An Essay On The Piano, Law, And The Search For Women's Desire, Julia E. Hanigsberg Jan 1996

An Essay On The Piano, Law, And The Search For Women's Desire, Julia E. Hanigsberg

Michigan Journal of Gender & Law

The thesis of this essay is a simple one: to have a measure of control over her destiny, to have any choices, a woman must be a sexual agent, a subject of desire rather than an object. How can women exercise any autonomy in any other realms if in their most intimate lives they are unable to voice their desires? I do not mean to suggest that sexuality has unlimited explanatory power or that everything about women's domination can be explained by a rearticulation of desire. I do believe, however, that although the issue of sexuality is much discussed, feminist …

Race And Political Empowerment: The Crisis Of Black Leadership, William E. Nelson Jr. Jan 1996

Race And Political Empowerment: The Crisis Of Black Leadership, William E. Nelson Jr.

William Monroe Trotter Institute Publications

W.E.B. Du Bois demonstrated poignant insight into the character of American society when he predicted in 1901 that the fundamental problem of the 20th Century would be the problem of the color line. Du Bois was writing in the aftermath of the first reconstruction that saw the institutionalization of Jim Crow and white dominance across the South. This period was symbolized by the infamous Plessy v. Ferguson decision in 1896. It was also marked by the capitulation of white Republican custodians of Reconstruction to the racist demands of southern politics, including the massive ejection of Black politicians from public office, …

Take A Picture, It May Last Longer If Guggenheim Becomes The Law Of The Land: The Repatriation Of Fine Art, Hans Kennon

St. Thomas Law Review

It is undisputed by all that the very nature of artwork makes it valuable. As only the original artist is able to recreate that style of artwork, it is a commodity that is able to inspire the collector and attract the art thief. This Article begins by looking at the artwork that has been plundered or stolen by persons who are considered art thieves by most, but saviors of the arts by others. However, thieves often come in different sizes and shapes. Some countries allege that other countries have stolen their culture, while others focus on members of the military …

Law Faculty Articles and Essays

Unfortunately, with the adoption and revision of formal ethics codes, moral teaching has virtually disappeared from American legal ethics. Law professors, generally, do not consider it their responsibility to teach morality, and our profession today lacks a common moral standard. The Judeo-Christian principles expressed in Proverbs, however, provide a timely challenge to lawyers by advocating values that include justice, purity, mercy, honesty and civility.

Community Culture And Tradition: Maintaining Male Dominance In Conservative Institutions, Christine M. Venter Jan 1996

Community Culture And Tradition: Maintaining Male Dominance In Conservative Institutions, Christine M. Venter

Journal Articles

"The freer women are to share their gifts with society and to assume leadership in society, the better are the prospects for the entire human community to progress in wisdom, justice and dignified living ... " So argued Mary Ann Glendon, the Vatican delegate to the Fourth World Conference on Women in September, 1995. While Glendon's point is well taken, in many societies, including the Catholic Church which Glendon represented at the Conference, women often do not have the opportunity to choose their roles and share their gifts and talents with society in the manner they deem most appropriate. John Courtney Murray And The Dilemma Of Religious Toleration, Gerard V. Bradley Jan 1996

John Courtney Murray And The Dilemma Of Religious Toleration, Gerard V. Bradley

Journal Articles

John Courtney Murray and the Dilemma of Religious Toleration. By Keith J. Pavlischek. Thomas Jefferson University Press. 290 pages. $22.50.

Keith Pavlischek's valuable book advances the Murray discussion right where Murray's writings most repay careful reading: religious liberty. Pavlischek, an evangelical Protestant, analyzes Murray's published and unpublished writings on religious liberty, and examines his role in the drafting and revision of Vatican II's Dignitatis Humanae. Pavlischek notes that Murray was not entirely pleased with DH. But Pavlischek's is the best discussion of just how the moral-theological defense of religious freedom advanced by the French prevailed over Murray's view …

Feminism, Law, And Bioethics, Karen H. Rothenberg Jan 1996

Feminism, Law, And Bioethics, Karen H. Rothenberg

Faculty Scholarship

Feminist legal theory provides a healthy skepticism toward legal doctrine and insists that we reexamine even formally gender-neutral rules to uncover problematic assumptions behind them. The article first outlines feminist legal theory from the perspectives of liberal, cultural, and radical feminism. Examples of how each theory influences legal practice, case law, and legislation are highlighted. Each perspective is then applied to a contemporary bioethical issue, egg donation. Following a brief discussion of the common themes shared by feminist jurisprudence, the article incorporates a narrative reflecting on the integration of the common feminist themes in the context of the passage of …

Assessing Modern Bankruptcy Law: An Example Of Justice, Veryl Victoria Miles

Scholarly Articles

The task undertaken in this article will be to consider how well modern bankruptcy law measures up to concepts of justice that have evolved from Catholic social thought. The application of Catholic social justice in the assessment of whether a law is "just" or "unjust" can be viewed as a rational progression in evaluating the quality of justice achieved under a law.

Maybe A Lawyer Can Be A Servant; If Not…, Thomas L. Shaffer

Journal Articles

Consider the way we American lawyers learn about the relationship between the church and the law: This grand constitutional and legal order we propose to serve is unfolded before us and built up in our minds and hearts; it comes to us out of multi-volume sets of course books, and, like the gods of Canaan, it comes to us as religious: Thomas Jefferson said America was God's New Israel; David Hoffman, the grandfather of legal ethics in America, spoke of the law as a temple and of us lawyers as priests who served in the temple; Law Day speakers commonly …
