This paper arose from an invited symposium on "Democracy in America: The Promise and the Perils," held at Loyola University Chicago School of Law in Spring 2019. The essay places the Trump administration’s immigration and refugee policy in the context of a resurgent ethnonationalist movement in America as well as the constitutional politics of the past. In particular, it argues that Trumpism’s suspicion of foreigners who are Hispanic or Muslim, its move toward indefinite detention and separation of families, and its disdain for so-called “chain migration” are best understood as part of an assault on the political settlement of the …

Fatma Marouf

A noncitizen who has been convicted of a “particularly serious crime” can be deported to a country where there is a greater than fifty percent chance of persecution or death. Yet, the Board of Immigration Appeals has not provided a clear test for determining what is a “particularly serious crime.” The current test, which combines an examination of the elements with a fact-specific inquiry, has led to arbitrary and unpredictable decisions about what types of offenses are “particularly serious.” This Article argues that the categorical approach for analyzing convictions should be applied to the particularly serious crime determination to promote …

Rita Alkhaledy grew up in Sadr City, a poor suburb of Baghdad. Her father is an Iraqi Arab and her mother was Kurdish Iranian. Her mother lived in fear that she would be cast out of Baghdad as being an outsider in Iraq was frowned upon. Her father served in the Iraqi army in the 80s and was gone a great deal, leading to a strained relationship. Their relationship was mended when her mother died from cancer.

Jeanusnat’s father, who was chief of a Nigerian community, was murdered by an enemy community. The murderer intended to kill Jeanusnat and his mother as well, but they fled to neighboring Niger. There, Jeanusnat parted ways with his mother, who stayed at the church with a family, and Jeanusnat crossed into Libya in the back of a truck. But once in Libya, danger persisted. He was confronted by some robbers who stabbed him with a knife and beat him, leaving injuries on his legs and shoulder. At eighteen fate placed Ali and his family in the center of hostilities in northern Afghanistan. Warring militant factions killed hundreds of people in his village. Ali helped identify and bury dozens of his friends and neighbors in a mass grave.

In the midst of the worst humanitarian crisis of our time, in Syria, we have seen extreme suffering by millions who have been summarily executed, tortured, imprisoned, raped, starved, and bombed with chemical weapons. Specifically, we have seen that women have been the target of gender-based violence in the conflict by and with the acquiescence of the Assad regime forces and by opposition groups. In September 2016, Nicole Ludwig led a group of her neighbors in Germany to assist newly-arrived Syrian and Afghani refugees. The volunteers collected clothing and toys, organized activities and field trips for the refugee children, and taught them German. Later, the volunteers offered homework support and led library reading groups. For the adult refugees, the volunteers provided cultural assimilation instruction and cooking classes. While there were occasional challenges to working together, the volunteers and refugees fostered a collaborative system and even hosted a Christmas party, during which one elderly Syrian man said, “This is one of the best memories I …

She grew up on a farm in the country and became the financial support for her family after her mother died and her father became “emaciated.” When Putin came to power, diplomatic ties deteriorated between Georgia and Russia, which eventually led to war. A-R-C-G- Is Not The Solution For Domestic Violence Victims, Lizbeth Chow

Catholic University Law Review

For over fifteen years, U.S. immigration authorities and courts have grappled with the idea of domestic violence as a basis for asylum. But in 2014, the Board of Immigration Appeals (BIA) issued a decision indicating that victims of domestic violence may qualify for asylum. This Comment assesses the BIA’s decision and concludes that it is ultimately ineffective. This Comment further suggests that the only practical solution is for Congress to intervene. This Comment first provides a brief historical overview of asylum law to help elucidate the purpose of asylum law. It also provides an in-depth review of the elements needed …

This Thesis investigates the French asylum seeker legal framework and refugee integration effects based on evidence in government data, non-governmental organizations, and external sources. Specifically, the policies of the protected rights of asylum seekers from history to modern day in relation to its efficiency and respect to human rights. Despite the development of past models through reforms, some shortcomings and discrepancies still exist that adversely affect asylum rights and responsibility sharing among EU nations. A potential system that benefits the applicant in addition to the host country is possible by implementing a model that takes into consideration asylum preferences, socioeconomics, …
