Administrative Law- Federal Water Pollution Prevention And Control Act Of 1972- Jurisdiction To Review Effluent Limitation Regulations Promulgated Pursuant To The Act By Environmental Protection Agency Lies In Circuit Courts, James C. Mcmahon, Jr.
Fordham Urban Law Journal
Plaintiffs, eight corporations engaged in the manufacture and sale of chemicals, brought an action against the Administrator of the Environmental Protection Agency (EPA seeking review of certain regulations promulgated by the Administrator under the Federal Water Pollution Prevention and Control Act of 1972 (Act). The district court dismissed the complaint for lack of subject matter jurisdiction to review the regulations. The Court of Appeals for the Fourth Circuit affirmed. It seems clear that the Supreme Court will have to decide the question of the Administrator's authority to issue effluent limitations pursuant to section 301 of the Act before the collateral …

On Labor Day 1974, President Ford signed into law~the Employee Retirement Income Security Act of 1974, commonly known by its acronym ERISA. Securing A Valid Annexation In Virginia: State And Federal Requirements
Securing A Valid Annexation In Virginia: State And Federal Requirements
University of Richmond Law Review
Municipal expansion by the annexation of surrounding territory involves two separate and distinct procedures in Virginia. Due to the Commonwealth's coverage under the Voting Rights Act of 1965, municipalities seeking annexation must obtain federal approval in addition to satisfying the requirements of state law. Compliance with the Act requires an affirmative showing that the expansion is nondiscriminatory in both its purposes and effects with regard to minority voting strength. Failure to meet these fed- eral requirements will invalidate the annexation, irrespective of its compliance with state law. This note will first examine the law of annexation in Virginia, highlighting its …

The Extraterritorial Scope Of Nepa's Environmental Impact Statement Requirement, Michigan Law Review
Michigan Law Review
This Note analyzes the extent to which NEPA's section 102(2) procedural requirements, specifically the impact statement requirement of section 102(2) (C), apply to federal agencies in their activities abroad. After determining that Congress does possess the authority to extend the requirements of NEPA to all federal agency actions, and that legislative intent will thus control the territorial scope of these requirements, consideration will be given to the presumption against the extraterritorial application of congressional enactments. It will be concluded that a "clear statement" of congressional intent is not required in the case of NEPA and that the scope of the …
