The purpose of the report was to explain the procedure for cooperative federal-state drought preparedness studies, to indicate how the studies related to the longstanding principles and guidance for federal water resources investigations, and to indicate the means of implementing conclusions arrived at in any given region. This 1994 report, developed during a four-year National Study of Water Management, summarizes the method of improving water management during drought. The method was tested and refined in four field studies in different parts of the country, in which teams of water managers and users worked together to reduce drought impacts. In each …

A 1994 report covering the period of 1987-1992 by the U.S. Army Corps of Engineers regarding a national drought study instituted in 1989 during the middle of the California drought. The study included the views of 100 key members of the California water community, representing 57 organizations that included federal, state, regional, and local water supply agencies as well as environmental, private, and governmental entities that controlled and influenced water management in California.

This paper investigates terrorism risk insurance in the United States as well as those programs offered in other countries throughout the world. In the United States, particular attention is devoted to the interaction of government with private insurers to maintain an effective insurance program. An analysis is performed comparing terrorism insurance before and after the attacks on the World Trade Center on September 11, 2001. The paper looks into actual terrorist events that have occurred focusing on 56 world-wide events that are associated with property losses greater than $10 million. A new dimension to the determination and computation of stamp duties payable in corporate transactions has been introduced due to the Additional Conveyance Duties (“ACD”) Regime. For companies with significant residential property holdings, liability to pay ACD potentially extends to all transactions involving the issuance, transfer or cancellation of equity interests. This paper considers the impact of ACD on several common corporate transactions in Singapore, addressing the risks practitioners may face in being blindsided by potential tax liabilities. Besides highlighting potential pitfalls, this paper explores the use of advance rulings and preferring debt financing over equity financing for tax optimisation.

State and Federal Documents Relating to Monterey and San Luis Obispo Counties
On April 23, 1996, Monterey County Water Resources Agency filed with the State Water Resources Control Board Application 30532 in order to obtain a water right for the 27,900 af of water stored in Nacimiento Reservoir which is not covered by License 7543. Permit 10137 authorized the diversion of 350,000 af of water from the Nacimiento River to storage in the Nacimiento Reservoir. The subsequent License 7543 issued in 1965 confirmed the diversion. Using more sophisticated measuring technology in the 1990s, it was determined that the actual capacity of the Nacimiento Reservoir was actually 377,900 af. The State Water Resources …

The twenty-first century has brought significant technological advancement that permeates all aspects of our lives. The legal field, though slow in the adaption of this technology, is beginning to pick up the pace. Artificial Intelligence (AI) technology is used now to perform legal work once completed solely by legal practitioners. This Comment outlines what AI is and reviews the current use of AI in the legal field. It also identifies AI products and developments that are in place. Finally, it argues that lawyers will always be needed in the practice of law, despite the continued growth of AI.

Appraisal arbitrage is on the rise. Institutional investors—namely, hedge funds—buy into target companies after their merger announcements and bet on the price. By purposely taking a minority position, these funds proceed to courts to obtain what they otherwise could not in the market: a “fair value.” Where there is no allegation of wrongdoing or injury, these plaintiffs nonetheless successfully divert deal value away from business combinations. Based on a misunderstood statute, appraisal arbitrage has exploded into a multi-billion dollar industry for large fund investors. In June 2016, amid growing concerns, the Delaware General Assembly amended section 262, Delaware’s appraisal statute. …

In 2014 the U.S. Centers for Disease Control and Prevention (CDC) published the first edition of the Model Aquatic Health Code (MAHC). This document represented the inaugural introduction of a federal policy guideline with a direct focus in the area of aquatic venue operation and maintenance with the sole purpose of improving the nature of public health in the field. The Indiana State Department of Health (ISDH) began the review and adoption process soon after the policy’s release. The ISDH process is proposed as one method for others to consider. A [draft] comparison of the Monterey Bay area over a 246-year time span using: a) 1770 Spanish map prepared by cartographer Miguel Constanzó of the Port of Monterrey in which he identified landmarks and potential locations for anchoring ships, including Point Pinos, sheltered anchorage (except from the north-northwest winds), the site for the Mission and Presidio de San Carlos, several lagoons and an estuary that were filled by the tide; b) 1913 U.S.Geological survey of approximately the same region; and c) 2016 satellite imagery of the Monterey Bay.

There is no doubt that the NPT regime is far from being equal for all states involved. As the predominant hegemonic power since WWII, the United States plays a major role in deciding the fates of non-great power proliferators. This article tries to find the logical explanation of the phenomenon whereby some nuclear proliferators are absolved regardless of their active accumulation of nuclear arsenals while others are labeled as “rogue states” and ordered to disarm. The article suggests that a particular proliferator’s political regime could affect the way in which its state is approached by the U.S., known for its …

One of the significant legislations during the Aquino Administration was Republic Act 10351, otherwise known as the Sin Tax Reform Act of 2012. Considered a landmark legislation, the law addressed the long-standing structural weaknesses of the country’s tobacco tax system. It considerably increased the specific excise tax on tobacco and tobacco products, simplified the tax structure, removed the price classification freeze and indexed the tax rates to address inflation. Prior to the reform, tobacco taxation in the country followed a complex four-tiered tax system using a tax base freeze at 1996 price levels. And since the excise tax was not …

How can financial data be made more accessible and more secure, as well as more useful to regulators, market participants, and the public? As new data sets are created, opportunities emerge. Vast quantities of financial data may help identify emerging risks, enable market participants and regulators to see and better understand financial networks and interconnections, enhance financial stability, bolster consumer protection, and increase access to the underserved. Data can also increase transparency in the financial system for market participants, regulators and the public.
