Avoiding Spacex's Giant Leap Backwards For Mankind: Why The Nlrb Leadership Is Constitutionally Protected And How To Keep It That Way, Clara Goldrich
Avoiding Spacex's Giant Leap Backwards For Mankind: Why The Nlrb Leadership Is Constitutionally Protected And How To Keep It That Way, Clara Goldrich
Brooklyn Law Review
Companies like SpaceX and Amazon are arguing in federal court that the structure of the National Labor Relations Board (NLRB) unconstitutionally protects its Members and administrative law judges (ALJs) from presidential removal. President Donald Trump’s firing of Member Gwynne Wilcox, the ensuing litigation, and the Supreme Court’s grant of certiorari in an analogous case, Trump v. Slaughter, has kicked the constitutional question of NLRB leadership removal protections into high gear. This Note examines the constitutionality of NLRB Member and ALJ removal protections. Under current Supreme Court precedent, NLRB Member removal protections are likely constitutional. However, the Court has recently signaled …
Exploring The Dynamics And Outcomes Of Family Engagement In Child Welfare Services: A Structural Equation Modeling Approach, Jianchao Lai, Michelle Graef, Todd Franke
Exploring The Dynamics And Outcomes Of Family Engagement In Child Welfare Services: A Structural Equation Modeling Approach, Jianchao Lai, Michelle Graef, Todd Franke
Center on Children, Families, and the Law: Faculty Publications
Background: Engaging families effectively in child welfare services remains a persistent challenge, shaped by complex interactions between agency practices and family circumstances. While existing research has explored this issue, it has predominantly relied on data from agency and caseworker perspectives, often overlooking the crucial viewpoint of the families. Objectives: This study investigates families’ subjective experiences and perceptions within the child welfare system, focusing on their satisfaction with child welfare workers and overall engagement. Methods: The study draws on data collected through an evaluation of the implementation of Alternative Response in a Midwestern state. Agency administrative data is integrated with additional …
Public Patent Powers, Laura E. Dolbow
Public Patent Powers, Laura E. Dolbow

Congress has created multiple structures for agencies to control how patents are used, but that institutional design choice has received little academic attention. This Article provides the first comprehensive survey of existing laws that expressly authorize agencies to control patents. I locate 113 express conditions across 68 laws that expressly authorize executive actors to make some form of decision about patents. These powers, which I refer to as “public patent powers,” allow the government to use patented inventions, to obtain patents, to authorize third parties to use patented inventions, and to regulate how patents are used. Agencies have used many …
The Major Questions Doctrine, Post-Chevron?: Skidmore, Loper-Bright, And A Good-Faith Emergency Question Doctrine, Jed Handelsman Shugerman
The Major Questions Doctrine, Post-Chevron?: Skidmore, Loper-Bright, And A Good-Faith Emergency Question Doctrine, Jed Handelsman Shugerman
Faculty Scholarship
When my students and colleagues fretted about Chevron's fate, I have said, "Worry less. Skid-more." Just as old Skidmore "weight" or "respect" returns post-Chevron, the new (and newer) major questions doctrine(s) survive as a reason to give less weight to an agency interpretation. This symposium essay suggests a special role for the post-Chevron major questions doctrine: an Emergency Questions Doctrine. When the executive asserts an emergency power, when the statutory basis is open-ended (often for very good reasons), majorness means less deference to simple and fast textualism, and more time for courts to engage in deeper purposivism to …
Amicus In Wilcox V. Trump On Presidential Removal And Unitary Executive Theorists’ Errors, Jed Handelsman Shugerman
Amicus In Wilcox V. Trump On Presidential Removal And Unitary Executive Theorists’ Errors, Jed Handelsman Shugerman

