This Comment will illustrate one of the many tensions occurring at the fault line of intersection between intellectual property law and antitrust law. This tension derives from the presumption of market power as it has been applied by the courts to the ownership of property protected by intellectual property law. The area where the effects of this presumption are the most apparent is in antitrust litigation involving "tied" products. A policy that recognizes the differences between intellectual property and other forms of property as they pertain to antitrust law and competitiveness is needed. Block, Beck and Kruger present detailed examples from the testimony given during the Commission on the Future of Worker-Management Relations (commonly called the Dunlop Commission) national and regional hearings. The Commission, by hearing from a wide range of stakeholders, sought to define the state of industrial relations and labor law in the U.S. during the 1990s. Because the Commission's final reports were concerned with policy matters, they only briefly summarized the testimony. This volume draws deeply from the testimony, citing many examples that clearly illustrate the wide variety of relationships between workers and management today. In addition, it shows how …

This article examines the existing regulations of the municipal securities market, focusing on what activities prompted the regulatory changes and analyzing the direction and efficacy of these regulations in terms of the deficiencies in the market. Part One gives a background sketch of the market and its participants from the time of the New York City fiscal crises to today. Part Two discusses whether the existing regulation is sufficient to produce disclosure, focusing on the Orange County crises. Part Three offers a critique of the current regulatory scheme and makes some suggestions for reform.

Global financial markets trade about $1 trillion of securities each day. Investors in these markets seek the highest returns by shiffing huge amounts of capital from nation to nation, "playing global monopoly... and deciding which governments deserve to 'Pass Go' and collect $200 billion dollars and which should go directly to jail and be starved of the capital to raise living standards." International competition for capital gives global investors tremendous leverage over developing nations' economic policies.

Controlling costs in the acquisition of new defense systems is a major challenge in today's environment of declining budgets and rapidly changing technology. One of the challenges faced by program managers and cost analysts is selecting the most appropriate Estimate at Completion (EAC) method for their program. This study compares the performance of the popular index-based EAC methods with several newer nonlinear, regression based EAC methods to determine whether the complex nonlinear methods perform better than the simpler index-based methods. With ongoing public scrutiny of defense system acquisitions, due to numerous program failures resulting from cost and schedule overruns, now, more than ever, cost and schedule-management competencies are critical to program success. This research examined the schedule-management competencies required of defense program managers. A schedule-management competency model was developed from a foundation of past research. The model was evaluated through a mail survey of 484 intermediate and senior level military program managers assigned to Air Force Materiel Command. The results provided by 243 respondents indicate that 25 of the 28 competencies in the model were valuable to program managers and …

Teaching Ethics In Schools Of Business In Oklahoma Colleges And Universities, Shelsea Ellis

The research in this study seeks to establish the degree to which ethics is included in the business curriculum of four-year colleges and universities in Oklahoma. If ethics is taught as a separate course, the study inquires about the methodology used in that course. If there is not a separate ethics course, the study determines if ethics is included in several courses of the business curriculum. Clarification is also determined as to the percentage of time dedicated to the teaching of ethics and whether or not the dean of the School of Business believes this percentage to be appropriate.

As outlined by Wolfson, laws give the perception of protecting farm animals but, in reality, provide little or no protection. Federal law fails to provide any protection to farm animals on the farm. Moreover, while many state cruelty laws still cover farm animals in theory, they are rarely if ever applied. And most disconcerting is the trend of farm animals being increasingly excluded from the reach of state cruelty laws.

This Article analyzes the Investment Law and its prospects for encouraging foreign businesses to invest in Gaza and the West Bank (collectively, "Palestinian Territories"). A brief analysis of the importance of foreign private investment to the peace process between Israel and the Palestinian Liberation Organization, and the progress made towards attracting such investment in Gaza and the West Bank since the September 1993 signing of the Declaration of Principles on Interim Self-Government Arrangements, serves as a prelude to a detailed examination of the text of the Investment Law. The authors identify and analyze the strategies for change and techniques most often used in today's labor negotiations. Nearly gone, they say, is the traditional "arms length" approach used by negotiators in the past. Instead, modern collective bargaining is characterized mainly by divergent strategies the authors characterize as either "forcing" (highly contentious) or "fostering" (highly cooperative). A dozen detailed case studies from a variety of industries are presented that show when, why and how these strategies are used, by whom, and to what result.
