The mission of the American Academy of Matrimonial Lawyers is "to encourage the study, improve the practice, elevate the standards and advance the cause of matrimonial law, to the end that the welfare of the family and society be protected." The AAML Comission was charged to analyze, critically review and make recommendations consistent with the mission of the Academy. After considering all available sources of information the Commission concluded that there are two significant and related problems associated with the setting of spousal support. The first is a lack of consistency resulting in a perception of unfairness. From this flows …

The Aaml Model For A Parenting Plan, Mary Kay Kisthardt

The American Law Institute's Principles on the Law of Family Dissolution were published in 2002. These principles, which were developed over nearly a decade, reflect the thinking of prominent family law scholars, practitioners and judges concerning the legal consequences of marital dissolution: child custody, child support, distribution of marital property and compensatory payments to former spouses. The American Academy of Matrimonial Lawyers undertook the process of reviewing the ALI Principles concerning the Allocation of Custodial Decision-Making Responsibilities for Children and drafting a model parenting plan that would reflect the spirit of the ALI Principles relating to parenting plans without reference …

From Representing Clients To Serving Recipients: Transforming The Role Of The Iv-D Child Support Enforcement Attorney, Barbara Glesner Fines

Attorneys for the poor are being asked to serve more clients for less money and with more restrictions on their practice than ever before. These restrictions, both on amounts and uses of funds, influence the attorney's independent professional judgment. Determining when that influence is inappropriate becomes a difficult practical and ethical issue. Is this issue resolved if one simply reconceptualizes the role of the entities and individuals involved? What if the government becomes the client and the individual receiving legal services becomes something other than a client? Examining the development of governmental funding of child support enforcement, one finds just …

The Use Of Mediation And Arbitration For Resolving Family Conflicts: What Lawyers Think About Them, Mary Kay Kisthardt

Faculty Works

The use of alternative methods for resolving family conflict has increased significantly in the past few years, but many attorneys are still wary. In an effort to discover some of the sources of this hesitation as well as identify support for "alternative" processes, the American Academy of Matrimonial Lawyers surveyed its members concerning the use of dispute resolution methods. The purpose of this study was to ascertain attorneys' perceptions of the advantages and disadvantages of the two most commonly used alternative dispute resolution mechanisms: mediation and arbitration. Whether clients will continue to use these methods depends in great part on …
