An Examination Of South Carolina’S Institutions Of Reform And Their Impact On The Self-Narratives Of African American Men, Ashley E. Krejci-Shaw

In the State of South Carolina (SC), African American male adolescents disproportionately face disciplinary action in public schools and other institutions. In 2013, South Carolina’s Department of Juvenile Justice (SCDJJ) released data that listed Black male children comprising 57% of all juvenile referrals in the state. This disproportionate trend is also present in South Carolina’s correctional system. In 2013, South Carolina’s Department of Corrections (SCDOC) reported that out of 20,777 male prisoners, 13,631 were Black. For adolescents or young adults looking to continue their education, alternative programs are available. One program that captures educationally displaced children in South Carolina is …

Judgment Day For Fraud-On-The-Market: Reflections On Amgen And The Second Coming Of Halliburton, Donald C. Langevoort

The Supreme Court has reaffirmed the "fraud on the market" presumption of reliance, facilitating large scale class actions for this kind of securities fraud. This essay traces the road from its decision last year in Amgen to this year's reaffirmation in Halliburton II, and considers some of the issues that will emerge as lower courts struggle with Halliburton II's secondary holding--that the issue of "price impact" is crucial to class certification, even if the burden of proof is on the defendants.

The majority of the United States health care fraud has been focused on the major public program, Medicare. The yearly financial loss from Medicare fraud has been estimated at about $54 billion. The purpose of this research study was to explore the current state of Medicare fraud in the United States, identify current policies and laws that foster Medicare fraud, and determine the financial impact of Medicare fraud. The methodology for this study was a literature review. Research was conducted using a scholarly online database search and government Web sites. This paper reviews the various methods of information and communications technology (ICT) that is used by employers to peer into the work lives and, in some cases, private lives of employees. Some of the most common methods – such as computer and Internet monitoring, video surveillance, and global positioning systems (GPS) – have resulted in employee disciplines that have been challenged in courts. Disaster management and humanitarian aid organizations have had to reevaluate how communities and individuals can better adapt and prepare for future disaster events. One concept organizations are incorporating into their overall framework is strengthening community resilience. Increasing a community’s resilience level increases its ability to cope with the changes that affect it. Creating awareness of the vulnerabilities in an area, addressing these vulnerabilities with preparedness training, disaster risk reduction (DRR), and sustainable changes made over the long-term can develop a community’s adaptive capacity to be more resilient.

The Joint Capabilities Integration and Development System (JCIDS) is 10 years old and ripe for review. A central output document of the JCIDS process is an Initial Capabilities Document (ICD) used by the Department of Defense to define gaps in a functional capability area and define new capabilities required. The research team analyzed 10 years of ICDs to identify methods and trends. The team found that several methodologies were favored and a convergence emerged in format and necessary content. Discretion is an important feature of all contractual relationships. In this Article, we rely on incomplete contract theory to motivate our study of discretion, with particular attention to fiduciary relationships. We make two contributions to the substantial literature on fiduciary law. First, we describe the role of fiduciary law as “boundary enforcement,” and we urge courts to honor the appropriate exercise of discretion by fiduciaries, even when the beneficiary or the judge might perceive a preferable action after the fact. Second, we answer the question, how should a court define the boundaries of fiduciary discretion? We observe that courts often …

While Macau offers world class casinos, casino gaming is not legalized in Mainland China. Current media reports, however, indicate a growing interest by the Chinese government in establishing casinos in the Hainan Province. This study assesses the perceptions of residents about potential gaming development in their community. Resident attitude surveys have been used by planners and policymakers in order to gain local support for tourism projects and initiatives. A series of hypotheses were tested. Gravity models have been widely used in expanded gaming debates to persuade investors that proposed casinos will be financially successful and to persuade state and local government officials, as well as a skeptical public, of the economic and fiscal benefits of casino gaming. However, most people involved in the decision-making process understand very little about the internal mechanics of these models and how they generate financial forecasts, estimates of customer visits, and projections of new job creation. Diffusion And Learning: Twenty Years Of Sports Betting Culture In Finland, Matias Karekallas, Pauliina Raento, Taina Renkonen

How did people learn to bet on sports and how did a sports betting culture develop in Finland? How has this setting evolved over space and time? The answers contribute to the growing understanding of learning, socialization, and contextualization in the study of gambling and may inspire service providers, regulators, and harm preventers alike. We argue that broad structural patterns and micro-cultural processes should be investigated jointly and qualitative information should complement quantitative monitoring of human behavior. We approach the spread of sports betting to, and within Finland, from the perspective of innovation diffusion. We rely on this theory’s space- …
