Savvy marketers have long sought to exploit the psychological effects of color to differentiate their brands and create competitive advantage: IBM Blue, Coca- Cola Red, and BP Green. These are not new colors but well-known brand colors. While changes in international trademark law over the past decade paved the way for marketers to seek protection for a color associated with a brand, this case demonstrates some important challenges in defending such trademarks.

Supply Chain Contract Evolution, T. Coltman, K. Bru, N. Perm-Ajchariyawong, T. M. Devinney, G. R. Benito

This paper draws together theories from organisational and neo-institutional literatures to address the evolution of supply chain contracts. Using a longitudinal case study of the Norwegian State Railways, we examine how firms move through the stages in an inter-organisational process of supply chain contract evolution and how they can cooperate to ensure efficiency and equity in their contractual relationship. The findings suggest that inefficient and inequitable initial contracts can occur in part, because of the cognitive shortcomings in human decision-making processes that reveal themselves early in the arrangement before learning and trust building can accumulate. A Practical Solution To The Reference Class Problem, Edward K. Cheng

The "reference class problem" is a serious challenge to the use of statistical evidence that arguably arises every day in wide variety of cases, including toxic torts, property valuation, and even drug smuggling. At its core, it observes that statistical inferences depend critically on how people, events, or things are classified. As there is (purportedly) no principle for privileging certain categories over others, statistics become manipulable, undermining the very objectivity and certainty that make statistical evidence valuable and attractive to legal actors. A large share of America's population, businesses and economic activity now occurs in coastal areas. At the same time, during this century many coastal communities are likely to be severely impacted by sea level rise and increased storm surge and tidal flooding.

“What to do” about this vulnerability is the subject of this brief. It is intended to help municipalities identify courses of action and steps they might take toward increasing their resilience, especially regarding financial resources that will need to be allocated toward the various strategies identified.

Most companies listed on the S&P 500 index have reported smoothed earnings since the 1990s inspiring questions from regulators about the accuracy of financial statements. In 1998, the Financial Accounting Standards Board issued SFAS No. 133 (Accounting for Derivative Instruments and Hedging Activities) to establish accounting and reporting standards for derivative instruments. In 2002, the Sarbanes-Oxley Act (SOX) was issued to eradicate earnings management activities and improve transparency in financial reporting. Knowledge management has been extensively studied from the single organization (intra-organizational) perspective for many years. Although the literature on intra-organizational knowledge is extensive, there still exist gaps in the literature with regards to knowledge being shared by multiple organizations (inter-organizational knowledge). Inter-organizational knowledge satisfaction is gained when the organizations successfully embody the knowledge gained via the cooperation and crystallizes that knowledge within the organization.