As courts ask whether Free Enterprise and Seila Law call into question Humphrey’s Executor and independent officers or agencies, the more immediate questions should be focused on new historical evidence and new fact-checking finding pervasive and repeated historical errors and misinterpretations at the foundation of the unitary executive theory of removal.
Since the Supreme Court decided Seila Law, a wave of new historical research has shown that the Founding generation did not understand Article II to grant the President an indefeasible removal power over executive officials. In response, pro-unitary executive scholars have tried to offer new historical support. That …
Judicial Accountability, Anya Bernstein
Judicial Accountability, Anya Bernstein
Faculty Scholarship
Judicial decisions are moving ever more authority over regulatory statutes away from agencies and to courts instead. One justification offered for this power transfer: agencies lack the accountability of courts. This Article takes up that claim, assessing the institutions’ relative capacities for accountability in their authoritative interpretations of regulatory statutes—agency regulations and court rulings. I take accountability to involve actors undertaking reasoned decisionmaking grounded in publicly recognized values and facts and justifying their decisions to others who can evaluate, influence, or override those judgments. Accountability thus involves a give and take: it gives an account of government reasoning to a …
Middlemen At A Price: The Role Of State-Level Laws In Restricting Pharmacy Benefit Managers, Patrick W. Schrader
Middlemen At A Price: The Role Of State-Level Laws In Restricting Pharmacy Benefit Managers, Patrick W. Schrader
Lewis & Clark Law Review
Pharmacy Benefit Managers (PBMs) have evolved from simple third-party payors into powerful intermediaries controlling prescription drug access for over 289 million Americans. Operating with minimal federal oversight, just six PBMs dominate 96% of the market, employing practices that systematically increase drug costs while claiming to reduce them. This Comment examines four primary mechanisms through which PBMs exploit the pharmaceutical supply chain: rebate manipulation, spread pricing, step therapy requirements, and formulary control. Federal regulatory efforts remain nascent and ineffective. The Centers for Medicare and Medicaid Services requires only basic reporting without substantive restrictions. Proposed federal legislation has repeatedly stalled, leaving states …
Living The Good Life In The Anthropocene, Danielle Stokes
Living The Good Life In The Anthropocene, Danielle Stokes

The Stockholm Resilience Centre has concluded that the number of “planetary boundaries” we are crossing has increased from three in 2009, when the Centre’s researchers first introduced the concept, to six in 2023. Crossing these boundaries means humans are changing basic attributes of planetary systems to the point of risking the future of civilization. And the distinction between “safe” and “just” planetary boundaries raises questions regarding how to conceptualize the “good life.” In this latest in a biannual series of essays, members of the Environmental Law Collaborative explore conceptions of the “good” as well as the various elements necessary to …
The Real Story Of Nepa Litigation In Clean Energy Permitting, Anna Mance
The Real Story Of Nepa Litigation In Clean Energy Permitting, Anna Mance
Faculty Journal Articles and Book Chapters
Environmental protections and the processes of the administrative state are under attack. In recent years, the National Environmental Policy Act (NEPA) has drawn outsized criticism from across the political and legal spectrum as a major impediment to climate friendly infrastructure and the clean energy transition. NEPA enables private groups to challenge development through litigation. Critics are moving to strip public oversight over federal permitting based on claims that these private groups bring largely frivolous environmental claims to court, driving up costs for developers and delaying progress responding to climate change. But is this really true?

Effects Of Perceived Procedural Justice On The Relationship Between Visa Application Outcome And Psychological Distress: Evidence From Ghanaians And Nigerians Applying For U.S. Student Visas, Harriet Swanzy-Baffoe
Effects Of Perceived Procedural Justice On The Relationship Between Visa Application Outcome And Psychological Distress: Evidence From Ghanaians And Nigerians Applying For U.S. Student Visas, Harriet Swanzy-Baffoe
Masters Theses
Visa interviews are not just bureaucratic processes; they can have significant psychological effects on applicants. This study examined the impact of U.S. student visa outcomes on psychological distress among West African applicants, with particular attention to perceptions of procedural justice during the interview process. The study surveyed 203 Ghanaian and Nigerian individuals who had previously applied for a U.S. student visa. Psychological distress was measured using the Impact of Event Scale-Revised (IES-R), and perceptions of fairness were measured with a custom-developed Procedural Justice Scale. Independent samples t-tests showed that denied applicants reported significantly higher distress, although elevated symptoms were also …
Mechanisms For Including Publics In Administrative Governance, Nina-Simone Edwards
Mechanisms For Including Publics In Administrative Governance, Nina-Simone Edwards
Library Scholarship
This project’s fourth concept paper rethinks public participation in administrative processes. Although participation mechanisms are theoretically designed to enable those affected by regulations to influence their development, it is often extremely difficult for members of the public to meaningfully engage with agencies. After discussing institutional failures of current participation mechanisms, this report develops a set of principles to guide the redesign of public participation mechanisms. These include involving publics earlier in the process, building both public and regulatory capacity for meaningful, two-way communication, and reframing expertise as a public good.
The paper then proposes specific mechanisms to optimize communication between …
Designing Policymaking Mechanisms For Regulatory Dynamism, Nina-Simone Edwards
Designing Policymaking Mechanisms For Regulatory Dynamism, Nina-Simone Edwards
Library Scholarship
The project’s third concept paper focuses on the design of regulatory policymaking mechanisms that translate decisions about public values–such as “avoid deceiving consumers”–into operationalized forms that support iteration and experimentation. It outlines a set of foundational principles for a dynamic, effective regulatory toolkit that empowers regulators to act sooner, experiment, create governance seams, mandate beneficial friction, and extend regulatory authority in ways that mirror the scale and interdependence of digital supply chains.
To support this expanded regulatory toolkit, the paper recommends empowering regulators to mandate data flow restrictions, to develop design requirements for both user-facing and technical interfaces, to require …

