How To Govern A City On A Hill: The Early Puritan Contribution To American Constitutionalism, John Witte Jr. Jan 1990

How To Govern A City On A Hill: The Early Puritan Contribution To American Constitutionalism, John Witte Jr.

Faculty Articles

This Article explores briefly the constitutional ideas and institutions of seventeenth-century Puritan New England. It analyzes the constitutional ideas that the Puritans derived from their theological doctrines of covenant, church and state, and sin, and it examines the forms and functions of political and ecclesiastical government they devised in implementation of these ideas.

Challenging Law, Establishing Differences: The Future Of Feminist Legal Scholarship, Martha Albertson Fineman Jan 1990

Challenging Law, Establishing Differences: The Future Of Feminist Legal Scholarship, Martha Albertson Fineman

Faculty Articles

I begin with my version of the ideally antagonistic interaction of feminist theory with the law. I locate my discussion between the extremes of grand theory and unique experience. I consider the central, pressing task of feminist theory to be challenging existing law and legal doctrines through the articulation and establishment of a theory of difference. In this essay I divide my discussion of the theory of difference into two sections. The first section concerns the theoretical and political necessity of establishing the differences between men and women. Articulation of the extent of this manifestation of difference illustrates that the …

A Critical Legal Studies Perspective, Mark Tushnet Jan 1990

A Critical Legal Studies Perspective, Mark Tushnet

Cleveland State Law Review

In this comment I want to address two points suggested by Professor Finnis's essay "Natural Law and Legal Reasoning." I say "suggested by" deliberately, for I do not want to attribute the points in their full force to him, although I believe that his essay lends itself to a reading in which those points would be given their full force. The points deal with the question of "easy questions" and what Professor Finnis calls the "sufficient and necessarily artificial clarity and definiteness" that yields answers to such questions, and with the way in which legal professionals are likely to understand …

Whose Nature - Practical Reason And Patriarchy, Lynne Henderson Jan 1990

Whose Nature - Practical Reason And Patriarchy, Lynne Henderson

Cleveland State Law Review

My comments on John Finnis's Natural Law and Legal Reasoning grow out my concern about the relationship of law to authoritarianism. In this comment, I do not intend to go deeply into the relationship of law to authoritarianism but rather to sketch out the background of the argument. It seems to me that authoritarianism, properly understood, is of great relevance to a symposium on jurisprudence and legal reasoning, because at a minimum, authoritarianism overlaps with legality's ethic of rule-following and obedience to authority. Authoritarian attitudes about authority and morality also are relevant to the jurisprudential concern with the relation of …

The Virtues Of Redundancy In Legal Thought, Randy E. Barnett Jan 1990

The Virtues Of Redundancy In Legal Thought, Randy E. Barnett

Cleveland State Law Review

Redundancy has a bad reputation among legal intellectuals. My interest in the virtues of redundancy grows out of my interest in the social function of the liberal conception of justice and the rule of law. In this essay, I propose that legal theorists pay serious attention to the concept of redundancy used by engineers. I explain how redundancy-in this special sense-is essential to any intellectual enterprise in which we try to reach action-guiding conclusions, including the enterprise of law. I will describe the virtues of redundancy in legal thought. I want to explain why it is useful to rely on …

The Search For An American Public Theology: The Contribution Of John Courtney Murray, Gerard V. Bradley Jan 1990

The Search For An American Public Theology: The Contribution Of John Courtney Murray, Gerard V. Bradley

Journal Articles

THE SEARCH FOR AN AMERICAN PUBLIC THEOLOGY: THE CONTRIBUTION OF JOHN COURTNEY MURRAY by Robert W. McElroy. New York: Paulist Press, 1989. Pp. iii+ 216. $10.95.

Among the many services Robert McElroy renders in this fine volume is an extensive bibliography of Murray's published writings. A glance at it suggests another service. Murray wrote countless articles, but no books. (His most famous work, We Hold These Truths, comprised previously published essays.) Precisely because Murray's thought is scattered across several decades and many journals, this intellectual biography - a narrative of Murray's life thought - is most valuable.

Jewish-Christian Dialogue: A Jewish Justification, Gerard V. Bradley Jan 1990

Jewish-Christian Dialogue: A Jewish Justification, Gerard V. Bradley

Journal Articles

JEWISH-CHRISTIAN DIALOGUE: A JEWISH JUSTIFICATION. By David Novak. New York: Oxford University Press, 1989. Pp. xiii, 194. $24.95. ISBN: 0-19-505084-3.

David Novak's "philosophically formulated theological argument for Jewish-Christian dialogue" (p. ix) seeks a "common border" between the two monotheisms which constitute the main story line of Western religion. And he finds it, in that old American standard, the Judeo-Christian ethic. I recommend Novak's rigorously argued, learned, and insightful book to readers of all faiths, and to those of no faith at all. I propose to support that recommendation by describing precisely its important and truly singular aspiration.

The Union At Risk: Jacksonian Democracy, States Rights And The Nullification Crisis, Gerard V. Bradley Jan 1990

The Union At Risk: Jacksonian Democracy, States Rights And The Nullification Crisis, Gerard V. Bradley

Journal Articles

Richard E. Ellis, The Union at Risk. Jacksonian Democracy, States Rights and the Nullification Crisis, Oxford: Oxford University Press, 1987. Pp. xi, 279. $32.50 (ISBN: 0-19-503785-5).

From the Review

In a widely reported address at Tulane University in October 1986, Attorney General Edwin Meese chastised the Supreme Court for its habitual conflation of constitutional law and the Constitution.

Meese is no intellectual, and his remarks were not intended as academic musings; thus, the speech may have been appropriately judged from a political perspective, condemned by liberals and applauded by conservatives for roughly the same reasons. Unfortunately obscured by the …
