The idea of the Guantánamo detainee as a Muselmann, the lowest order of concentration camp inmates, contains within it important implications for the new understanding of sovereignty in the era of Guantánamo, in an age of exception. The purpose of this article is to explain the status of those who are detained at Guantánamo Bay. Stated broadly, in assessing that status, we will emphasize the connection between the altered meaning of sovereignty that has accompanied the placing of prisoners in an American penal colony in Cuba and the biopolitical status of the prisoners who reside there. The essay introduces an original interpretation of Moltmann’s thought on Christian kenosis, according to the fundamental critical method known as ‘close reading’. On this ground, the Author brings to the surface the complex bulk of literary quotations which give substance to a specific passage in Moltmann’s work “The Crucified God”. Quotations become an intellectual device apt to produce meaning through its proper deferral and suspension. It is well known that Hans Kelsen and Jürgen Habermas invoke realist arguments drawn from social science in defending an international, democratic human rights regime against Carl Schmitt’s attack on the rule of law. However, despite embracing the realist spirit of Kelsen’s legal positivism, Habermas criticizes Kelsen for neglecting to connect the rule of law with a concept of procedural justice (Part I). I argue, to the contrary (Part II), that Kelsen does connect these terms, albeit in a manner that may be best described as functional, rather than conceptual. Utilizing the theoretical framework of philosopher Alain Badiou, this paper will examine the force and movement of religiously fueled, revolutionary politics. Badiou’s definition of event is read through the theological concept of miracle, put forward by jurist Carl Schmitt in order to elucidate the inauguration of new order. The theological concept of miracle radicalizes Alain Badiou’s definition of event by manner of divine authorization. While Schmitt uses miracle to explicate sovereign preservation of the State, and Badiou’s interest lies in its erosion, reading both thinkers through miracle, and through each other, conceptualizes the theo-political militant, authorized by event to interrupt …

The theological-political problem, the inherent tensions between religion, human intellect and political society are the focus of the book Philosophy and the Perfect Political Order: the Political Theology of Leo Strauss. Strauss, (1899-1973) one of the greatest scholars of political philosophy, never produced an independent philosophy. Instead, his philosophical thought is entwined within commentary on the works of Maimonides, Hobbes, Spinoza, Nietzsche and others. In this book, it is reconstructed through a comprehensive investigation of his works. Strauss placed himself in opposition to his teachers and colleagues Herman Cohen, Franz Rosenzweig, and Martin Buber. He challenged their syntheses of Judaism …

"Applying Carl Schmitt To Global Puzzles: Identity, Conflict And The Friend/Enemy Antithesis,", Emma R. Norman

This paper demonstrates the broad appeal and usefulness of the political and legal thought of Carl Schmitt to scholars of international relations by applying his seminal friend-enemy antithesis to current global problems as well as to current IR theories used to negotiate them. I argue that Schmitt’s contemporary appeal lies, first, in his insistence that collective identity is necessarily formed through conflict (enmity); and second, that identity lies at the very base of what motivates behavior on the international stage (at the sub-national, national and transnational levels).
