who have occasion to object.

Whose Needy Children?, David L. Bazelon

As an appellate judge for twenty-five years, the author has been confronted daily with cases involving what we call "behavior problems." As a judge, he can tell you it is a distressing task to sift daily through the records detailing the wreckage of human lives. He does not speak only of criminal cases. He also refers to child abuse and neglect cases, welfare eligibility cases, civil commitment cases, and many others.

The Division Of Legal Labor In Rural Haiti, Pnina Lahav Jan 1975

The Division Of Legal Labor In Rural Haiti, Pnina Lahav

Faculty Scholarship

This paper explores the institutional facilities available to Haitian peasants for the settlement of their disputes. More specifically, it compares the institution of the Chef de Section - the lowest administrative appointee in the Haitian countryside and the Justice of the Peace - the lowest ranking judicial institution provided by the Haitian legal system. The paper further advances the hypothesis that at the present time there is a shift in the division of labor between the two institutions, in favor of the Justice of the Peace, and that this shift may be attributed to processes of social differentiation currently detectable …

Obscenity, The Law And Religion, Thomas A. Long

The long history of the relation between Western religion and secular law is both interesting and complex.' In what follows I shall discuss one current social issue which is illustrative of this relation, namely, the relatively recent legal-moral controversy over obscenity.

Photo Essay: On The Street, John G. Hopper

IUSTITIA

When people speak of crime in the streets, they invariably refer to cold statistics or a report from a governmental agency as a source of information. There is however another source of information on the subject-that of personal experience. It is the unique experience that urban police sometimes refer to as being "on the street". The following is this photographer's impression of spending several winter nights on the streets with an urban police force.

Bail In Missouri Revisited, Mark Berger Oct 1974

Bail In Missouri Revisited, Mark Berger

Faculty Works

During the early part of the 1960's, interest in the civil rights movement generated concern over the inequities of bail administration. In the latter part of the decade the same problems were revealed in major studies of the nation's criminal justice system. Contributions to the legal literature in this period, encompassing statistical and evaluative studies as well as academic analysis, helped to focus further attention on bail. Moreover, a major effort was undertaken by the United States Department of Justice to promote the sharing of bail program information and ideas. There are signs, however, that some of the earlier interest …

A Historiography Of The Elizabethan Poor Laws: Late Xixth And Xxth Century Historians, Susan C. Mcnaught Jul 1974

A Historiography Of The Elizabethan Poor Laws: Late Xixth And Xxth Century Historians, Susan C. Mcnaught

Dissertations and Theses

The Elizabethan poor laws stand as a great work from a dynamic period. How and why they were formulated have been questions which historians have asked for centuries. The discussions of these questions have varied, depending on the personal values and biases which each historian brought to this study. It is generally agreed that a very important function of the historian is interpretation. The study of history is not only a study of the events, but a study of the historians and their differing interpretations of those events.

In the past one hundred years, numerous historians have devoted themselves to …

The Organized Bar--Yellow Brick Road To Legal Services For The Poor, Lawrence L. Thompson, R. William Ide, Iii May 1974

The Organized Bar--Yellow Brick Road To Legal Services For The Poor, Lawrence L. Thompson, R. William Ide, Iii

Vanderbilt Law Review

The experience of GILS-GLSP demonstrates that the extensive investment of time necessary to involve the organized bar in the legal services effort can make a vital contribution to the development of a stable, professional, statewide, legal services program. Bar support eases access to the political process, improves community relations, and facilitates program funding. Furthermore, bar support helps reduce the political strife that has heretofore plagued legal services programs. The rewards of such an approach can be great. Adequate funding obtained with active bar support has enabled GILS-GLSP to provide increasingly comprehensive legal services to indigent clients. From a modest budget …

The Fairness Doctrine And Pro-Natalism In Television, Myra Spicker Apr 1974

The Fairness Doctrine And Pro-Natalism In Television, Myra Spicker

IUSTITIA

It is a premise of this paper that television reflects a pro-natalist bias in its promotion of the traditional female role in society, and that such bias is evident in both commercial advertisements as well as in dramatic presentations particularly on daytime television. Those who are opposed to a pro-natalist point of view will find it virtually impossible to air their opposition effectively. At best anti-natalist groups may be able to garner only meager financial resources to air spot commercials, but this is hardly adequate to combat the subtle onslaught of the opposition. Suggestions have been made that pro-natalist attitudes …
