Family Security Insurance: A New Foundation For Economic Security, Workplace Flexibility 2010, Georgetown University Law Center, Berkeley Center On Health, Economic & Family Security, Uc Berkeley School Of Law
Published Reports
A report released by Georgetown Law's Workplace Flexibility 2010 and the Berkeley Center on Health, Economic & Family Security (Berkeley CHEFS) outlining a blueprint for establishing and financing a new national insurance program to provide wage replacement for time off for health and caregiving needs. The report describes the need among working Americans for time off from work to address personal illness, to care for a new child, or to care for a loved one with a serious illness. It argues that the need for time off is no longer an issue for individual families or select industries, but a …
Developing A Culturally Responsive Classroom Collaborative Of Faculty, Students, And Institution, Paul J. Colbert
Developing A Culturally Responsive Classroom Collaborative Of Faculty, Students, And Institution, Paul J. Colbert
MBA Faculty Conference Papers & Journal Articles
Culture is integral to the learning process. It is the organization and way of life within the community of students and teachers and directs the way they communicate, interact, and approach teaching and learning. Although founded in particular values and principles, the academy, like most organizations, is impacted day-to-day by its culture. Yet, the traditional higher education institution has not been designed to operate within a racially or ethnically diverse student population. The social, political, economic, and cultural forces that support the institution influence the teaching and learning environments. To better address cultural diversity in the classroom, faculty must first …

Labor And Media: A Strained Relationship, Mac-Z Zurawski
Labor And Media: A Strained Relationship, Mac-Z Zurawski
All Student Theses and Dissertations
The labor movement or union community of America has been in a steady decline for more than a decade. The 1950s saw the pinnacle of success with one-third of the U.S. workforce being unionized. Today only 8% of the private workforce is unionized. One way in which this decline may be perceived as more pronounced is through media alienation. According to journalists across the nation such as Philip M.Dine unions have been alienated by media and its type of union coverage. In this study, I analyze the way in which the New York Times portrays the labor movement during the …

Nation, Corporation Or Family? Tribal Casino Employment And The Transformation Of Tribes, Theodor Gordon
Occasional Papers
Since its modest beginnings in the early 1980s, tribal gaming rapidly developed into a $25 billion industry that generates over a quarter million jobs. However, the increasing employment of non-Indians in tribal casinos prompts new cultural and political challenges. This paper analyzes tribal and commercial casino trade publications in order to demonstrate how tribal casino employee relations play a significant role in transforming public policy and perceptions of tribal government in the United States.
Who Cares? The Role Of Job Involvement In Psychological Contract Violation, Jason S. Stoner, Vickie C. Gallagher
Who Cares? The Role Of Job Involvement In Psychological Contract Violation, Jason S. Stoner, Vickie C. Gallagher
Business Faculty Publications
This study examined survey data from full-time employees employed in a variety of occupations. We empirically examined how psychological involvement with one’s job affects reactions to psychological contract violation. Data for control variables (i.e., age, gender, organizational tenure), the independent variable (i.e., psychological contract violation), and the moderator (i.e., job involvement) were taken at Time 1; and dependent variables (i.e., depressed mood at work, turnover intention) were taken at Time 2. Results illustrated that job involvement was an important construct in understanding individuals’ negative reactions to psychological contract violations. Implications and limitations are discussed, and suggestions for future research are …
Benevolent Vs. Hostile Sexism Impact On Work Performance For Women In Turkey, Crystal M. Bonneau-Kaya
Benevolent Vs. Hostile Sexism Impact On Work Performance For Women In Turkey, Crystal M. Bonneau-Kaya
Masters Theses & Specialist Projects
All studies to date that have assessed the direct impact of benevolent vs. hostile sexism on performance outcomes have done so in the context of a Western society. Because of this void in the literature, it remained unknown how living in a low egalitarian and/or non-Western society may impact women's experiences of sexism. The purpose of this study is to address this gap in the literature. This study investigates the impact of benevolent vs. hostile sexism on women in four Turkish textile factories. 210 Turkish female textile factory workers were randomly assigned to the benevolent sexism, hostile sexism, or control …
Work Support, Work-Family Enrichment, Work Demand And Work Well-Being Among Chinese Employees : A Study Of Mediating And Moderating Processes, Shuwen Tang
Lingnan Theses
Work and family are the central and salient domains in one’s life. Juggling work and family life has become a challenge for many employees and families (Hammer et al., 2005). This study proposed a theoretical model in which work to family enrichment functioned as the mediator between work support (support from supervisor, co-workers and organization) and work well-being (job satisfaction and psychological health), and also examined whether work demand buffered the impact of work support on work well-being. The inclusion of work to family enrichment extends prior research on Job Demands – Resources model (Demerouti & Bakker, 2007), and allows …

