The Graduate Review

This article defines and explores the application of restorative justice principles in the context of twentieth century genocide acknowledgments. The genocides used as case studies in this article include the Holocaust, Cambodian genocide, and Rwandan genocide. This article examines how survivors have utilized restorative practices to facilitate healing, the importance of historical site preservation, and governments acknowledging their wrongdoings. The importance of acknowledgment and making amends to facilitate healing is highlighted throughout the article. The findings underscore the complexity of applying restorative justice to genocide and the necessity of proper acknowledgment for true reconciliation and healing to occur. This article …

Ethical Dilemmas Surrounding Community Water Fluoridation, Roopwant Kaur, Herminio Perez, Mark Moss

Journal of the American College of Dentists

Since the 1950s, community water fluoridation (CWF) has stood as a cornerstone of dental public health. However, a growing amount of public scrutiny necessitates reflection on the ethical basis for coming to a firm position on the topic. Aside from CWF, fluoride in the form of ingestible supplements has recently been identified as a concern by the US Food and Drug Administration. Indeed, it is challenging to wade through the facts, opinions, misinformation, and policy shifts. This article examines the ethical dilemmas that surround CWF through the lens of the American Dental Association (ADA) Principles of Ethics and Code of …

Pawns In The Power Struggle: Navigating Creative Labor Precarity Across Mcns, Platforms, And State Regulation In China, Qingyue Sun Oct 2025

Pawns In The Power Struggle: Navigating Creative Labor Precarity Across Mcns, Platforms, And State Regulation In China, Qingyue Sun

Interdisciplinary Studies

This study examines how digital creators navigate the precarious Chinese digital creative industries (DCCIs), shaped by multi-channel networks (MCNs), platform logic, and intensifying state intervention. Drawing on interviews with 34 creators, I identified three challenges facing Chinese creators: (1) dual exploitation by volatile platforms and capricious MCN management; (2) erosion of creative autonomy under MCN gatekeeping and state oversight; (3) involuntarily being enlisted as propaganda artisans. Creators, especially those affiliated with MCNs, are increasingly positioned as state labor with governed creativity: cultural workers whose output is shaped, constrained, and redirected by the layered imperatives of state mandates, platform governance, and …

Bowers, Lawrence And Obergefell: A Case-By-Case Analysis, Hailey Moran

The Downtown Review: An Interdisciplinary Journal Written and Peer-Reviewed by Mandel Honors College Students at Cleveland State University

What does Bowers v. Hardwick, Lawrence v. Texas, and Obergefell v. Hodges all have in common? Each of these Supreme Court cases chronicles the passage of time and advancement in LGBTQ+ rights in America. Not only, however, do they chronicle the rights that have been achieved for LGBTQ+ individuals, but they also chronicle the evolution of the Justices on the bench. These cases here help us understand the influences that encourage the Justice’s decision-making, whether it be the state of the law or the Court’s environment. By analyzing each case, we can understand not only how these cases were decided, …

The Trial Of Musammat Kelee: Widowhood, Infanticide, And Colonial Justice In Early Twentieth Century India, Rashmi Banerjee Oct 2025

The Trial Of Musammat Kelee: Widowhood, Infanticide, And Colonial Justice In Early Twentieth Century India, Rashmi Banerjee

Socio-Legal Review

This article examines the 1920 trial of Musammat Kelee, a Hindu widow from Ajmer-Merwara, accused of drowning her illegitimate infant son in a lake. Drawing on extensive trial records, police reports, and official correspondence, it reconstructs the procedural history of her case and situates it within broader colonial debates on female sexuality, widowhood, and infanticide. Kelee’s conviction under Section 302 of the Indian Penal Code, despite weak evidence, hinged on judicial emphasis on her widowhood and the perceived illegitimacy of her child as proof of motive. Yet her subsequent pardon by the Viceroy’s office reflected a contradictory administrative impulse that …

Dream A Little Dream Of Licensing: Jazz And The § 115 Compulsory Music Reproduction License, Jackson S. Roberg Oct 2025

Dream A Little Dream Of Licensing: Jazz And The § 115 Compulsory Music Reproduction License, Jackson S. Roberg

