This paper examines the different types of assistive and instructional technology available to students who are classified with one or more of the thirteen disabilities outlined in the Individuals with Disabilities Education Act (referred to as, IDEA). While the roles of assistive and instructional technology are different, there are many instances where their uses may overlap. The right to an equal education for students with disabilities is not something that has been available to all children until recently. In 1975, the passing of Public Law 94-142 started the movement of social justice and inclusion for all people with diverse learning abilities to receive equal access to an education. This law has been restructured and is currently known as the Individuals with Disabilities Education Act (2004). Students with disabilities are significant members of the American population; consequently, provisions for their inclusion in the learning community as outlined in the Individuals with Disabilities Education Act (IDEA) are relevant. The purpose of the study was to track disability trends in due process cases from 2008-2018 in Missouri for students in public schools from grades K-12. The researcher undertook a descriptive content analysis of archived data from the Missouri Department of Elementary and Secondary Education. The Second Circuit Court of Appeals has declared that “Prior decisions of this Court are consistent with the Supreme Court’s decision in Endrew F.,” the 2017 Supreme Court decision interpreting the Individuals with Disabilities Education Act obligation to furnish students with disabilities free, appropriate public education. This Essay considers whether that statement is accurate, and concludes that while some of the past Second Circuit decisions fit comfortably with Endrew F. ex rel. Joseph F. v. Douglas County School District RE-1, others do not. The Essay submits that the court of appeals should confess a lack of clairvoyance in its earlier …
