Advanced data collection and analysis has allowed police departments across the country to incorporate computer generated crime predictions into both short and long-term policing strategy. Predictive policing offers novel legal, ethical and logistical challenges to our criminal justice system. These technologies have the ability to erode our constitutional rights to privacy and equality, but they also have enormous capacity to make law enforcement more efficient and effective. This thesis explores extant Supreme Court jurisprudence to better understand how these technologies will affect our civil liberties, specifically with respect to the Fourth and Fourteenth Amendments.

The primacy accorded individual civil and political rights is often touted as one of the United States' greatest achievements. However, mass incarcerations of indefinite duration have occurred consistently throughout U.S. history and have primarily targeted people of color. The dominant narrative insists that the United States is a political democracy and portrays each instance of indefinite detention in exceptionalist terms. Medico-Legal Collaboration Regarding The Sex Offender: Othering And Resistance, Mary Lay Schuster, Brian Larson, Amy D. Propen

We examined medico-legal collaboration regarding dangerous sex offenders where state legislators have adopted statutes that determine the criteria for commitment to and discharge from civil commitment programs. The application of these statutes relies on medical diagnoses of pathologies such as paraphilia, anti-social personality disorder, and pedophilia along with prognoses for cure or recidivism. In our study, we examined court opinions from commitment hearings and observed a trial in federal court on the constitutionality of these commitments. We found that one result of this medico-legal collaboration is the marginalization or othering of sex offenders by essentializing, dividing, shaming, and impeaching them. …

The doctrine of unconscionability allows a court to refuse to enforce a contract because of its unfairness. Although well settled in contract law, the doctrine remains controversial. Critics of the doctrine argue that it is impermissibly paternalistic: it rescues responsible agents from the consequences of their own mistakes.' Defenders of the doctrine admit its paternalism but insist that the unfairness in cases of unconscionability makes paternalist intervention legitimate. Critics say that the doctrine is sentimental and wonder if the resort to expressions such as "shocks the conscience" conceals the defenders' inability to articulate the standard these agreements supposedly transgress.' If I say “He’s an eligible BLANK,” you’re likely to complete the sentence with “bachelor.” The fact that “eligible” and “bachelor” often appear together--in corpus-linguistic terms, they are collocated--tells us something about the meaning of “bachelor” that is not in its dictionary definition and related social values (e.g., gendered ones, in this example). This article, based on a keynote address delivered at the University of Toledo Law Review Symposium on “Gender Equality: Progress and Possibilities,” takes up the task of theorizing gendered aspects of the current chasm between progressive elites on one hand and rural and working-class whites on the other. As intelligent machines begin more generally outperforming human experts, why should humans remain ‘in the loop’ of decision-making? One common answer focuses on outcomes: relying on intuition and experience, humans are capable of identifying interpretive errors—sometimes disastrous errors—that elude machines. Though plausible today, this argument will wear thin as technology evolves.
Here, we seek out sturdier ground: a defense of human judgment that focuses on the normative integrity of decision-making.
