Anticompetitive Patent Settlements And The Supreme Court's Actavis Decision, Herbert J. Hovenkamp

In FTC v. Actavis the Supreme Court held that settlement of a patent infringement suit in which the patentee of a branded pharmaceutical drug pays a generic infringer to stay out of the market may be illegal under the antitrust laws. Justice Breyer's majority opinion was surprisingly broad, in two critical senses. First, he spoke with a generality that reached far beyond the pharmaceutical generic drug disputes that have provoked numerous pay-for-delay settlements.
Second was the aggressive approach that the Court chose. The obvious alternatives were the rule that prevailed in most Circuits, that any settlement is immune from antitrust …

The purpose of the current study is to understand consumers’ behavioral intentions in situations involving both positive and negative potential impacts on the environment. The case of energy efficient Compact Fluorescent Lamps (CFLs) with their potential for mercury pollution is an example of this type of trade-off. Past studies have confirmed the usefulness of the Theory of Reasoned Action for identifying the antecedents influencing recycling rates, however, none have looked at situations where conflicting environmental trade-offs were involved. Stepwise regression analysis was used to develop a core model which explains R2=.561 of the intention to recycle. Significant antecedents include the …

The worldwide dominance of Western nations in commercial knowledge-intensive services has declined between 1995 and 2010, but the slippage in revenue was only from 88 to 79 percent. The European Union and North America remain the two largest regions in consumption and in exporting. Four professional service sectors—accounting, law, engineering, and management consultancy—have shown stability or even growth in the past decade. Entry and expansion requirements in these fields, at home and abroad, constitute barriers for both individual professionals and companies. Entrepreneurship is evident in these sectors, as small and medium size enterprises have maintained their viability against large firms. …

Warwick Junction, a thriving trading hub in the inner city of Durban, has long been considered one of the best examples of collaborative urban management practices between the local government and informal traders. In a post-apartheid South Africa, there was a national desire to transform the old systems of governance, which in Warwick translated to city government institutions making an effort to include informal traders in the policymaking and management processes. Activating Actavis, Aaron Edlin, C. Scott Hemphill, Herbert J. Hovenkamp, Carl Shapiro

In Federal Trade Commission v. Actavis, Inc., the Supreme Court provided fundamental guidance about how courts should handle antitrust challenges to reverse payment patent settlements. The Court came down strongly in favor of an antitrust solution to the problem, concluding that “an antitrust action is likely to prove more feasible administratively than the Eleventh Circuit believed.” At the same time, Justice Breyer’s majority opinion acknowledged that the Court did not answer every relevant question. The opinion closed by “leav[ing] to the lower courts the structuring of the present rule-of-reason antitrust litigation.”

This study focuses on the supplemented strategies of microfinance institutions (MFIs), in which the MFI offers nonfinancial services, such as entrepreneurship related knowledge, in addition to financial services to impoverished borrowers at the bottom of the pyramid (BoP). We examine two contextual factors–foreign direct investment (FDI) and loan defaults–to better understand the relationship between providing knowledge support to encourage entrepreneurship and costs of operating at the BoP for MFIs. In contexts where FDI is low and loan defaults are high, providing knowledge support to encourage entrepreneurship aggravates the MFI's costs of operating at the BoP. However, in contexts where FDI …

What Do Accelerators Do? Insights From Incubators And Angels, Susan L. Cohen

What do accelerators do? Broadly speaking, they help ventures define and build their initial products, identify promising customer segments, and secure resources, including capital and employees. More specifically, accelerator programs are programs of limited-duration—lasting about three months—that help cohorts of startups with the new venture process. They usually provide a small amount of seed capital, plus working space. They also offer a plethora of networking opportunities, with both peer ventures and mentors, who might be successful entrepreneurs, program graduates, venture capitalists, angel investors, or even corporate executives. Finally, most programs end with a grand event, a “demo day” where ventures …

Exploring Family Features In Non-Family Organizations: The Family Metaphor And Its Behavioral Manifestations, Nava Michael-Tsabari, Wee Liang Tan

In this study, we explore the possibility of reproducing family business characteristics in the professional context of a non-family organization and analyze the behavioral manifestations of this application. Drawing upon discussions in the family therapy, organizational behavior and family business literatures, we identify cohesion and flexibility as the two primary dimensions of the family metaphor. We build on illustrative cases of three sports teams to explore these dimensions in a non-family business setting. Our exploratory analysis of these cases reveals the existence of family features and extends our understanding of these features beyond family businesses.

The 32 fellows in the 2013 Emerging Leaders Program (ELP) worked with community partners to investigate the theme, “Engaging and Expanding Communities".
They worked with six community partners, and identified ways to help them expand beyond their core stakeholders to a wider circle of stakeholders and broader potential impact. The fellows gave their time and professional skills to understand how to reach new business partners, new participants, new advisors, and new donors. Regulatory Focus Theory predicts that the motivation to self-regulate goal-directed thought and behavior depends on two distinct regulation strategies: a promotion focus based on attaining gains and a prevention focus based on avoiding losses.
This study took a social-cognitive approach predicting that regulatory focus has an impact on how family startups (several family related founders) explore “new ideas”, exploit “old certainties” and achieve the balance of both (ambidexterity), compared to lone founder startups (only one founder present).

The event itself was designed to benefit the Dana-Farber Cancer Institute and the Jimmy Fund. In the early stages of the project, it was clear that a charity event would have the largest impact both on our experiential learning as well as the community as a whole. Dana-Farber was selected as the events beneficiary due to their impressive contributions to cancer research worldwide. This is a major issue for our students as they leave our universities and our subscription resources and move on to become practitioners of their field. Social entrepreneurship evades easy definition and conceptualization. In this paper we attempt to advance social entrepreneurship theoretically by examining it conceptually, from a theory of the firm perspective. If social entrepreneurship entails pursuit of a double bottom line (Dees 1998), the added complexity of the social entrepreneurial venture identified by Tracey and Phillips (2007) should be discoverable from a theory of the firm perspective. Applying the knowledge-based theory of the firm to social entrepreneurship, we aver that social entrepreneurship’s added complexity is manifest when social entrepreneurs make decisions about their knowledge.
