Oer Textbook Review For Business Law - (1) Business Law And The Legal Environment - (2) Law For Entrepreneurs, Liz Brown Jd

Open Educational Resources Publications

Liz Brown, Professor of Law at Bentley University, evaluates two OER textbooks: "Business Law and the Legal Environment" and "Law for Entrepreneurs," both published by Saylor.org in 2012. While praising their clarity and accessible language, the review highlights significant limitations due to outdated content, lack of comprehensiveness, and cultural relevance. Key issues include the absence of current legal developments, such as topics like privacy and AI, and the omission of critical topics like start-up funding mechanisms in the entrepreneurship text. Despite these shortcomings, the textbooks are suggested as potential basic outlines for their subjects, though requiring substantial supplementation with current …

Locum Tenens Dentists: You May Need One, Or You May Be One, Angie Kanazeh

The Journal of the Michigan Dental Association

Locum tenens dentists temporarily fulfill the duties of an absent or short-staffed dentist. This practice is beneficial for both hiring dentists and those serving as locum tenens. For hiring dentists, considerations include ensuring the locum tenens dentist is properly licensed, credentialed with insurance networks, and adequately insured. For locum tenens dentists, benefits include flexible schedules, diverse experiences, networking opportunities, and potential higher earnings. Both parties should have clear agreements and consult with healthcare attorneys. The demand for locum tenens dentists is growing, offering valuable support in the dental community.

Bunching In Real-Estate Markets: Regulated Building Heights In New York City, Jan K. Brueckner, David Leather, Michael Zerecero Jul 2024

Bunching In Real-Estate Markets: Regulated Building Heights In New York City, Jan K. Brueckner, David Leather, Michael Zerecero

Business Faculty Articles and Research

This paper presents a real-estate application of the bunching methodology widely used in other areas of applied microeconomics. The focus is on regulated building heights in New York City, where developers can exceed a parcel’s regulated height by incurring additional costs. Using the bunching methodology, we estimate the magnitude of these extra costs, with the results showing a modest increase in the marginal cost of floor space beyond the regulated building height. We use these estimates to predict the additional floor space that would be created by complete removal of building-height regulation in NYC. While this last exercise is circumscribed …

Building Responsible And Sustainable Supply Chain Frameworks: Limits Of International Investment Law And The Csr Initiatives Taken By The Eu And China, Stefanie Schacherer

Research Collection Yong Pung How School Of Law

Supply chains play a pivotal role in global economic relations, fostering growth, employment, and poverty alleviation. Multinational enterprises (MNEs) are central actors in these chains, bearing responsibilities towards workers and the environment. Corporate Social Responsibility (CSR) standards guide MNEs in assessing the societal and environmental impacts of their activities, though these standards remain largely voluntary. Recent investment treaty practice shows a trend to incorporate CSR provisions in international investment agreements (IIAs), but such clauses fail to impose direct human rights, labour and environmental obligations on investors. Amidst this landscape, the EU and China, major players in global trade and investment, …

This research analyzes the effect of the exclusive contracts of the merged Ticketmaster-Live Nation entity on competition in the ticketing industry through the lens of prominent antitrust scholars. Previous literature reveals differing ideas about whether exclusive contracts are an exclusionary practice and literature identifies the …

The Business Judgment Rule In Stakeholder Capitalism, Thiago Spercel May 2024

The Business Judgment Rule In Stakeholder Capitalism, Thiago Spercel

Northwestern Journal of International Law & Business

The tension between shareholder primacy and stakeholder capitalism embodies a fundamental debate about the purpose of a corporation. These two perspectives offer contrasting views on whether a company should primarily serve the interests of its shareholders or consider the broader spectrum of stakeholders in its decision-making process, taking into account environmental, social and governance factors alongside financial performance. The Dodd-Berle debate from the 1930s and Milton Friedman’s teachings in the 1970s regarding the purpose of a corporation and the tension between shareholder primacy and stakeholderism have been reinvigorated. On the one hand, ESG considerations have become increasingly important in risk …

Less Litigation, More Business Purpose: Leveraging Dispute Prevention To Preserve Business Relationships, Joan Stearns Johnsen

UF Law Faculty Publications

Strong interorganizational relationships play an essential role in business relationships. Soft skills associated with negotiation and communication are key to dealing with disagreements in these relationships. However, many companies do not invest in these aspects of their business relationships until conflicts arise. Dispute resolution provides helpful processes for managing these disputes, but companies can avoid conflict before it arises by investing in dispute prevention.

Dispute prevention represents a change in the existing paradigm, yet it poses numerous benefits. By implementing a dispute prevention mechanism, such as a Standing Neutral, companies can invest in strong interorganizational relationships and improve their ability …

Intellectual Property Rights: Examining Outdated Laws, Monopolies, Manipulation, And The Need For Modernization, Maggie Moles

Economics Undergraduate Honors Theses

This thesis critically examines the shortcomings of current intellectual property (IP) laws in the face of rapid technological advancement and evolving digital landscapes. It argues that while IP laws were intended to incentivize innovation, protect creators' rights, and foster fair competition, they often fall short of these goals in practice. Through an analysis of various case studies and real-world examples, the thesis demonstrates how outdated IP laws can hinder progress, stifle creativity, and impede access to knowledge and resources, particularly in industries heavily reliant on patents and copyrights.

Furthermore, the thesis explores alternative models and proposals for reform, including open …

Confronting Cosmetic Carcinogens: A Proposal Regarding The Dangers Of Talcum Powder, Rachael Howell

Helm's School of Government Conference - 2021-2024

The Federal Government needs to stop the import, export, mining, and distribution of talcum powder in the United States. This is an issue that affects all Americans, especially active-duty military members.

Since 2013, there have been over 38,000 lawsuits against Johnson & Johnson, which allege that their talcum-based baby powder caused cancer. The plaintiffs in the very first talc case in the U.S. have died. All four of the plaintiffs from a 2019 suit have died. Yet, the 2019 case has been reversed and remanded. The FDA has redacted the names of scientist(s) that conduct “safety tests” on talc samples. …
