On November 2-3, 2001, the University of Buffalo sponsored Digital Frontier: The Buffalo Summit 2001. The attendees included Gary M. Schober (Moderator), Shubha Ghosh (Organizer), Ann Bartow, Chris Hoofnagle, and Phyllis Borzi. The participants were drawn from a wide range of specialties, from lawyers and doctors to business-men and academics, in order to provide some perspective on our data-driven world. This session on Privacy and Security identified some of the trends in technology that threaten privacy rights, as well as those that may assists preserving privacy. The speakers also explored legal developments and political structure influencing cyber-privacy.

Vaguely Going Where No-One Has Gone: The Expansive New Computer Access Offences, Alex Steel

Both the New South Wales and Australian Commonwealth governments have enacted major reforms to computer - related offences. These reforms are based on the Model Criminal Code Chapter Four: Damage and Computer Offences. The reforms move from an emphasis on access to an emphasis on damage. While they provide principled limitations on some previous offences they also introduce new sweeping offences relating to network impairment and control of data preparatory to other offences. This article outlines the elements of these new offences and highlights the issues that are likely to arise in their enforcement.

This Article examines the conflict in the former Yugoslavia which gave birth to the International Criminal Tribunal for the former Yugoslavia (ICTFY). The ICTFY established the beginning of a new pattern in the genuine international implementation of international criminal and humanitarian law and the move back to the international model inaugurated at Nuremberg which had in the Cold War era been boldly supplanted by national prosecutions. The Article seeks to show that even this ad hoc tribunal was the by-product of international realpolitik. “Now You See, Now You Don’T: The Duty Of The State To Investigate And Prosecute ‘Disappearances And Extra Judicial Executions, Jackson N. Maogoto

This article sets out to explore the duty of a state to punish “disappearances” and extra-judicial executions. Section II will introduce generally the spectre of forced “disappearances” and extra-judicial executions as conceived by Hitler (arguably the architect of the institutionalisation of this atrocious practice by the state) and outline a brief commentary on the scourge. Section III will define “disappearances” and extra-judicial executions. It will further discuss the attractiveness of this form of human rights violation as an instrument of governmental policy to states. Individual criminal responsibility, and command responsibility in particular, are important because, to deter human rights abuses, potential perpetrators must perceive prosecution as a possible consequence of their actions. Historically, the doctrine of command responsibility has been an important tool to hold accountable leaders who plan, participate in, or acquiesce in large-scale human rights abuses. The purge of mortgage is believed to be one of the few French remnants in the otherwise largely German style Japanese Civil Code. Since the breakdown of Japanese asset price bubble in early 1990s, it has been blamed as one major obstacle to clearing up nonperforming loans held by Japanese banks, and a central target subject to abolishment. In this paper, I analyzed the structural problems existing in the Japanese purge system and also probed the history and social background behind the debates about its abolishment. While regulatory agencies have been engaging in negotiation with regulated parties and other stakeholders for decades now, careful study of the implications of such negotiations have lagged. In particular, while several commentators have now staked out intellectual ground on the theoretical ramifications of regulatory negotiation, empirical analyses of regulatory negotiations have been lacking. This article analyzes the implications of regulatory "reinvention" as the latest in a series of administrative initiatives aimed at achieving better rulemaking and adjudication through negotiations. Reinvention is commonly understood to mean those programs that utilize negotiated agreements to implement regulatory requirements imposed by various environmental statutes. …

It explains the concepts of anti-essentialism, intersectionality, multiple consciousness, multi-dimensionality, and post-intersectionality.