Early Retirement Incentive Plans And The Age Discrimination In Employment Act, Workplace Flexibility 2010, Georgetown University Law Center
Early Retirement Incentive Plans And The Age Discrimination In Employment Act, Workplace Flexibility 2010, Georgetown University Law Center
Memos and Fact Sheets
Early retirement incentive plans (ERIP) “seek to give incentives to older employees to retire before conventional retirement age. The purpose of these programs is to cut back on salaries and benefits to make way for younger workers.” While some ERIPs might constitute a prohibited act under the Age Discrimination in Employment Act (ADEA), the statute provides an affirmative defense for employers who can prove that the plan is voluntary and “consistent with the purposes” of the Act.
Some commentators have suggested that one way to encourage employers to establish bona fide phased retirement programs within their qualified pension plans is …
Benefits, Rights And Features Nondiscrimination Testing And Phased Retirement Programs, Workplace Flexibility 2010, Georgetown University Law Center
Benefits, Rights And Features Nondiscrimination Testing And Phased Retirement Programs, Workplace Flexibility 2010, Georgetown University Law Center
Memos and Fact Sheets
Various studies indicate that formal phased retirement programs within defined benefit plans are wanted and needed by both employers and employees. Phased retirement programs may be useful for employees who want to reduce their hours during later stages of their careers, but who wish to remain in the workforce. For employers, a phased retirement program may be a useful tool to retain talented employees who may otherwise fully retire.
In designing phased retirement programs, It is not surprising that many employers wish to have significant discretion in deciding which employees they will seek to retain through a phased retirement program. …

Faqs About Employees And Employee Benefits, Pamela Perun
Faqs About Employees And Employee Benefits, Pamela Perun
Memos and Fact Sheets
This primer is an introduction to the basic laws of employee benefits. It is often assumed that there are legal impediments to employers providing benefits to phased retirees, part-time workers and the contingent workforce. From a benefits law perspective, this is really not true. By statute, self-employed workers are sometimes excluded from plans required to be employee-only but employers face few other prohibitions when designing their plans.
From an employer’s perspective, there are far more impediments to excluding these workers from their benefit plans than including them. Tax law provides incentives to employers who sponsor plans and to workers who …

Legal And Research Summary Sheet: Phased Retirement, Chantel Sheaks J.D., Marcie Pitt-Catsouphes Phd, Michael A. Smyer Phd
Memos and Fact Sheets
During the first decade of the 21st century, significant attention has been paid to the widely anticipated retirement of the Baby Boom generation from the U.S. workforce. Employers and policymakers have considered important questions such as:
- What percentage of older workers are likely to retire on a full-time basis between the ages of 62-65?
- What might the implications of a “mass exodus” of Baby Boomers mean for different types of businesses?
- Which types of policies and practices might encourage some older workers to extend their labor force participation, thereby enabling employers to retain the knowledge and skills of these experienced …

A "flexible work arrangement" (FWA) is any one of a spectrum of work structures that alters the time and/or place that work gets done on a regular basis. The term includes (but is not limited to):
1. flexibility in the scheduling of hours worked, such as alternative work schedules (e.g., flex time and compressed workweeks), and arrangements regarding shift and breack schedules:
2. flexibility in the amount of hours worked, such as part-time work and job shares; and
3. flexibility in the place of work, such as working at home or at a satellite location.
Labor Cost Effects On Apple Price, Victor Cancel
Labor Cost Effects On Apple Price, Victor Cancel
Agribusiness
Agriculture is an essential part of life in the United States due to the fact that everyone needs to eat. And, being that many commodities within agriculture, such as apples, are very labor intensive, the people that work in the industry are also very important. But while these laborers, many of who are legal or illegal immigrants from Mexico, are important to supplying Americans with food, many are compensated at a wage at or around the amount required by federal law. Since the apple industry is so labor intensive, discussions have been raised about how much the cost of labor …

The summit tied issues of employment opportunities, job readiness and economic trends with the need to invest …
The Utility Of Trouble: Leveling The Playing Field: Giving Municipal Officials The Tools To Moderate Health Insurance Costs, Robert L. Carey
The Utility Of Trouble: Leveling The Playing Field: Giving Municipal Officials The Tools To Moderate Health Insurance Costs, Robert L. Carey
Edward J. Collins Center for Public Management Publications
According to the research, Boston could have reduced its 2010 health premiums by between 15.6 and 17.1 percent, for a savings of between $41.4 and $45.4 million by joining the state’s Group Insurance Commission, more widely known as the GIC. The City is unable to join the GIC, however, without first receiving 70% union approval, according to state law. This requirement and the associated tradeoffs involved are a major barrier to municipal participation in the GIC. Several cities and towns including Boston have called for cities and towns to have the same ability as the state to design health insurance …

