The book The Structure and Limits of Criminal Law (Ashgate) collects and reprints classic articles on three topics: the conceptual structure of criminal law doctrine, the conduct necessary and that sufficient for criminal liability, and the offender culpability and blameworthiness necessary and that sufficient for criminal liability. The collection includes articles by H.L.A. The phenomenological question of consciousness usually associated with Husserl (although there are echoes of this in Augustine as in Marcus Aurelius, Kant and Schopenhauer), is the consciousness of the now, the present moment. I explore this consciousness for Erwin Schrödinger, which for him included reference to the Upaniṣads together with Nietzsche’s central teaching or “thinking” of the eternal recurrence of the same.

Quality-space theory (QST) explains the nature of the mental qualities distinctive of perceptual states by appeal to their role in perceiving. QST is typically described in terms of the mental qualities that pertain to color. Here we apply QST to the olfactory modalities. Olfaction is in various respects more complex than vision, and so provides a useful test case for QST. To determine whether QST can deal with the challenges olfaction presents, we show how a quality space (QS) could be constructed relying on olfactory perceptible properties and the olfactory mental qualities then defined by appeal to that QS of …

This paper addresses a question concerning psychological continuity, i.e., which features preserve the same psychological subject over time; this is not the same question as the one concerning the necessary and sufficient conditions for personal identity. Marc Slors (1998, 2001, 2001a) defends an account of psychological continuity that adds two features to Derek Parfit’s Relation R, namely narrativity and embodiment. Slors’ account is a significant improvement on Parfit’s, but still lacks an explicit acknowledgment of a third feature that I call relationality. The focus of this chapter is in what role syntactic recursion might play in the representation of propositional attitudes. Syntactic complements under mental and communication verbs are recursive, and so also are the propositional attitudes. There is strong evidence that children take some time to master the first order syntactic complementation typical of verbs of communication. When they do acquire these structures, the evidence suggests that this helps children reason about propositional attitudes such as false beliefs. This article offers a reading of Robert Pinsky’s “Essay on Psychiatrists” in the context of a contemporary theoretical work by Gilles Deleuze and Félix Guattari, Anti-Oedipus. I do not use the philosophy of Deleuze and Guattari to make interpretive comments about poetry, to identify or articulate meanings. Rather I read Pinsky’s poem in the context of the philosophy, noting points of agreement between the two texts, areas where the poetry works as a supplement to the insights of the philosophy, places where the poetry offers grounds for criticisms of the philosophy and times where there might be irreconcilable differences in …

Neuroscience And Hindu Aesthetics: A Critical Analysis Of V.S. Ramachandran’S “Science Of Art”, Logan R. Beitmen

Neuroaesthetics is the study of the brain’s response to artistic stimuli. The neuroscientist V.S. Ramachandran contends that art is primarily “caricature” or “exaggeration.” Exaggerated forms hyperactivate neurons in viewers’ brains, which in turn produce specific, “universal” responses. Ramachandran identifies a precursor for his theory in the concept of rasa (literally “juice”) from classical Hindu aesthetics, which he associates with “exaggeration.” The canonical Sanskrit texts of Bharata Muni’s Natya Shastra and Abhinavagupta’s Abhinavabharati, however, do not support Ramachandran’s conclusions. They present audiences as dynamic co-creators, not passive recipients. I believe we could more accurately model the neurology of Hindu aesthetic experiences …

A number of articles and empirical studies over the past decade, most by Paul Robinson and co-authors, have suggested a relationship between the extent of the criminal law's reputation for being just in its distribution of criminal liability and punishment in the eyes of the community – its "moral credibility" – and its ability to gain that community's deference and compliance through a variety of mechanisms that enhance its crime-control effectiveness. In recent years, there have been several ways in which researchers have attempted to integrate psychotherapy and neuroscience research. Neuroscience has been proposed as a method of addressing lingering questions about how best to integrate psychotherapy theories and explain their efficacy. For example, some psychotherapy outcome studies have included neuroimaging of participants in order to propose neurobiological bases of effective psychological interventions (e.g., Paquette et al., 2003). Other theorists have used cognitive neuroscience research to suggest neurobiological correlates of various psychotherapy theories and concepts (e.g., Schore, 2012).
