My dissertation consisting of three essays focuses on the role of technological innovations in value distribution within R&D alliance, and the impact of patent litigation on R&D alliance formation and technological innovation. Essays one and two are intended to extend signaling theory with transaction cost economics (TCE) and social embeddedness perspective. Essays two and three investigate the consequences of patent litigation on R&D alliance formation and technological search, respectively. Essay one investigates the empirical relationships between patent attributes and allocation of control rights, and the relationships between patent attributes and up-front payment in R&D alliance contracts. This dissertation focuses on the issues of copyright enforcement and management. Especially, the research looks into how the digital technology reshapes the general perceptions and landscape of the copyright system in terms of online enforcement and management. Stepping into the digital age, the interaction between copyright holders and other parties, including online users and the ISPs, establishes two coexisting models—the right-holder-centric model and the cooperative model. Therefore, the dissertation analyzes which model is more appropriate and efficient with respect to online copyright enforcement and management.

Counterfeit drugs threaten public health and present unique and complex challenges to the criminal justice system and the field of forensic science. Theft of intellectual property in the pharmaceutical industry has caused sickness and death, and it is necessary that the perpetrators of these crimes are brought to justice. In some cases, threats to health and safety are short term; in others they are long term. This research describes these threats in detail.

Undergraduate thesis completed for Seattle Pacific University's University Scholars program. This project focuses on patent law as an intersection of engineering and law. Beyond studying the philosophies used to justify the granting of patents, the project attempts to quantify the value of patents as measured by company assignees versus the general public. A case study of patents involved in litigation between Hewlett Packard, Inc. and Repeat-O-Type Stencil Manufacturing Corporation is examined, with visuals generated by a Matlab program that made up a large component of this project.

This dissertation presents an analysis of patent system and antitrust law issue in OLED (Organic Light Emitting Diode) display industry focusing on the patent strategy for securing technologies and materials. Today both the U.S. and China are plagued with copyright infringement, particularly infringement involving online file sharing via file hosting services. The safe harbor rules in the U.S. Digital Millennium Copyright Act (here after “DMCA”) §512(c) provide a certain amount of protection for contributory infringers, such as file hosting service providers, as long as certain conditions are met. Although China has borrowed extensively from DMCA §512(c) in setting up its own safe harbor rules, their content and standard of review remain unclear, leading to inconsistencies in judgments. Although zines made today utilize many forms of antiquated technologies such as the typewriter and the photocopier in their construction, they are a part of contemporary tinkering with intellectual property. This thesis examines free culture as it has been expressed in self-published zines made in the last thirty-five years. It looks at the licenses found in zines as conversations between a zine maker and a zine reader. This work examines the scope of non-practicing entity behavior and whether the debate on remedies can lead to changes that encourage the goals behind a patent system. Innovation is often the stated goal but the significance of innovation commercialization is often ignored. Furthermore, there has been an increase in business models that involve alternate means of monetizing patents, not all of which were contemplated in the purpose of the patent system.
