Restorative Justice is a practice that incorporates harmed parties and the greater community in resolving harm or conflict, the ultimate goal of restorative justice being to make things right. This practice has been used increasingly in student conduct processes on college campuses across the United States. This doctoral research paper serves to evaluate the restorative justice program housed at the University of Denver, which has been using this process since 2012. This op-ed piece for the Chronicle of Higher Education argues that the affirmative consent rule of "yes means yes" is a useful standard that can help educate and ideally change norms regarding consent to sexual intercourse. But that goal can best be achieved by using “yes means yes” as an ex ante announcement of the society's desired rule of conduct. That standard only becomes problematic when used as the ex post principle of adjudication for allegations of rape. Together our two essays move between scenes of teaching and researching with women and men who are or have been in prison. Having written on ethnography, autoethnography, and participatory research, we both have sought a method that would allow us to abandon superficial identifications, mistaken for deep connection, with those who are or have been incarcerated. While we are conscious of the failures and successes of our attempts, we nonetheless write because what we have learned about the state's support for mass incarceration and the state's retreat from public higher education—particularly for persons of color—more than warrants it.