Dekolonisasi Hukum Perdata Indonesia: Kritik Terhadap Warisan Kolonial Dan Implikasinya Terhadap Pembangunan Hukum Berkeadilan, R. Mustar Lofi
Jurnal Hukum & Pembangunan
A Market-Based Approach To Effective Slaughterhouse Line Speed Regulation, Kailey Mcneal
A Market-Based Approach To Effective Slaughterhouse Line Speed Regulation, Kailey Mcneal
Animal Law Review
The nature of animal agriculture in the United States is heavily industrialized and profit-centered. Industrial animal agriculture maximizes profits and production by employing low-wage workers to do significant loads of labor. Slaughterhouses’ implementation of faster line speeds reflects this tactic. As the industry continues to increase line speeds to boost profits, workers, animals, and the environment continue to face augmented risks to their health and safety. Nonetheless, slaughterhouse line speeds at the federal level remain largely un- and under-regulated. The current federal regulatory scheme is unduly influenced by industry interests, prioritizes profit over safety, and lacks effective enforcement mechanisms. Through …
The Ill-Fated History Of Animal Protection Laws: Why Congress Must Create An Animal Protection Agency, Melissa Baines
The Ill-Fated History Of Animal Protection Laws: Why Congress Must Create An Animal Protection Agency, Melissa Baines
Animal Law Review
Over the years, the United States Congress has passed several federal laws with the intention of protecting animals from being subjected to inhumane treatment by humans. Such laws have great potential to create positive change for animals, but all of these laws have been delegated to inappropriate government agencies for oversight and enforcement. It is time to finally remove the impossible task placed upon these federal agencies—who have been asked to carry out their own stated mandates while also promulgating rules that effectuate animal protection laws in conflict with those same mandates—by creating a federal Animal Protection Agency with the …

Using Public Nuisance Litigation To Address Industrywide Misconduct: Common-Law Statutes, Nondelegation, And Regulation, Hillel Y. Levin, Timothy D. Lytton

In this Article, we assert that broad, open-ended public nuisance statutes offer a legitimate legal tool to curb public health harms caused by the unreasonable design, marketing, and distribution practices of product manufacturers. We argue that these statutes are "common-law statutes" by which legislatures authorize courts to apply the concept of public nuisance to new situations using common-law-style reasoning. We demonstrate that this understanding of public nuisance statutes is consistent with well-established interpretive traditions regarding the codification of common law. Statutory delegation of broad interpretive discretion to courts concerning the application of public nuisance law constitutes a legislative choice to …
Unconstitutionil: Name, Image, And Likeness State Laws In The Postamateurism World Of College Sports, Bryan Dearinger
Unconstitutionil: Name, Image, And Likeness State Laws In The Postamateurism World Of College Sports, Bryan Dearinger
American University Law Review
College sports stands at its biggest inflection point in a century. Amateurism is almost dead, and the ability to benefit from their name, image, and likeness (NIL) is here to stay. Scholars, lawyers, and policymakers are quick to congratulate state legislatures, criticize the National Collegiate Athletic Association (NCAA), and propose blueprints for Congress to fix the NIL regime in college athletics. But the incentives for dismantling the old regime are not shared between schools and the NCAA, so nothing happens. A collective action problem exists in the NIL space. Using a commons dilemma lens, this Article argues why NIL laws …

The implementation of strikes by doctors is a complex phenomenon with significant implication that give rise to ethical dilemma. Doctors have a responsibility to provide health services, so that a strike can endanger the health care system. On the other hand, doctors also have the right to fight for fair and decent working conditions. In view of these problems, this study has two (2) problem formulations, how the legal regulations regarding the actions of doctors who go on strike and how the ethical responsibilities of doctors who go on strike. The rapid advancement of information technology has intensified the risks of personal data breaches and violations of privacy rights. Although Law Number 27 of 2022 on Personal Data Protection (PDP Law) has established a comprehensive legal framework for personal data protection in Indonesia, its effective implementation remains constrained by the absence of the Personal Data Protection Supervisory Authority (PDP Authority). This institutional absence creates a structural authority vacuum that weakens preventive measures, law enforcement mechanisms, and alternative dispute resolution in personal data protection. Through normative legal analysis using Hans Kelsen’s Stufenbau Theory, Nonet and Selznick’s Responsive Law Theory, and Satjipto …