Northwestern University Law Review

The compulsory music reproduction license codified at 17 U.S.C. § 115 allows anyone to obtain the right to record another version of, or “cover,” a previously published musical work. Invoking the compulsory license, however, comes at a dramatic cost. Under § 115(a)(2), the licensee cannot copyright any original musical material they compose for the cover without express permission from the underlying copyright owner, even if that material would otherwise be copyrightable. This limitation gravely harms jazz music, as jazz relies on dynamic recompositions of preexisting music. Jazz musicians depend on compulsory licenses to record the reinterpretative covers essential to the …

Reclaiming Sound: Copyright Restoration As Cultural And Economic Justice For Black Musicians, James Roberts Jr. Oct 2025

Reclaiming Sound: Copyright Restoration As Cultural And Economic Justice For Black Musicians, James Roberts Jr.

Senior Theses

This paper examines copyright restoration as both a legal mechanism and a form of cultural reparations for Black musicians historically excluded from ownership and profit in the American music industry. It traces the evolution of U.S. copyright law from its earliest forms to the Music Modernization Act of 2018, highlighting how shifting statutory frameworks have gradually extended protection and restoration rights to artists who were once denied them. The analysis situates this legal trajectory within a broader history of racialized exploitation in the recording industry, where inequitable contracts and systemic power imbalances functioned as modern forms of artistic sharecropping. Through …

Law As A Tool Of Empire: A Transhistorical Comparison Of Mandate Palestine And Ancient Rome, Will L. Hisle Oct 2025

Law As A Tool Of Empire: A Transhistorical Comparison Of Mandate Palestine And Ancient Rome, Will L. Hisle

Armstrong Undergraduate Journal of History

Through a comparative analysis of Law and Identity in Mandate Palestine by Assaf Likhovski, and A Legal History of Rome by George Mousourakis, this essay demonstrates that law was crucial to the expansion of empire. When read in tandem, these monographs provide a transhistorical framework for viewing law outside of itself, as a mechanism of colonial and imperial domination.

A History Of Native People In Nebraska, Part I, Gabriel Bruguier Sep 2025

A History Of Native People In Nebraska, Part I, Gabriel Bruguier

Truth and Reconciliation History Project

The following isn’t a comprehensive history; the aim is to highlight important events and the ideas of those whose actions brought forth the history of the region and eventually the state of Nebraska. Using an analogy from the book The Nebraska State Constitution, we can think of how the state developed as a sort of fence, a way of separating what is “mine” and “yours”, who is “us” and “them,” and who the “insiders” and “outsiders” are.9 In examining the period leading up to the formation of Nebraska Territory, it is instructive to point to how outside forces desired and …

Voices Of Latinidad: A Truth And Reconciliation Movement To Preserve Latino And Latina History, J.S. Onésimo (Ness) Sándoval

Truth and Reconciliation History Project

This chapter began as a quest to tell the story of Latinidad in Nebraska. It is not meant to be a historical account of Latinos or Latinidad, nor a socioeconomic analysis. Instead, it has evolved into an accessible narrative highlighting the accomplishments of Latinos in Nebraska. The accounts and data presented serve as a public testimony and starting point for discussions that acknowledge Latinos’ presence. These accounts were not designed as an academic treatment for scholarly work but aim to inspire future scholars to research the lives and accomplishments of Latinos in Nebraska. Latinos have long been an integral part …

Native Americans, Part Ii, Kevin Abourezk Sep 2025

Native Americans, Part Ii, Kevin Abourezk

Truth and Reconciliation History Project

The Civil Rights Movement of the 1950s and 1960s – aimed at abolishing legalized racial segregation and discrimination across the United States – found expression in Nebraska in many ways. From college protests to marches in Lincoln, the movement found a home within the youth and counterculture communities of Lincoln and Omaha. But less known is the way the movement impacted Native American populations, especially those in remote Nebraska communities. “Just as young Hispanics, Asians, and Native Americans across the nation were learning the lessons of the black experience of the 1960s and expressing their identity as they sought to …

Frontmatter And Foreword To Roots Of Justice: A History Of Race And Racism In Nebraska, Bill Arfmann

Truth and Reconciliation History Project

Covers, Table of Contents, and Foreword:

There is much to understand about the history of Nebraska and how the past shapes the present. This book attempts to bring into clearer focus the triumphs and trials of five broad groups whose lives have often been overlooked when the state’s history is told. The authors know some of this history of racism firsthand: Most of them have lived as people of color in Nebraska. They’ve experienced “the good, the bad and the ugly” that makes up our state story. We encourage educators, scholars and family historians to continue to dig, to document …

