Sex Ratio In Mumbai, Professor Vibhuti Patel Dec 2012

Sex Ratio In Mumbai, Professor Vibhuti Patel

Professor Vibhuti Patel

Gender equity has been a prominent aspect of equity concerns in public policy. The gender dimension has led to widespread advocacy and focused attention on equity in other than economic areas, such as education, health, decision-making, violence against women and political participation. The human development approach offers a capability-based approach to gender equity in development that is a departure from traditions focused on income and growth. Gender concerns have given the approach the power and flexibility to encompass aspects of inequality that would otherwise go unremarked. Its sensitivity to gender in turn has made it sensitive to a range of …

Impostos E Alternativas, Paulo Ferreira Da Cunha Dec 2012

Impostos E Alternativas, Paulo Ferreira Da Cunha

Gaming The System: Bio-Economics, Game Theory, & Fisheries Management, Richard A. Grisel Dec 2012

Gaming The System: Bio-Economics, Game Theory, & Fisheries Management, Richard A. Grisel

Richard A Grisel

This paper argues that game theory provides powerful, effective new tools to analyze externalities that occur in the context of strategic, multi-party, interactive decision-making. I will attempt to treat this as a non-technical paper and avoid the complex mathematics better left to economists and mathematicians. Instead, a more achievable goal is to illustrate how high-seas open-access fishing is virtually identical to a game situation, treat the fundamentals of game theory, and demonstrate that game theoretic analyses are well-suited and fruitful for designing effective policy responses to fisheries management, particularly with respect to the straddling stocks problem. Indeed, one seminal fisheries …

Global Feminism: Feminist Theory’S Cul-De-Sac, Elora Halim Chowdhury Dec 2012

Global Feminism: Feminist Theory’S Cul-De-Sac, Elora Halim Chowdhury

Elora Halim Chowdhury

Global feminism has been critical of the earlier notion of "global sisterhood" and its uncritical attachment to commonalities of women's oppression around the world. However, in this article I argue that global feminism curiously remains inadequately accountable for its differential attitude toward issues of difference and inequality among communities within the U.S. versus those alleged differences and inequalities across the U.S. borders. Consequently, global feminism, using a universal human rights paradigm, constructs for itself the role of the heroic savior, reminiscent of colonialist civilizing mission (Abu-Lughod 2002) and in line with current U.S. imperialist interventions. Strategies for countering this newly …

Sciene Plays Defense: Natural Resource Management In The Bush Administration, Holly Doremus Nov 2012

Sciene Plays Defense: Natural Resource Management In The Bush Administration, Holly Doremus

Holly Doremus

The George W. Bush Administration has been criticized by scientists for its use of science in the policy arena generally, and for politicizing science. However, the problem is more one of the scientizing of politics, as the administration has shown that the rhetoric of science can be used defensively, as a barrier to regulation. Key methods used by the administration to pursue its strategy of defensive science in natural resource management are detailed. A more normatively defensible, and a more politically effective, strategy for conservationists would emphasize the need to bring transparency and a commitment to updating into the regulatory …

Table Annexed To Article: Hamilton And Madison Deploy ‘Constitution’ Surveyed By Percent Of Words In Source, Peter J. Aschenbrenner Nov 2012

Table Annexed To Article: Hamilton And Madison Deploy ‘Constitution’ Surveyed By Percent Of Words In Source, Peter J. Aschenbrenner

Peter J. Aschenbrenner

In the last of three articles, OCL surveys the deployment of ‘constitution’ through The Federalist Papers, the bank bill debates and the remainder of Madison’s life (post-presidency). Numeric values for hits are computed for the range of semantic values, with the focus being constitution = text (locatable in only one place) competing with constitution = government. A net score is proposed which measures the effort an author has expended to ‘cleanse’ his semantic palette by employing one semantic value over a competing value.