Analisis Klausula Choice Of Forum Dalam Kontrak Standar E-Commerce Di Indonesia: Kajian Berdasarkan Perspektif Perlindungan Konsumen, Sarping Saputra
Jurnal Hukum & Pembangunan
This research discusses choice of forum clauses in standard contracts on the five largest e-commerce platforms in Indonesia, namely Shopee, Tokopedia, Lazada, Bukalapak, and Blibli. The clause stipulates the mechanism and location of dispute resolution that automatically binds consumers when using the platform. In practice, these clauses tend to burden consumers, especially regarding access to fair dispute resolution. This research focuses on the compatibility of the choice of forum clause with the principles of consumer protection regulated in the Consumer Protection Law (UUPK). The results reveal that most e-commerce platforms use exclusive forms of choice of forum clauses, such as …

The Interchangeable-Part Structure Of Food And Drug Law, Adam I. Muchmore
FIU Law Review
This Article demonstrates that nested tiers of interchangeable parts serve as the foundation for the regulatory programs administered by the U.S. Food and Drug Administration. Core interchangeable parts used in FDA-administered programs include product categories, prohibitions on adulteration and misbranding, agency-registration requirements, current good manufacturing practices, product standards, marketing authorization requirements, postmarket requirements, and user fees. In each of these areas, Congress or the FDA has engaged in interchangeable-part lawmaking (IPL). IPL occurs when a government takes a portion of its law in one subject area and uses it as a model for its own law in another subject area. …

“Modernizing Regulatory Review”: A Short-Lived Abandonment Of More Than Four Decades Of Regulatory Review And Benefit-Cost Analysis, Richard Belzer

"President Biden’s Modernizing Regulatory Review (MRR) initiative fundamentally altered regulatory procedures, practices, and centralized oversight that had been in place since 1981 when they were formalized by President Reagan in Executive Order 12,291. MRR proceeded in three phases. First, a Memorandum issued on President Biden’s first day in office telegraphing the broad outlines of the plan. Second, more than two years later, an Executive Order codifying the MRR memorandum was issued, combined with implementation guidance issued by the Office of Management and Budget (OMB). And third, OMB guidance on the conduct of regulatory BCA was radically revised, clearly with an …
Emergency Oversight, Catherine Baylin Duryea
Emergency Oversight, Catherine Baylin Duryea
FIU Law Review
This Article examines one of the most pressing questions in administrative law: How much judicial oversight should administrative agencies face during an emergency? This issue was particularly salient during the COVID epidemic, but it is not new. The Second World War saw a significant expansion and consolidation of the power of administrative agencies as well as experimentation with the appropriate oversight role for courts. This Article analyzes one such experiment: judicial oversight of agencies implementing wartime anti-inflationary measures, i.e. price controls and rationing. During the war, Congress created a specialized court, the Emergency Court of Appeals (ECA), to hear disputes …

The Hunger Games: Food As A Right, Not A Privilege, Camesha F. Little
FIU Law Review
Despite the United Nations' explicit declaration that all humans have a right to food, food insecurity and hunger remain persistent problems in the United States and around the globe. The dystopian landscapes depicted in novels such as The Hunger Games and Parable of the Sower—societies crippled by poverty, oppression, and pervasive starvation—resonate with sobering contemporary realities. This Article examines existing food laws, food rights, and the current protections safeguarding the United States food supply from a humanitarian perspective. Ultimately, this Article argues that the human right to food must expand to encompass a right to healthy or natural food, and …

The article provides a legal-technical and market analysis of electronic delivery in Poland, concluding that while the system complies with the basic requirements of the eIDAS Regulation, it needs significant organizational and technical improvements. The author reviews the National Electronic Delivery System, the role of the designated operator and qualified trust service providers, and highlights issues with interoperability, address registration and portability, delivery mailboxes, and the hybrid delivery service. Recommended legal reforms include granting the public delivery service qualified status, enabling multiple delivery addresses for public and complex organizations, partly opening the market to commercial qualified providers, and moving supervision …