Justice Sonia Sotomayor And The Relationship Between Leagues And Players: Insights And Implications, Michael Mccann
Law Faculty Scholarship
This Essay examines U.S. Supreme Court Justice Sonia Sotomayor’s important role in shaping U.S. sports law. As a judge on the U.S. District Court for the Southern District of New York and later on the U.S. Court of Appeals for the Second Circuit, Sotomayor authored opinions that resolved two major sports law disputes: whether Major League Baseball (“MLB”) owners could unilaterally impose new labor conditions on MLB players during the 1994 baseball strike and whether Ohio State University sophomore Maurice Clarett was obligated to wait three years from the completion of high school to become eligible for the National Football …
Participation In The Workplace: Are Employees Special?, Jeffrey Moriarty
Participation In The Workplace: Are Employees Special?, Jeffrey Moriarty
Philosophy Faculty Publications
I consider two influential arguments for employee participation in firm decision making: what I call the “interest protection argument” and the “autonomy argument.” I argue that the case for granting participation rights to some other stakeholders, such as suppliers and community members, is at least as strong, according to the reasons given in these arguments, as the case for granting them to certain employees. I then consider how proponents of these arguments might modify their arguments, or views, in response to this conclusion.
Saving America's Automobile Industry: The Bailouts Of 1979 And 2009, An Overview Of The Economic Conditions, Factors For Failure, Government Interventions And Public Reactions, Taylor A. Wall
CMC Senior Theses
This paper will discuss the bankruptcies experienced by U.S. automakers in both 1979 and 2009. The main factors which led the automakers into financial ruin was the uncontrolled power of labor unions, the severe financial impact of oil embargos, the aggressive imposition of federal regulations and the increasing dominance of Japanese imports. After discussing these important factors, the paper will describe the specifics of Chrysler’s bailout experience in 1979 with the positive public acceptance of the government loans, largely due to the character of Lee Iacocca. After delving into Chrysler, this paper will explain the specifics of the government’s bailout …

Domesticating The Diaspora: Memory And The Life Of Sister Katie, Caroline Waldron Merithew
History Faculty Publications
Three shrines in Illinois honor heroes of the working class: one for the legendary Mother Jones; one for the Virden martyrs, who died for coal mining unionism, and whose memory is kept alive by labor organizers around the world; and one for Catherine (Katie) Bianco DeRorre. Katie's monument, unlike the others, draws few visitors today. But when it was dedicated in 1961, men and women — on the floor of the U.S. Congress, in the neighborhood where Katie grew up, at American universities, in union halls, on the streets of New York City, and in Milan — took notice and …
An Exploration Of The Perceptions Of Flexible Work Arrangements (Fwas) And Factors Affecting Their Uptake At A Tertiary Education Institution In Australia, Fleur Sharafizad
An Exploration Of The Perceptions Of Flexible Work Arrangements (Fwas) And Factors Affecting Their Uptake At A Tertiary Education Institution In Australia, Fleur Sharafizad
Theses : Honours
Flexible work arrangements (FW As) have become an area of considerable interest. The reason for this increased interest is that flexibility has been found to offer organisations a competitive advantage and helps in attracting and retaining high quality employees (Carlson, Grzywacz & Kacmar, 2010, p. 330). FWAs do not only offer employees the opportunity to create a better work-life balance (WLB) their uptake has also been linked to increased organisational commitment, morale and job satisfaction. Work-life conflict, on the other hand, has been linked to negative individual, as well as organisational consequences. Research has, however, identified gaps between the FW …
Earnings Of Nurses In Non-Nursing Occupations: Evidence Of Significant Nursing Dissatisfaction?, Stephen D. Rubb
Earnings Of Nurses In Non-Nursing Occupations: Evidence Of Significant Nursing Dissatisfaction?, Stephen D. Rubb
WCBT Faculty Publications
In examining the nursing shortage, many scholars note the high correlation between job dissatisfaction and "intentions" to leave. This study compares the earnings of individuals with nurse training in non-nursing occupations to those in nursing occupations. Nurses exiting the occupation while remaining employed appear to occur if alternative occupations pay a premium. This premium is higher for males and increases with education. Earnings of nurses in non-nursing occupations do not provide evidence of significant nursing dissatisfaction.
