This Article proceeds as follows. Part I presents doctrinal background. It discusses the laws governing tip-pooling, with an emphasis on relevant federal and state laws. Part II analyzes, from a law-and-economics perspective, how tip-pooling arrangements—both voluntary and mandatory—might arise, and what form they might take. Part III shows how governing law limits the ability of restaurateurs to put tip-pooling arrangements in place, and shapes the incentives of employees. It also analyzes the response of restaurants like the Union Square Hospitality Group that have barred all tipping. Casino Gaming From A Border State Perspective: Impact On The Hospitality Industry, Claire D. Schmelzer, Damon Revelas, Desmond O. Brown

Stakeholders of the hospitality industry, defined as owners and managers of hotels and restaurants, from a state contiguous to states where casino gaming is legalized were questioned regarding their attitudes toward the legalization of casino gaming and their perceptions of its impact on business currently and if gaming were legalized in the state. The data were analyzed using frequency distributions, cross tabulations, and Chi Square statistics. Results included the following: Opinions about legalizing gaming in the state were evenly divided between favor and disfavor. [Excerpt] "The need for a strict statutory scheme prohibiting or effectively segregating tobacco smoke in restaurants and public buildings in New Hampshire is compelling. One evening, during the summer of 2003, I took my wife and daughter to a restaurant in New Hampshire for dinner. When the time came to be seated, the waiter asked if we preferred to be seated in the smoking or non-smoking section. At our request, he led us to the non- smoking section.
