Social Network usage in hiring practice is a valuable tool for employers to learn more about an applicant than what can be found on a resume or application. Social Network usage is controversial as it can provide a variety of information to an employer that could impact the hiring process. The responsibility falls on the employer to implement a Social Network screening policy to ensure proper usage of this hiring tool. In combination with current legislation and HR professional recommendations, employers have the resources they need to develop a successful Social Network screening policy.

Is 'Equal Pay For Equal Work' Merely A Principle Of Nondiscrimination?, Jeffrey Moriarty

Should people who perform equal work receive equal pay? Most would say ‘yes’, at least insofar as this question is understood to be asking whether employers should be permitted to discriminate against employees on the basis of race or sex. But suppose the employees belong to all of the same traditionally protected groups. Is (what I call) nondiscriminatory unequal pay for equal work wrong? Drawing an analogy with price discrimination, I argue that it is not intrinsically wrong, but it can be deceptive, in which case it is wrong.

Gaming The System: The Exemption Of Professional Sports Teams From The Fair Labor Standards Act, Charlotte S. Alexander, Nathaniel Grow

This article examines a little known exemption to the Fair Labor Standards Act relieving seasonal recreational or amusement employers from their obligation to pay the minimum wage and overtime. After evaluating the existing, confused case law surrounding the exemption, we propose a new, simplified framework for applying the provision. We then apply this framework to a recent wave of FLSA lawsuits brought by cheerleaders, minor league baseball players, and stadium workers against professional sports teams. The article concludes by considering the policy implications of exempting this class of employers from the FLSA's wage and hour requirements.

Perceived Workplace Racial Discrimination And Its Correlates: A Meta-Analysis, María Del Carmen Triana, Mevan Jayasinghe, Jenna R. Pieper

We combine the interactional model of cultural diversity (IMCD) and relative deprivation theory to examine employee outcomes of perceived workplace racial discrimination. Using 79 effect sizes from published and unpublished studies, we meta-analyze the relationships between perceived racial discrimination and several important employee outcomes that have potential implications for organizational performance. In response to calls to examine the context surrounding discrimination, we test whether the severity of these outcomes depends on changes to employment law that reflect increasing societal concern for equality and on the characteristics of those sampled. The Horticulture and Crop Science department had created their own Injury and Illness Prevention Program (IIPP) which was placed online using Cal Poly’s “PolyLearn” module. The program had just been created and generally covered some of the basic IIPP elements required by CalOSHA law, however it had various points of improvement to fulfill all IIPP regulations. If an employee is committed to his firm – if he is “attached” or “bound” to it – then his firm may be able to obtain a discount on his labor. This paper asks: Is it wrong for firms to do so? If we understand just or fair pay solely in terms of voluntary agreements between employers and employees, the answer seems to be ‘no’. Against this, I argue that, in some cases, it is ‘yes’. Many writers argue that a “democratic deficit” is created when private actors such as corporations take on state functions. The problem, it is said, is that the course of public life is being shaped by agents who are not accountable to the public. We evaluate this claim and consider what should be done about it. We focus in particular on a recent attempt, put forward principally by Palazzo and Scherer, to address the democracy deficit by “democratizing” corporations. We examine the issues concerning the legality and ethicalityof the Second Amendment right to bear arms balanced by the employer’s duty to provide a safe workplace for its employees. Two court rulings highlight this balancing act: McDonald et al. v. City of Chicago et al. and District of Columbia v. Heller. “Stand Your Ground” and “Castle Doctrine” laws in the recent Traven Martin shooting on February 26, 2012 are also applicable. The persistent existence of the 'gender pay gap' in organisations, and the lack of females at executive level position in Ireland due to motherhood is the context for this paper. In particular, this study seeks to investigate why women's careers are impacted by childbearing. The study investigates if there is a correlation between taking maternity leave, and women's career progression in the work place. The increasing length of maternity leave benefits and flexible work arrangements results in elongated absence of females from the workplace. The purpose of this exploratory study was to investigate the effects personal social networking sites had on candidate’s opportunities for obtaining employment and how and to what extent hiring managers used this information in the hiring process. Hiring managers across four industries: Retail, Banking, Healthcare and Hospitality were surveyed to learn how they are using social media sites to “screen” potential mid-level (and above) managers for their organizations. This qualitative multiple case study research project examines interpreter use for students who are Deaf in the public school system and juxtaposes it with interpreter use found in the work sector after the school-to-work (STW) transition. Semi-structured interviews with 16 Deafness professionals and 6 study participants who are Deaf, as well as workplace observations yield bits of data which are coded and themed for review. Results confirm that interpreter use is abundant in public schools and scant in the work sector. Business ethicists have written much about ethical issues in employment. Except for a handful of articles on the very high pay of chief executive officers and the very low pay of workers in overseas sweatshops, however, little has been written about the ethics of compensation. This is prima facie strange. Workers care about their pay, and they think about it in normative terms. This article's purpose is to consider whether business ethicists' neglect of the normative aspects of compensation is justified.
