When Eu Law Meets Arabic Law: Assessment Of Anti-Corruption Law In Morocco And Some Proposed Amendments, Bryane Michael, Abdelaziz Nouaydi
Bryane Michael (bryane.michael@stcatz.ox.ac.uk)
This article reviews the present state of the adoption of anti-corruption legal provisions usually adopted in EU (or candidate) countries in Morocco. Morocco lags behind many countries in its adoption of anti-corruption legislation and the recently established Central Agency of the Prevention of Corruption is unlikely to succeed in speeding up the adoption of these measures. English language translations of a number of Moroccan anti-corruption legal instruments are presented and amendments to these legal instruments are recommended (based on international best practice) in order to increase the likely effectiveness of Moroccan law enforcement institutions in fighting corruption.

Disciplining Words: What You Always Wanted To Know About Terminology Management, Uwe Muegge
Uwe Muegge
Terminology management enables organizations of any size to use the same terms consistently within and across the communication types that accompany a product or service. Typical communication types include specifications, drawings, GUI, software strings, help systems, technical documentation, marketing materials, regulatory submissions, etc. As multiple authors typically contribute to these communications, terminology management is the most efficient solution for ensuring that the organization speaks with one voice.

E-Commerce And Information Privacy: Privacy Policies As Personal Information Protectors, Corey A. Ciocchetti
Corey A Ciocchetti
This article dives into the contemporary debate surrounding information privacy in the twenty-first century e-commerce environment through the lens of consumers submitting personally identifying information into the vast abyss of cyberspace. I argue that this information must be better protected and that United States law should emphasize electronic privacy policies as privacy-protecting devices. Currently, the United States operates under primarily a self-regulatory environment where the federal and state governments allow industry to regulate the use and content of their privacy policies. This article details current state of the United States legal regime, addresses its inefficiencies in this area and proposes …

Green With Envy? Greenmail Is Good! Rational Economic Responses To Greenmail In A Competitive Market For Capital And Managers, Eric A. Engle
Eric A. Engle
Greenmail denotes the decision by a corporation's board of directors to repurchase its shares that are held by a corporate raider, often at a significant premium, thereby keeping the board of directors in office. It may represent a conflict of interest between the corporation's shareholders and the board of directors. While greenmail is legal, 50% of greenmail gains are subject to taxation. This Article argues that greenmail has a healthy role in a competitive market economy.

The "Duty" To Be A Rational Shareholder, David A. Hoffman

How and when do courts determine that corporate disclosures are actionable under the federal securities laws? The applicable standard is materiality: would a (mythical) reasonable investor have considered a given disclosure important. As I establish through empirical and statistical testing of approximately 500 cases analyzing the materiality standard, judicial findings of immateriality are remarkably common, and have been stable over time. Materiality's scope results in the dismissal of a large number of claims, and creates a set of cases in which courts attempt to explain and defend their vision of who is, and is not, a reasonable investor. Thus, materiality …

The Effect Of Auburn University’S Business-Engineering-Technology Program On The Predisposition Towards Entrepreneurship In Business And Engineering Graduates, Paul Swamidass, Daniel Butler
Paul Swamidass
The unique Business-Engineering-Technology (BET) minor at Auburn University trains business and engineering students in teamwork and entrepreneurship. All eleven graduates of the first BET class (2003) and nineteen graduates from the second BET class (2004) were surveyed to assess their entrepreneurial skills, knowledge and abilities. Their responses were compared against the Auburn University norm for graduating seniors. The norm was developed using 254 responses from business and engineering students who were cohorts of the BET students. In this lock-step program, students design and develop three different products and matching businesses to exploit their products. Over the two years, they prepare …

Free And Fair Elections, Riccardo Pelizzo
riccardo pelizzo
This chapter argues that the freedom and the fairness of elections are threatened by old and new (and emerging) threats. In fact, the freedom and the fairness of elections are threatened not only by political violence, intimidation and electoral fraud which can be regarded as the ‘old’ or ‘traditional’ threats, but they are also threatened by the absence of plural sources of independent information, conflict of interests and , above all, corruption

Globalization has turned product design upside down. Members of a single design team in multinational firms may be located in several countries such as the USA, UK, Italy, India and so on. It is a challenge to give engineering and business students a taste of this experience. Auburn University’s Business-Engineering-Technology (B-E-T) program, and the College of Engineering, University of Plymouth, participated in a joint effort to replicate real-life product design process with a mixture of engineering and business students. This paper describes the experience, its lessons and compares it with other attempts at multinational student design-team projects.

Agenda Setting, Issue Priorities, And Organizational Maintenance: The U.S. Supreme Court, 1955 To 1994, Jeff L. Yates, Andrew B. Whitford, William Gillespie
Jeff L Yates
In this study, we examine agenda setting by the U.S. Supreme Court, and ask the question of why the Court allocates more or less of its valuable agenda space to one policy issue over others. Our study environment is the policy issue composition of the Court's docket: the Court's attention to criminal justice policy issues relative to other issues. We model the Court's allocation of this agenda space as a function of internal organizational demands and external political signals. We find that this agenda responds to the issue priorities of the other branches of the federal government and the public. …

Sesame is one of the important oilseeds crop in India, which plays a major role in supplementing the income of small and marginal farmers of Sunderbans. One of the major constraints of traditional Sesame farming is low productivity of local varieties. To replace this anomaly, Krishi Vigyan Kendra of CIFRI has conducted frontline demonstration at adopted farmers’ field in four development blocks viz. Kakdwip, Namkhana, Patharpratima and Kulpi of Sunderbans, West Bengal. Cultivation of high yielding varieties of Sesame viz. Rama (Improved Selection-5) and Tilottma (B-67) shows percentage increase of 46.58 and 35.86 respectively over local check. The technology gap …
