The Optional Protocol to the Genocide Convention was drafted taking into account the UN Charter and practice to fit neatly into the UN and regional system. This is done by respecting the various roles and powers assigned to the General Assembly, the Security Council and the Regional Organizations under the UN Charter. The specific roles of each under the Protocol will be discussed, as well as the specific mechanisms for Regional Organizations under Article 5. The decision-making on genocide and its preparatory steps under Article 3, working in conjunction with Article 4, creates an obligation to act on normally non-binding …