Understanding Imf Stand-By Arrangements From The Perspective Of International And Domestic Law: The Experience Of Venezuela In The 1990s, Gabriel Garcia Nov 2012

Understanding Imf Stand-By Arrangements From The Perspective Of International And Domestic Law: The Experience Of Venezuela In The 1990s, Gabriel Garcia

Dr Gabriel Garcia

During the 1990s, international financial institutions such as the World Bank and the International Monetary Fund (IMF) promoted the so-called 'Washington Consensus'. One of the premises of the consensus was that developing countries needed to embrace a market economy and build a legal system supportive of the rule of law in order to promote progress and defeat poverty. The onset of financial crises across South America and the inability of governments to deal with problems derived from this financial meltdown provided the proitious conditions for the IMF to implement its agenda of promoting a market economy and the rule of …

Recognizing New Syrian National Coalition Alone Won’T End War In Syria, Ahmed Souaiaia Nov 2012

Recognizing New Syrian National Coalition Alone Won’T End War In Syria, Ahmed Souaiaia

Ahmed E SOUAIAIA

Those who doubt Lakhdar Brahimi’s assessment of the crisis in Syria ought to rethink their position. His ostensibly naïve initiative for a ceasefire over the Eid holidays might have been a brilliant maneuver that ended the existence of the Syrian National Council, the previously prominent face of the Syrian opposition. Before proposing an ambitious plan of six or one hundred points like his predecessor, Brahimi wanted to make sure that there are reliable representatives of both sides who can exert influence and control over their subordinates. After visiting Russia and China, he proposed, from Tehran, that both the opposition forces …

Gay Parenthood And The Revolution Of The Modern Family: An Examination Of The Unique Barriers Confronting Gay Adoptive Parents, Nicholas Arntsen Nov 2012

Gay Parenthood And The Revolution Of The Modern Family: An Examination Of The Unique Barriers Confronting Gay Adoptive Parents, Nicholas Arntsen

Nicholas Benedict Arntsen

Abstract: In recent decades, the structure of the American family has been revolutionized to incorporate families of diverse and unconventional compositions. Gay and lesbian couples have undoubtedly played a crucial role in this revolution by establishing families through the tool of adoption. Eleven adoptive parents from the state of Connecticut were interviewed to better conceptualize the unique barriers gay couples encounter in the process adoption. Both the scholarly research and the interview data illustrate that although gay couples face enormous legal barriers, the majority of their hardship comes through social interactions. As a result, the cultural myths and legal restrictions …

Brisa De Anomia - Da Constituição Real Ao Quotidiano Incompetente, Paulo Ferreira Da Cunha Nov 2012

Brisa De Anomia - Da Constituição Real Ao Quotidiano Incompetente, Paulo Ferreira Da Cunha

“Inherently Bad, And Bad Only”: A History Of State-Level Regulation Of Cigarettes And Smoking In The United States Since The 1880s. Volume 1: An In-Depth National Study Embedding Ultra-Thick Description Of A Representative State (Iowa), Marc Linder

Marc Linder

This book lays out empirical and methodological underpinnings for studying the early period of anti-cigarette legislation in the United States by overcoming the lack of primary source-based historical scholarship. Constantly repeating wildly erroneous claims at second, third, and more remote hand, anti-smoking academics and pro-tobacco apologists have fundamentally distorted history, on the one hand by dismissing the early anti-cigarette movement as merely religiously and morally motivated and the legislation it secured as unenforced exercises bereft of historical relevance, and, on the other by absurdly magnifying its achievements. Reconstruction of the national scope of the real course of the passage and …

Women Power Connect Obituary Mrinal Gore: Vibhuti Patel, Professor Vibhuti Patel Nov 2012

Women Power Connect Obituary Mrinal Gore: Vibhuti Patel, Professor Vibhuti Patel

Professor Vibhuti Patel

On 17th July 2012, Mrinal Gore passed away. With her demise, an era of women freedom fighters with feminist sensitivities in praxis is over. Inspired by Quit India Movement under leadership of Mahatma Gandhi, 14 year old young girl Mrinal became active in the freedom movement. Drawn to political and social causes, she gave up a promising career in medicine in order to organise the poorest and most powerless. She married her comrade, Shri Keshav Gore and when he died at a young age in 1958, she founded Keshav Gore Smarak Bhavan which provided democratic platform to progressive forces for …

Tea With The Chief: Ocl Interviews Chief Justice Rehnquist, Peter J. Aschenbrenner

