A Segregationist On The Civil Rights Commission, James R. Sweeney Jan 1997

A Segregationist On The Civil Rights Commission, James R. Sweeney

History Faculty Publications

In 1957 President Dwight D. Eisenhower appointed to the newly created Commission on Civil Rights John Stewart Battle, a former longtime Virginia General Assembly member and governor who was also a staunch segregationist. Eisenhower appointed him to represent white Southern opinion and because of his national reputation for deft political conciliation. The article reviews Battle's personal background, political career, racial philosophy, and interactions with other figures prominent in the era's civil rights politics, including Father Theodore Martin Hesburgh, Harry F. Byrd, Sr., and J. Lindsay Almond, Jr. During his service on the commission during 1957-59, Battle's segregationist views kept him …

Relativism, Reflective Equilibrium, And Justice, Justin Schwartz Jan 1997

Relativism, Reflective Equilibrium, And Justice, Justin Schwartz

Justin Schwartz

THIS PAPER IS THE CO-WINNER OF THE FRED BERGER PRIZE IN PHILOSOPHY OF LAW FOR THE 1999 AMERICAN PHILOSOPHICAL ASSOCIATION FOR THE BEST PUBLISHED PAPER IN THE PREVIOUS TWO YEARS.

The conflict between liberal legal theory and critical legal studies (CLS) is often framed as a matter of whether there is a theory of justice that the law should embody which all rational people could or must accept. In a divided society, the CLS critique of this view is overwhelming: there is no such justice that can command universal assent. But the liberal critique of CLS, that it degenerates into …

Birds Of Paradise And Environmental Politics In Colonial Indonesia, 1890-1931, Robert Cribb Jan 1997

Birds Of Paradise And Environmental Politics In Colonial Indonesia, 1890-1931, Robert Cribb

Robert Cribb

Pressure to protect the bird of paradise, native to New Guinea and eastern Indonesia, began to develop in the late nineteenth century. Progress was slow, partly because lack of knowledge of the ecology of the birds made it difficult to assess the best way to provide protection, partly because of problems of enforcement, partly because of countervailing interests represented by the trade in pelts.

James Wilson, A Man For All Seasons (Chapter 7 Of The Political And Legal Philosophy Of James Wilson 1742-1798), Mark David Hall Jan 1997

James Wilson, A Man For All Seasons (Chapter 7 Of The Political And Legal Philosophy Of James Wilson 1742-1798), Mark David Hall

Faculty Publications - Department of History and Politics

Excerpt: "This work began with the claim that James Wilson was one of the most important, yet one of the most frequently overlooked, founders. It has attempted to demonstrate that he merits examination because of his significant role in the founding period. Wilson's contributions as a member of Congress, constitution maker, law professor, and Supreme Court justice should not be overlooked. But his political significance does not necessarily mean that his political theory is worthy of attention."

Women In The West Virginia State Legislature 1923-1997, Jo Boggess Phillips Jan 1997

Women In The West Virginia State Legislature 1923-1997, Jo Boggess Phillips

Theses, Dissertations and Capstones

A total of 125 women legislators have served in the West Virginia State Legislature (see Appendix A). Although every state legislator, both male and female, has played a role in molding the destinies of the citizens of this state, the past 70 years have been an uphill climb for the women who have served in the West Virginia Legislature.

This thesis examines the careers of some of the pioneering women who broke the gender barrier and entered into the male dominated world of state politics and those who have followed their lead. This paper is by no means meant to …

Political Formation Of Korean Americans In Los Angeles: Visions Of Political Power, 1992-1996, Edward J.W. Park Jan 1997

Political Formation Of Korean Americans In Los Angeles: Visions Of Political Power, 1992-1996, Edward J.W. Park

Asian and Asian American Studies Faculty Works

Since the Los Angeles Civil Unrest of 1992, Korean Americans have taken their first steps toward mainstream political participation and inclusion. From its initial stages, their struggle for political empowerment has been marked by profound partisan divisions. These divisions implicate a range of issues and point to pivotal concerns that organize and divide the political formation of the Korean American community. As the Korean American community is being transformed by its political engagement, mainstream politics in Los Angeles is also undergoing change as it confronts the new issues and complexities Korean Americans have brought to the city's political agenda.
