Disjunctive legal change is often accompanied by a period of frantic activity as the competing forces of stasis and evolution vie for domination. Nowhere is the battle for legal change likely to be more sharply joined than when the findings of modern science, in their varied and multifarious forms, are pitted directly against prevailing moral or societal precepts. One of the latest incarnations of this trend is the battle over the legal recognition of gay "rights." In recent history, the courts have been inundated by gay litigants seeking the rights and protections already afforded other discrete groups within society. In …

Lucas Heights Revisited: The Framing Of A Major Scientific Controversy By The Sydney Morning Herald, Adam Robert Lucas

A detailed analysis of the Sydney Morning Herald's reportage of the Lucas Heights controversy reveals significant omissions in the cover-age. In particular, I draw attention to the existence of two competing rationalities within the controversy, that is, the instrumental rationality used by the Australian Nuclear Science and Technology Organisation (ANSTO), the Australian Federal Government, and the SMH editorial to publicly justify the buildeing of a new reactor, and the ecological rationality advocated by the Sutherland Shire Council's scientific consultants and some individuals within the environmental lobby. The Role Of Harm And Evil In Criminal Law: A Study In Legislative Deception?, Paul H. Robinson

What is the role of the occurrence of harm or evil in criminal law? What should it be? Answers to these questions commonly use the distinction between what is called an objective and a subjective view of criminality. To oversimplify, the objective view maintains that the occurrence of the harm or evil defined by the offense is highly relevant. The subjectivist view maintains that such harm or evil is irrelevant; only the actor's culpable state of mind regarding the occurrence of the harm or evil is important. The labels tend to overstate a rather subtle distinction. The objectivist or harmful …

From Critics To Casualties: The National Farmers Union And United States Foreign Policy, 1945-1953, Bruce Edward Field

This study chronicles the change in the foreign policy views of the National Farmers Union brought about by U.S. involvement in the Korean War. Abandoning its poignant criticisms of President Truman's earlier Cold War initiatives, the nation's foremost liberal agrarian organization embraced not only American actions in Korea but on a larger scale administration attempts to further what Henry Luce termed the "American Century." This policy reversal created a rift between the national organization and various state and regional branches. The Iowa and Northeastern divisions in particular objected to the shift as a surrender of principle and as a capitulation …

In Search Of The Market’S Moral Limits: Liberalism, Perfectionism, And ‘The Bad Man’ In Christian Perspective, William J. Wagner

The orientation to law and values which can sustain specifically Christian arguments for, and against, the restriction of market exchanges requires reference to authentically Christian theological principles and values. It requires, equally, that such principles and values be set in profile against the assumptions of both liberalism and classical perfectionism. This essay aims to provide such a statement of the relevant Christian orientation to law and values.

I would like to make several points in this essay. First, the historians of national legal systems are still, by and large, balkanized. They study, explain, and trace the history of their legal systems with only a cursory nod in the direction of the Ius commune. Second, within the Ius commune, some historians still approach a topic as if its various parts can be studied in isolation. A Romanist will study a doctrine of Roman law as if canon and feudal law had only tangential influence on the development of the thought of the civilians.
