The purpose of this qualitative case study was to examine middle school teachers’ perceptions of the influence that restorative practices have on the middle school classroom environment. For the purpose of this study, seven middle school teachers were selected who have implemented restorative practices in their middle school classrooms to provide feedback. Findings suggest that overall restorative practices have a positive influence on the classroom. The findings from this study can be used with teachers, administrators, counselors, parents, and school and district support staff to help create a positive campus culture between students and adults in middle school classrooms. Disparities in discipline are well documented throughout our nation as the gap continues to increase (Losen et al., 2015; Losen & Skiba, 2016; Raush & Skiba, 2004; The Civil Rights Data Collection, 2014). Though Black students comprise only 16% of the student population in the United States, they account for nearly half of school suspensions and expulsions (The Civil Rights Data Collection, 2014). In the context of RHS (location of this dissertation in practice), Black students encompass nearly 20% of the student population while accounting for approximately 30% of the total number of referrals. African American male students are disproportionately represented in special education. The purpose of the current study is to examine the disproportionality of African American male students who are referred to special education programs and are identified special education services, specifically in the areas of Emotional Disturbance (ED), Specific Learning Disability (SLD), and other low incidence disabilities (OTH), which includes Speech & Language Instruction, Other Health Impaired, Autism, and Traumatic Brain Injury, in Northeast Ohio’s suburban school district for the 2017-2020 school year. Studies have examined the effects of school disciplinary policies and practices on Black boys. Much of this research highlights the degree to which many of these disciplinary policies and practices have affected Black boys in P-12 contexts in negative ways. A small and emerging body of scholarship has begun to investigate the effects of school discipline policies and practices in P-12 contexts on Black girls. Despite disability advocacy, case law, and legislative attempts to regulate equity in placement, students of color with disabilities are removed from general education settings at higher rates than peers. Ongoing advocacy to extend legal protections and utilize dispute resolution procedures contributed to special education’s reputation for being litigious. This study included a recent review of literature on landmark education cases and litigation using a symbolic organization framework to analyze special education placement procedures, disputes, and decisions. The disproportionality of dual language learners (DLLs) in special education has been a persistent and complex issue for decades. These students have multidimensional identities that require a look at how they are positioned in school systems and the broader social landscape. Using a multilevel model of intersectionality and an explanatory mixed methods design, this study examines how social categories, practice, and policies influence the representation of DLLs in special education in Virginia, a state where DLLs represented 13 percent of the total student population in 2018-19. This study explored the role of federal policy in improving school climate, and examined how federal policy, specifically the Every Student Succeeds Act (ESSA) is being implemented at the state-level to address school climate issues. A qualitative multiple-case study design with content analysis was used as the leading approach to understanding how states are implementing ESSA’s school climate measure for accountability. ESSA is the nation’s federal education law that was enacted in 2015 and replaced No Child Left Behind (NCLB). This study utilized relative risk ratios to examine the representation of English language learners in special education programs in elementary, middle, and high school campuses in a school district in South Texas. Results indicated that English language learners were both underrepresented and overrepresented in the school district. Furthermore, underrepresentation was greater at the elementary campuses and overrepresentation was greater at the secondary campuses. When special education eligibility is being determined under Specific Learning Disability, the exclusionary clause needs to be carefully considered. The current study was concerned with the exclusions of cultural factors, environmental or economic disadvantage, and limited English proficiency. The study used a semi-structured interview to explore when and how the exclusionary clause is considered by school psychologists in Virginia and what type of impact it has on eligibility decisions. Students of color and those with disabilities have been disproportionally identified, placed, and disciplined in education. As a result, IDEA 2004 requires states to have policies and procedures in effect to prevent and reduce disproportionate representation by race and ethnicity in the areas of identification, discipline, and placement of children with disabilities. Despite the policies, black students are still 1) suspended or expelled at a rate two-to-three times higher than white students; 2) 2.8 times more likely to be identified as having a high-incidence disability; 3) more likely to be placed in a more restrictive environment. Disproportionality in special education and school discipline in the U.S. Education system has been a crucial and complex issue. Research has shown that evidence-based interventions that lie within the positive behavioral interventions and supports (PBIS) framework has been effective in improving educational outcomes for all students. In this study, the author investigated the impact of the School-Wide Benchmarks of Quality, a PBIS fidelity measure, on student disciplinary outcomes. 380 schools presented four years of disciplinary outcome data. Results showed that the PBIS fidelity measure had a modest effect on the overall student disciplinary outcomes but did not address the disproportionate …

African American students are being re-segregated in today's public schools by their disproportionate placement in special education classes for the disabled pursuant to the Individuals With Disabilities in Education Act (IDEA). At the same time, the overall number of children found disabled and entitled to special education under the Act has skyrocketed over the past decade, leaving special education classes with swollen roles and inadequate resources. Congress attempts to remedy this divisive dual eligibility crisis when it re-authorized the IDEA in 2004 by promoting an educational paradigm of individualized instruction in general education.