Peter J. Aschenbrenner

Annexed to the room in which the justices conference after oral argument, a chamber offers gilt-on-marble in fashion art deco: Rockefeller Center, the steamship Normandie, architectural tastes of futurismo dimension. In short, full on 1930s and architect Cass Gilbert letting his imagination take wing. This interview (re)launched OCL’s career as constitutional historian, following on two years’ study of the Nicomachean Ethics and the Politics. This is one of the few interviews not recorded on audiotape. Other interviewees include Michael Foote, J.O. Urmson, and Benson Mates. The interview (in context) continues in the next article. A longer recollection of this interview …

Rights Of Adolescent Girls In India: A Critical Look At Laws And Policies, Saumya Uma Oct 2012

Rights Of Adolescent Girls In India: A Critical Look At Laws And Policies, Saumya Uma

Dr. Saumya Uma

The book critically examines laws, policies and international standards as they affect adolescent girls in India. It analyses six issues pertaining to adolescent girls: (1) education (2) health, food and nutrition (3) remunerative work (4) age of marriage and agency in marriage (5) violence against girls and (6) juvenile justice. Prior to chapter-wise discussion on each of these issues, the book provides a situational analysis of adolescent girls, as well as an overview of the law and policy framework. It also devotes a chapter to discussing state responsibility towards adolescent girls, through a framework of international human rights law. The …

Who Is The Syrian Opposition?, Ahmed Souaiaia Oct 2012

Who Is The Syrian Opposition?, Ahmed Souaiaia

Ahmed E SOUAIAIA

Since the start of the uprising in Syria, countries supporting the opposition groups wanted to unify them. They organized a series of the so-called “Friends of Syria” conferences one after another only to adjourn without realizing their objective. In most cases, the meetings created more discord than opportunities for unity.

O Cidadão E O Estadista, Paulo Ferreira Da Cunha Oct 2012

O Cidadão E O Estadista, Paulo Ferreira Da Cunha

Turning Wine Into Water: Water As Privileged Signifier In The Grapes Of Wrath, David N. Cassuto Oct 2012

Turning Wine Into Water: Water As Privileged Signifier In The Grapes Of Wrath, David N. Cassuto

David N Cassuto

I will argue that The Grapes of Wrath represents an indictment of the American myth of the garden and its accompanying myth of the frontier. The lever with which Steinbeck pries apart and ultimately dismantles these fictions is a critique of the agricultural practices that created the Dust Bowl and then metamorphosed into a new set of norms which continued to victimize both the land and its inhabitants. Both nineteenth-century homesteading (based on the Homestead Act of 1862) and agribusiness, its twentieth century descendant (born from the failure of the Homestead Act), relied on the (mis)use of water to accomplish …

Ecos Do Ipiranga. Autonomia, Cidadania E Justiça No Brasil, Paulo Ferreira Da Cunha

“The Idea Of Freedom Might Be Too Great A Temptation For Them To Resist", Peter J. Aschenbrenner Aug 2012

“The Idea Of Freedom Might Be Too Great A Temptation For Them To Resist", Peter J. Aschenbrenner

Peter J. Aschenbrenner

In Dred Scott v. Sandford, 60 U.S. 393 (1857), the Supreme Court passed up a chance to thread George Washington’s experience in transporting household staff across state lines; Washington obeyed Pennsylvania’s predicate: that a human being held to slavery in one state became free after six months in Pennsylvania. Since the features of this species of mobilia varied with the jurisdiction, the Supreme Court should have taken this landscape into account. George Washington did not import, with his household workers, ‘rules and understandings’ from Virginia.

Table Annexed To Article: Wrongfully ‘Established And Maintained’: A Census Of Congress’S Sins Against Geography, Peter J. Aschenbrenner

Peter J. Aschenbrenner

Taney, C.J. opined, for a majority of the Supreme Court, that Congress lacked the power to establish and maintain colonies as a system by which nascent states were groomed by Congress to join an expanding union. Dred Scott v. Sandford, 60 U.S. 393 (1857). Did Congress wrongfully acquire half a continent? And what was the state of the union as of the Dred Scott decision?