Introduction To Roots Of Justice: A History Of Race And Racism In Nebraska, M. Dewayne Mays, Paul Olson Sep 2025

Introduction To Roots Of Justice: A History Of Race And Racism In Nebraska, M. Dewayne Mays, Paul Olson

Truth and Reconciliation History Project

Nebraska has made racism a way of life through most of its history. It is still the way of life for many. In 2020, a Nebraska columnist wrote the following about Nebraska: “[T]he issues stemming from racism can seem like foreign concepts, confined to the larger cities (or the American South) and relics of a distant past.”2 The column goes on to show that these issues were not confined to large cities or to the South; they rested on our back door in Nebraska. Yet, one often heard back as far as one could remember that Nebraska is not and …

A History Of African Americans In Nebraska, Preston Love Jr., Adam Fletcher Sasse, Le Clara Gilreath, Portia Love, Heather Fryer Sep 2025

A History Of African Americans In Nebraska, Preston Love Jr., Adam Fletcher Sasse, Le Clara Gilreath, Portia Love, Heather Fryer

Truth and Reconciliation History Project

Black people have been present in Nebraska from its earliest days as a U.S. territory. The first U.S. Census of Nebraska, conducted in 1860, counted eighty-one Black people who, together, formed .28 percent of the young territory’s 28,841 residents. That number grew to 3,443 Black residents in 1900, representing 3.5 percent of the 102,555 residents of the state of Nebraska. The number and location of Black Nebraskans varied greatly through the twentieth century, comprising 13.7 percent of the state’s population in 1940 and 11.8 percent in 2020. Although African Americans have been relatively small in numbers, the historical record reflects …

Recent Arrivals: Refugee Resettlement In Nebraska, Emira Ibrahimpašić, Julia Reilly Sep 2025

Recent Arrivals: Refugee Resettlement In Nebraska, Emira Ibrahimpašić, Julia Reilly

Truth and Reconciliation History Project

One of the stories Nebraskans tell themselves is that the story of Nebraska is a story of immigration. One of the most recent versions of this story is that Nebraska is one of the best and most welcoming places in the country to be a resettled refugee. In many respects, this narrative is true, but as with all narratives, reality is more complicated. This chapter attempts to paint a fuller picture by providing a detailed history of the foundation of Nebraska’s refugee resettlement program, and an overview of five of the most populous refugee communities in Nebraska. First, we survey …

Exclusion From The Good Life: The Impact Of Anti-Asian Racism On Asian Nebraskans, Heather Fryer, Sharon Ishii-Jordan Sep 2025

Exclusion From The Good Life: The Impact Of Anti-Asian Racism On Asian Nebraskans, Heather Fryer, Sharon Ishii-Jordan

Truth and Reconciliation History Project

To understand how Americans of Asian descent experienced, adjusted, and overcame negative experiences in Nebraska, recognizing the external forces on their lives is paramount. The experiences of Asians in their diaspora across the U.S. and Nebraska during a 150-year span have been shaped by both external (global and domestic) and internal (personality and resilience) factors. The presence of stereotypes specifically targeted toward Asian Americans due to exotic imaginings, pseudoscience, and economic fears, in addition to the images created by national media, gave rise to society’s acceptance of stereotypes. These external factors contributed to a belief that continues to this day …

It concludes that both parties to the conflict violated international human rights and humanitarian law, with most violations amounting to war crimes. The Rapid Support Forces’ conduct may also constitute crimes against humanity, including persecution and extermination. The report calls for accountability and sets out a roadmap for justice.

The US Army War College Quarterly: Parameters

Welcome to the Autumn 2025 issue of Parameters. We open with two In Focus commentaries. The first, “A Case for Military Proportionality: Disabling Nuclear Plants” by Henry Sokolski, offers practical ways in which military planners can disable civilian targets, such as nuclear infrastructure, without undermining operational goals, alliance cohesion, or long-term political objectives. Our second commentary, “The Consequences of Declining Patriotism in the United States” by Neil N. Snyder, presents findings from a national survey showing a decline in patriotism, especially among Generation Z nonveterans. His article highlights a growing civil-military values gap with implications for recruitment and national …
