The Unconstitutionality Of Limitations Upon Donations To Political Committees In The 1976 Federal Election Campaign Act Amendments, David Skover

Faculty Articles

The Supreme Court's decision in Buckley v. Valeo partially dismantled the electoral reform program formulated in the 1974 Amendments to the Federal Election Campaign Act of 1971. The Court declared that the Act's limitations on expenditures by candidates and independent expenditures in federal elections unconstitutionally burdened political speech and association, while it upheld restrictions on contributions to candidates. After five months of deliberation, Congress attempted to salvage its design for electoral reform by enacting the Federal Election Campaign Act Amendments of 1976. Responding to Buckley's approval of restrictions on political contributions, Congress imposed new limits on "contributions" to political committees. …

George Q. Cannon's Views On Church And State, Lyndon W. Cook Sr.

Theses and Dissertations

Writers of nineteenth century Utah generally recognize George Q. Cannon's religious and political influence as second only to that of Brigham Young. Having occupied several positions of importance in the political arena as well as in the Mormon Church, Cannon is a major figure in Utah history whose life and thought merit careful examination.

This treatise is a study of George Q. Cannon's views on the institutions of church and state. After presenting a biographical sketch of Cannon's life, it examines his beliefs regarding the religious clauses in the First Amendment, and the place of revelation, positive law, and majority …

Reapportionment : An Oregon History And A Critique Of Baker Vs Carr, Ann Frissell Lackey Jul 1976

Reapportionment : An Oregon History And A Critique Of Baker Vs Carr, Ann Frissell Lackey

Dissertations and Theses

This study explores the ways in which federal and state authorities have sought to deal with a difficult problem of political power in the context of the U.S. Constitution. Oregon reapportionment history offers an appropriate introduction to a critique of the national reapportionment decisions of Baker vs Carr and Reynolds vs Sims. Its Constitution stipulated population and the ratio derived from a population based formula were the means by which apportionment was to be determined and noncompliance had been particularly evident from 1933 to 1952. Also, by the initiative process and a decision by the Oregon Supreme Court, Oregon had …

Bryan V. Itasca County, Us Supreme Court, William J. Brennan

US Government Documents related to Indigenous Nations

This United States (US) Supreme Court case, decided June 14, 1976, provided clarity on the jurisdiction granted by US Public Law 280 in regard to taxation of the personal property of reservation Indians. In 1972, petitioner Russell Bryan, enrolled member of the Minnesota Chippewa Tribe residing on the Leech Lake Reservation in Minnesota, received a notice of taxation on his home from Itasca County, Minnesota. Bryan filed suit to Minnesota district court which ruled in favor of Itasca County. Although US Public Law 280 does not specifically address taxation, the district court based its decision on US Public Law 280, …

Of the five plans, the recommended plan, which calls for the lines to be suspended from a single row of …

Continuity And Change In American Constitutional Development And Public Policy: 1964-1976, Donald P. Kommers, Kevin C. Gallagher

Journal Articles

From the Introduction:

"This report adheres as much as possible to the form and structure of the first two surveys. Thus, we begin this report with an overview of recent presidential elections and a discussion of the American electoral process. The article then moves on to a treatment of changes in federal-state relations, government organization, the distribution of power among the branches and levels of government, and constitutional law as judicially defined. Unlike the previous reports, however, we have devoted nearly half of this survey to recent public policy in the area of civil rights. This extensive treatment of civil …
