The Global Goals: Bringing Education For Sustainable Development Into U.S. Business Schools, Nancy E. Landrum

Purpose – This paper aims to learn how sustainability and the circular economy were being integrated into the curriculum of a Dutch university and to transfer that knowledge back to a US university business school curriculum. Given the resistance toward integrating sustainability into the US business school curriculum, the Dutch university served as a role model for education for sustainable development.

Design/methodology/approach – This case study used ethnographic methods of participant observation over a four-month residency at the Dutch university.

One of the most written-about and important topics in corporate law is the fiduciary obligations of corporate directors. Increasingly, critics of American capitalism have urged that corporations, and implicitly, corporate directors, act in a more socially responsible fashion and thus eschew the notion that shareholder primacy is the exclusive guide to a director’s fiduciary duty. Under this view, directors must consider the effect of their actions on “stakeholders” other than shareholders and be guided by morality—doing the right thing—when making business judgments.

When directors move away from shareholder primacy, however, decision-making becomes more difficult and problematic. This article analyzes the …

This article considers whether the values contained within the idea of human rights have normative priority over economic values as they are inscribed in shareholder-oriented interpretations of the duty of loyalty in corporate law. While stakeholder theorists have sought to expand the ambit of the fiduciary duty—arguing generally that corporate fiduciary law permits managers to take into account a broad range of stakeholder interests—this article shifts the frame of analysis: It proposes that the range of corporate fiduciary loyalty is constrained by human rights as normative values that are distinct from the strictly economic values that are given primacy in …

Most state rules of substantive law, whether legislative or judicial, ordinarily adjust rights and obligations among local parties with respect to local events. Conventional choice of law methodologies for adjudicating disputes with multistate connections all start from an explicit or implicit assumption of a choice between such locally oriented substantive rules. This article reveals, for the first time, that some state rules of substantive law ordinarily adjust rights and obligations with respect to parties and events connected to more than one state and only occasionally apply to wholly local matters. A “J. Crew Maneuver” is a type of collateral-stripping event that transfers the value of a nearly insolvent company from the lender to the borrower. This concept matters to lenders because it exposes them to significant downside risk through the loss of hundreds of millions of pledged collateral. While credit analysts and debt lawyers have commented on the importance of preserving creditor value ex ante through lender-protective clauses embedded within debt documents, this paper breaks ground on empirically studying the determinants of these protective clauses known as “J. In 1890, Congress passed the Sherman Antitrust Act to protect competition in the marketplace. Federal antitrust law has developed to prevent businesses from exerting unfair power on their employees and customers. Specifically, the Sherman Act prevents competitors from reaching unreasonable agreements amongst themselves and from monopolizing markets. However, not all industries have these protections.

An Examination Of How Environmental, Social, Governance (Esg) Investing Influences A Company's Stock Return, Sam Marty

Undergraduate Honors Thesis Projects

Using a random sample of 184 companies traded on the New York Stock Exchange in 2019, this paper investigates the impact of Environmental, Social, Governance (ESG) investing on a company’s stock return. The results show that ESG investing has a positive and statistically significant impact on a company’s stock return. An increase in one ESG rating leads to an increase between 0.4% and 3.6% in the return of a company’s stock. Additionally, the results show that individual ESG factors are each statistically insignificant. This indicates that the three ESG factors need to be viewed together rather than individually. Having an eviction record “blacklists” tenants from finding future housing. Even renters with mere eviction filings—not eviction orders—on their records face the harsh collateral consequences of eviction. This Note argues that eviction records should be sealed at filing and only released into the public record if a landlord prevails in court. Juvenile record expungement mechanisms in Illinois serve as a model for one way to protect people with eviction records. Recent updates to the Illinois juvenile expungement process provided for the automatic expungement of certain records and strengthened the confidentiality protections of juvenile records. The focus of this paper is to understand how the crisis of tax avoidance strategies is discursively treated, by looking at the representation of corporation tax in two mediated public discourses in the UK and Ireland. Specifically, it examines the coverage of two prominent, agenda-setting morning radio programmes: BBC’s Radio 4 ‘Today’ programme and RTE’s ‘Morning Ireland’. It does so by performing a Critical Discourse Analysis of the coverage of tax controversies of two high-profile global corporations, Google and Apple Inc, in order to demonstrate the embeddedness of ideology within mediated public discourses of the subject.
