Colorado’S Budding Economy: A Comparative Analysis Of Selected Marijuana Tourism Businesses In The Centennial State, Connor D. King

Since the 2014 legalization of recreational marijuana in the state of Colorado, pioneering entrepreneurs have been getting in on the ground level of a fledgling industry—marijuana tourism. Through interviews with six Colorado-based marijuana tourism business owners, this qualitative study identified current challenges and opportunities faced by those who are blazing the trail into this new form of alternative tourism. The results indicate that continued stigmatization of marijuana in society, along with restrictive and changing regulations, pose significant legal and financial challenges. Laws surrounding the possession, use, and distribution of marijuana have undergone many changes for over a century. Political pressures and social prejudices have most often been the cause of these changes, rather than scientific research or rational thinking. As a result, the law has sometimes lagged behind social practice as in the current case in much of the U.S., including Colorado. In such an environment, it often falls on a police officer's definition, interpretation, and reaction to the laws to determine the extent to which certain laws and sanctions are enforced. The purpose for this descriptive multiunit case study was to explore what strategies small business owners used to achieve profitability by the end of the first 5 years of opening their business. The sample comprised 4 small business owners who have been profitable by Year 5 of being in business in Denver, Colorado. · Learning is a key tool for foundations seeking to improve their effectiveness, and they are beginning to use evaluation to learn about and improve their strategies. The Colorado Trust took this a step further and integrated strategic learning into a grant strategy, including supporting learning coaches for 14 of their grantees.

· The strategic learning framework consisted of three steps: systematic data collection, collective interpretation of information, and the use of that interpretation to improve strategies.

We analyze the Colorado district court’s decision in Direct Marketing Association v. Huber – a decision that permanently enjoined Colorado’s "Amazon" law. Had it not been enjoined, the Colorado law would have mandated information reporting by remote e-commerce vendors so that Colorado could levy its sales and use tax on the e-commerce purchases made by Colorado residents. We evaluate the applicability of the Tax (Anti-)Injunction Act and whether the Colorado statute and regulations should be reviewed as a tax or as a regulation.
