Is A Ban On Non-Competes Supported By Empirical Evidence?, Sarah Oh Lam, Thomas Lenard, Scott Wallsten

The U.S. Federal Trade Commission (FTC) has proposed a rule to declare virtually all non-compete agreements unfair methods of competition under Section 5 of the FTC Act and therefore, illegal. However, the empirical literature on non-compete agreements cited by the FTC in its Notice for Proposed Rulemaking (“NPRM”) shows mixed results on earnings, job creation, firm formation, entrepreneurship, training, investment, and firm value. Evidence in other current studies also does not support an economy-wide ban. All entrepreneurs seek favorable legal or regulatory treatment for their businesses. Sometimes this leads an entrepreneur to build a business within a gap in the law—a loophole. In so doing, these “loophole entrepreneurs” may avoid steep regulatory compliance costs that otherwise would beset (or perhaps prohibit) their businesses, thereby gaining advantages over competitors. Despite these benefits, loophole entrepreneurship is fraught with risks. Loopholes, by nature, are fragile, and their contours are often uncertain. Moreover, the stigma of “exploiting a loophole” (which connotes unfairness or deception) can provoke ill will among competitors, policymakers, and the public.

Purpose of this article is to find out whether determinants of women entrepreneurship are different from those of men’s entrepreneurship in general and specifically in Côte d’Ivoire. To do this, we conducted a quasi-experimental analysis using non-parametric and parametric approaches to survey data on a sample of 161 entrepreneurs in Côte d'Ivoire, 113 of whom were women and 48 men. Our survey was designed and conducted to neutralize the socio-demographic and conjunctural differences between men and women entrepreneurship in order to produce matched data. Women entrepreneurs are a rapidly growing demographic. Mentoring is a recurring theme in the literature as a valuable contribution in helping women entrepreneurs succeed. The roles of mentoring as well as the literature of mentoring relationships is presented, followed by a study in which the demand and perceived benefit for mentoring was conducted among women currently engaged or self-identified as aspiring small business owners and entrepreneurs. Training is essential to guide and equip SMEs with the necessary skill sets to adapt to the disruption of the COVID-19 pandemic. The budget limitation urged DKI Jakarta Provincial Government (DJPG) to change their conventional training program for SMEs and arrange an IT-based platform enabling all city entities, including private and non-private sectors, to participate in a coproduction scheme. This article presents a feminist constructivist political economy perspective on the role of women’s enterprise development in modern times. Through establishing women’s enterprise as an aesthetic of good institutions rooted in the microcredit movement of the late twentieth century but with expanded resurgence into the global North in the aftermath of the 2008 financial crisis, I illustrate how female (micro)enterprise programs afforded moral legitimacy to international organizations, NGOs, and later corporations, financial institutions, and states in ways that downplayed individual and systemic empowerment.

The potential impact of social media use on the development of entrepreneurial intention has received little attention. In addressing this gap, research reported herein extends entrepreneurial intention literature by explicitly incorporating social media use. Inquiry investigates development of intention via specific social media factors that influence intention through its antecedents, namely, perceived entrepreneurial desirability and perceived entrepreneurial feasibility. Purpose – Driving economic development at the bottom of the pyramid (BOP) is an enduring global challenge. While the market-based approach places hope on entrepreneurship as a major impetus to drive the underdeveloped economy, the performance of entrepreneurial businesses and their impact on poverty reduction are sometimes below expectations. This paper seeks to examine the factors that may be hindering entrepreneurship within the BOP context. Purpose: In 2023, the New England Journal of Entrepreneurship (NEJE) reached its 25th anniversary.To commemorate this major milestone as well as entrepreneurship’s growth as an academic field, the study employs bibliometric methods to provide key trends and research suggestions for entrepreneurship scholars using all original research published in the journal.

Design/methodology/approach: The authors perform two predominant bibliometric techniques, performance analysis and science mapping, using all 251 articles published by NEJE from1998 to 2022.
