Federal Financing Of Urban Economic Development, S. William Green, Nancy W. Hunt Jan 1981

Federal Financing Of Urban Economic Development, S. William Green, Nancy W. Hunt

Fordham Urban Law Journal

Green and Hunt address the issue of whether the federal government should focus on "solving the nation's macroeconomic problems" with the hope that it will encourage local economic activity, or focus directly on "localities that are in social, economic or fiscal distress." They discuss and highlight the shortcomings of past federal initiatives to aid declining urban areas such as Hoover's Reconstruction Finance Corporation, the Housing Act of 1954, the Urban Development Action Grant program, the Community Development Block Grant, the Area Redevelopment Act, the Public Works and Economic Development Act of 1965 and the Reagan Administrations Kemp-Garcia plan. Green and …

The Fairness Doctrine: Fair To Whom, Loretta T. Menkes Jan 1981

The Fairness Doctrine: Fair To Whom, Loretta T. Menkes

Cleveland State Law Review

This Note contends that the fairness doctrine, as presently applied, fails to meet its legislative purpose and violates constitutionally protected rights. This Note will examine the standards and policies established by the FCC as judicially approved in Red Lion Broadcasting, Inc. v. FCC and American Sec. Council Educ. Foundation v. FCC. Practical application of these standards and policies will be explored in three categories: 1) controversial issue programming; 2) commercial advertisements; and 3) political messages. Finally, a solution to the arbitrary and discriminatory application of this amorphous doctrine will be suggested.

Regulatory Reform In A Time Of Transition, Peter L. Strauss Jan 1981

Regulatory Reform In A Time Of Transition, Peter L. Strauss

Faculty Scholarship

As Americans have become both disheartened at the performance of their governments and conscious of their penetration into what were once private lives, regulatory reform has been urged with increasing fervor at both federal and state levels. Some of the reform talk is lawyer's talk, some of it is directed to the most fundamental aspects of the government order, and there is a good bit in between. My purpose here is to examine a number of the directions being suggested at the federal level for regulatory reform during the coming decade. While it would be helpful also to consider state …

Counter Revolution In The Federal Courts Of Appeal - The Aftermath Of Vermont Yankee, Jon A. Mueller Jan 1981

Counter Revolution In The Federal Courts Of Appeal - The Aftermath Of Vermont Yankee, Jon A. Mueller

University of Richmond Law Review

In recent years, there has been growing judicial concern about the fairness of action by administrative agencies and the ability of courts to effectively review this action. This concern stems from the increased use of informal procedures by agencies promulgating rules or orders, to accomplish the congressional objectives set out in their substantive statutes. In response, certain federal courts of appeal have begun to impose upon these agencies more procedural safeguards than are required by either the Administrative Procedure Act (APA) or substantive statutes. These judicially imposed safeguards are more commonly known as hybrid procedures.

The Administrative Muddle In Georgia, Jessye Leigh Scott, Thérèse D. Stiffler

Mercer Law Review

In Rogers v. Composite State Board of Medical Examiners, the Georgia Supreme Court dismissed as moot a constitutional challenge to the subpoena power of the State Board of Medical Examiners. Dr. John Rogers, a physician in Columbus, Georgia, was involved in civil litigation with the board concerning its composition and the appointment of its members. The final disposition of this suit was in Rogers' favor. While this litigation was pending, Rogers was served with a subpoena to furnish certain information from his patient files to the Board's investigator. Rogers was informed that a criminal investigation was being conducted, however, …

The Civil Investigative Demand: A Constitutional Analysis And Model Proposal, Anthony J. Mcfarland Nov 1980

The Civil Investigative Demand: A Constitutional Analysis And Model Proposal, Anthony J. Mcfarland

Vanderbilt Law Review

This Note first traces the initial judicial reaction to administrative demands for information and administrative investigations and delineates the constitutional requirement set forth therein. The Note next examines the development of CIDs and analyzes decisions upholding their constitutionality. This Note contends that most courts either have incorrectly applied current administrative standards to the CID or have failed to apply such standards altogether. The analysis is broken down into six parts, each dealing with a separate constitutional basis for a CID challenge. Because most suits that contest CIDs are based on fourth amendment search and seizure issues, the bulk of this Note …
