Further than Ethics concieved as mere obedience, Republican Ethics expresses the idea of duty for freedom and Liberty. After Law concieved as only duty and imperative norms from power to the subjects, there is the possibility of a fraternal law, in new patterns. This article explores several ways in a new ethics and a new law paradigms, after the objective Roman Law and the subjective modern Law.

Recent U.S. high consequence events have made clear the importance of government collaboration with industry. The benefits of such collaboration were clearly seen as a lesson from Hurricane Katrina. The resources owned and controlled by American industry dwarf those available to local, state and even the federal government departments. Better agreements and incentives to bring the full capabilities of industry squarely into the national response agenda will be indispensable in effectively responding to large-scale catastrophes. This short article is a follow-up to a piece I wrote two years ago on Hamdan v. Rumsfeld, SSRN No. 913822. While applauding the result in Hamdan, I critiqued the Supreme Court for missing a “teachable moment” and obscuring the great issues at stake in prolixity and mind-numbing technical detail.In this article, I applaud the Boumediene v. Bush Court not only for its result—that the Constitution’s Suspension Clause can require habeas corpus for aliens held abroad under certain circumstances—but for its reasoning and style as well. In 2003, there were 586,523 international students in U.S. institutions. International students make up 13 percent of U.S. graduate students, and account for one-fifth of all doctorates. Some students remain in the U.S., while others return to their home countries. Either way, however, international students represent a very significant portion of the U.S. higher education field. Yet the literature on international graduate students is surprisingly sparse. While there are many studies of the international graduate student experience, they tend to focus mostly on language acquisition, academics, acculturation and social adaptation. The Portuguese Constitution (1976) came after a period of 48 years of authoritarianism and a closed society, in which some happy few enjoyed great privileges while the great majority of people were charged with heavy duties So, by a very understandable "law of human nature", the constituent law givers could not reasonably impose constitutionally many obligations, in an autonomous way. As rights and duties are the twin sides of the same coin, the juridical formulation under the sign of rights also implies obligations, related to those same rights. This is kinder and more pleasant to do by a liberating Constitution...

Onde melhor se pode aquilatar de uma filosofia constitucional? Além do cunho da constitução, que já vimos ser liberal na fórmula política (porque moderna ecodificada) e social na social, cultural e económica, o que mais exprime uma filosofia constitucional é a ética constitucional, e, antes de mais, são os valores. A Constituição cidadão brasileira e a Constituição portuguesa de 1976 comungam, em grande medida, dos meus valores de liberdade, igualdade, justiça, e outros, progressivos e de cidadania.
